WRONG. U.S. Constitution says a presidential term officials ends at noon on the 20th of January.

 

20th Amendment: The terms of the President and the Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.

WRONG. The oath is NOT symbolic. It IS WRITTEN IN THE CONSTITUTION.

 

Article II, Section I of the United States Constitution holds:

 

Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:–"I do solemnly swear (or affirm) that I will faithfully

execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."

 

The oath for president was administered when there was a president in office. The oath cannot be administered before noon, or it is VOID.

28 U.S.C. 3002(15)(A) holds that:

 

(15) “United States” means—

(A) a Federal corporation;

(B) an agency, department, commission, board, or other entity of the United States; or

(C) an instrumentality of the United States.

 

Most of us learned/assumed that the United States is the federal government of the United States, when say, the United States charges someone with a crime. That’s NOT how the U.S. Code defines “United States”

Once an individual completes the Oath, he (or she) is President of the United States, under Art. II, s. 1 and the 20th Amendment. It’s not a bullshit theory. It says so in plain English. Enforcing it is another story.

The Chief Justice said to Biden: “Congratulations, Mr. President” after the oath was completed. It was before noon at that point. The oath was void.
