Why would there have been 2 presidents at the same time? The constitution declares exactly when the switch over happens. The "swearing in" ceremony is symbolic and not related to when the power transfers.

That act was repealed in 1874, and furthermore all it did was create a government to run DC by replacing the Georgetown and Washington city charters. ALSO that law clearly states that the DC municipal government it is creating is subservient to the constitution, it says it multiple times.
