It seems unlikely that anyone smart enough to operate the functions referenced would believe that they were a substitute for actual voting, especially since NEITHER party had made ANY reference to voting in this manner.

If the liberal is not even charged for a post which is very nearly a quote of the conservative post, I find it difficult to believe that the conservative committed any crime at all. He should be just as safe behind the shield of comedy as she is.

Without such enforcement, there IS no problem. There is no such thing as "merely" when it comes to unconstitutional laws if the law is worded or applied in such a manner as any person with sufficient education as to become a sworn officer of the court should reasonably know it to be unconstitutional.

Sorry, putting on the uniform does not absolve you of responsibility for wrong-doing. If anything, it carries with it a heightened expectation of integrity.
