Senate Panel to Hold Hearing on ‘Current State of Stock Market’

"People on Wall Street only care about the rules when they're the ones getting hurt"

Reports now suggest that a panel in the Senate will hold a hearing on the “current state of the stock market,” after Congressmen from both parties supported one.

Bloomberg now reports that incoming Senate Banking Chairman, Sherrod Brown, will hold a hearing on the “current state of the stock market,” as ordinary daytraders face off against hedgefunds in a massive short squeeze of GameStop stocks, netting Americans huge profits as shorters face losses of around $70 billion.

“People on Wall Street only care about the rules when they’re the ones getting hurt. American workers have known for years the Wall Street system is broken – they’ve been paying the price,” Brown said in a statment. “It’s time for the SEC and Congress to make the economy work for everyone not just Wall Street,” he added, saying a hearing was very necessary to “do that important work.”

Robinhood, one of America’s most popular free trading platforms, shut down buy orders on GameStop and other “meme stocks” supported by the users of Reddit’s r/WallStreetBets forum, claiming that due to “the recent volatility” they had to only allow “position closing only,” sending many of the stocks in a nosedive. As National File reported:

As a result of their shenanigans, a class action lawsuit has been filed against Robinhood in the Southern District of New York, claiming that Robinhood delisted GameStop from its app and stopped the buying of shares in it and other memestocks “in order to slow the growth of GME… [and was] done purposefully and knowingly to manipulate the market for the benefit of people and financial institutions who were not [their] customers.”

Accusations had already been flying of collusion and corruption between Robinhood and Wall Street, with some users highlighting that Robinhood’s “primary revenue stream” last year was from selling orders to hedgefunds like Citadel Securities. Citadel bailed out Melvin Capital, the hedgefund that took the biggest hit from their attempt to short GameStop.

Congressmen from across the political spectrum had been calling for a hearing into Robinhood’s behaviour before Brown’s announcement. In a tweet, Representative Alexandria Ocasio-Cortez described the situation as “unacceptable,” and saying that she would support a Congressional hearing as a member of the Financial Services Committee, to which Senator Ted Cruz said he fully agreed.

Representatives Rashida Tlaib and Dr Paul Gosar also joined in. Tlaib said that the “absurd” situation was tantamount to obvious “market manipulation… to protect Wall St hedge funds,” while Gosar highlighted this was another example of Big Tech colluding with people, in this case Wall Street, “in a clear Securities Exchange Act violation and Sherman-Anti Trust violation.”

It is unclear whether the hearing announced by Brown would cover the actions of Robinhood, although the language in his statement suggests the panel would be far more focused on the actions of the Wall Street firms themselves, rather than the day investors.

Senator Pat Toomey, who is currently tipped to be the top Republican on the Banking Committee, did specifically call out Robinhood and some of the other platforms blocking the trades. “I find it very disturbing that a platform would suddenly freeze out investors,” Toomey said. “People should be free to make the investment decisions they choose.”

Failed FF?

Pedestrians run for cover as car races through central Melbourne, driver escapes

Sergio Arellano, who lost the recent election for Chairman of the Arizona Republican Party to Kelli Ward and proceeded take the stage alongside Ward and call for unity, is now challenging the election results. National File recently obtained a background report on Arellano, which reveals he has a lengthy history of traffic offenses, including driving without a license or proof of insurance, and was once accused by law enforcement of passing bad checks.

In a statement that was apparently exclusively provided to USA Today affiliate AZ Central, Arellano demanded an audit of the recent Arizona Republican Party election, despite only approximately 1,300 total votes being cast.

As AZ Central reported, “’This isn’t about the chairman’s race, this is about election integrity,” Arellano said in a written statement provided by [Kim] Owens to The Arizona Republic.'”

On Twitter, Arellano wrote about his decision to contest the election despite conceding, noting that he does not expect the audit to overturn the election results.

2) state committeemen are raising concerns and asking me to ask for an audit because only a candidate for party office can do so. So I've done that and we're waiting for a response that lays out the when, where, and how of that process.

— Sergio Arellano (@SurgeArellano) January 28, 2021

The background report obtained by National File reveals that, since 2000, Arellano has been involved in several separate encounters with law enforcement for traffic violations ranging from mundane speeding citations to failure to drive with a vehicle’s registration, a valid license, or proof of insurance. Arellano pleaded guilty to several of these charges.

Additionally, Arellano was accused of passing bad checks in 2002.

On September 1, 2000, Arellano pleaded guilty for failing to produce evidence of his car insurance and failure to carry his vehicle’s registration.

Less than a year later, on January 17, 2001, Arellano was accused of driving without insurance. Though this was dismissed, at the same time, Arellano was accused of riding as a passenger in a vehicle drive by someone, ostensibly an adolescent, who only had an instruction permit to begin learning how to drive, when he himself did not have a driver’s license. Arellano pleaded guilty to this charge.

Days later, on January 26, 2001, Arellano pleaded guilty to driving without a driver’s license.

On August 10, 2017, Arellano was again alleged to be driving without proof of insurance and driving without a license or driving with a license that was suspended. These charges were dismissed by the prosecuting attorney.

This happened again, however, on May 8, 2018. The charge was, again, dismissed by the prosecuting attorney.

Steve Cohen and Dave Portnoy feud over GameStop on Twitter

A real life rumble over GameStop between Wall Street and Main Street broke out Thursday between hedge fund billionaire Steve Cohen and day-trading poster boy Dave Portnoy.

The back-and-forth kicked off when Portnoy, founder of blogging site Barstool Sports, blasted Cohen, the billionaire owner of the Mets, for restrictions on trading apps like Robinhood that have hurt novice investors behind the spectacular rally in small stocks like Gamestop.

“PRISON TIME,” Portnoy said in a tweet that linked to Cohen, founder of Point72 Capital, as well as Citadel, a hedge fund run by billionaire Ken Griffin.

“Dems and Republicans haven’t agreed on 1 issue till this. That’s how blatant, illegal, unfathomable today’s events are. It also shows how untouchable @RobinhoodApp @StevenACohen2C Citadel Point72 all think they are. Fines aren’t enough. Prison or bust.”

Hey Dave , What’s your beef with me. I’m just trying to make a living just like you.Happy to take this offline

— Steven Cohen (@StevenACohen2) January 28, 2021

Portnoy made the comment while linking to a news article reporting anger from legislators over Robinhood trading restrictions forbidding users from buying certain stocks, including GameStop.

Cohen snapped back: “Hey Dave , What’s your beef with me. I’m just trying to make a living just like you.Happy to take this offline.”

“I don’t do offline. That’s where shady shit happens,” Portnoy said.

He then accused Cohen of having a hand in controversial restrictions on trading apps like Robinhood that are hurting novice investors behind the spectacular rally in small stocks like Gamestop. Hedge funds have lost billions in the rally by shorting these stocks, including Cohen’s Point72, which is down a more than 10 percent.

“I think you had strong hand in todays criminal events to save hedge funds at the cost of ordinary people. Do you unequivocally deny that?,” Portnoy said.

Biden State Dept Reviewing Trump’s Xinjiang ‘Genocide’ Declaration

During Senate confirmation hearings for Joe Biden’s pick for United Nations Ambassador, Linda Thomas-Greenfield Revealed the State Department is reviewing the Trump administration’s decision to label the Chinese Communist Party’s repression in Xinjiang as “genocide.”

Senator Marco Rubio inquired with Thomas-Greenfield, a long-time Chinese Communist Party-linked consultant and speaker, as to whether or not the Chinese Communist Party’s actions conduct in the region constituted

“genocide.”

Thomas-Greenfield refused to affirm the label, instead revealing Biden’s State Department is reviewing the Trump administration’s January 19th designation:

What they’re doing there has been referred to as genocide, and I know that the State Department is reviewing that as we speak. What they’re doing is horrific, and I look forward to seeing the results of the review that’s being done but certainly.

Senator Rubio follows up:

The State Department issued a designation I believe on the President’s last day, so is your understanding that it’s now being reviewed by the State Department to see if that’s appropriate?

“I think the State Department is reviewing that now because all of the procedures were not followed, and I think they’re looking to make sure that they are followed to ensure that that designation is held,” Thomas-Greenfield notes.

US Police Chief Calls for Permanent Fencing Around Capitol Building Amid Security Concerns

In the days since the deadly January 6 Capitol riot, congressional lawmakers and law enforcement officials have been analyzing protocol and raising questions over security plans at the federal building, specifically how best to strengthen measures.

In light of a multitude of security failures that unfolded on January 6, acting US Capitol Police Chief Yogananda Pittman is calling for permanent fencing to be installed around the historic grounds.

In addition to the fencing, Pittman also highlighted in a Thursday statement the importance and necessity of establishing additional security forces near the Capitol to assist Capitol police should a situation occur.

“As I noted earlier this week, even before September 11, 2001, security experts argued that more needed to be done to protect the US Capitol. In fact, a 2006 security assessment specifically recommended the installation of a permanent perimeter fence around the Capitol,” Pittman noted.

“In light of recent events, I can unequivocally say that vast improvements to the physical security infrastructure must be made to include permanent fencing, and the availability of ready, back-up forces in close proximity to the Capitol.”

At present, three security assessments are being conducted by Capitol police, the agency’s inspector general and a third party entity under the orders of House Speaker Nancy Pelosi (D-CA).

Fencing currently installed near the US Capitol was erected in days after hundreds of Trump supporters stormed the building in a failed effort to stop the electoral certification of the US election, resulting in five deaths, including a Capitol police officer. Much of the 7-foot-high, non-scalable fencing has been topped with razor wire as an added measure for deterrence.

One day after the deadly Capitol riot, the Secretary of the Army Ryan McCarthy revealed that the fencing would stay in place for at least a 30-day period.

The latest development came as federal officials have warned that individuals emboldened by the violent insurrection may be planning to stage similar attacks in the coming days and weeks. The Department of Homeland Security issued a warning through its National Terrorism Advisory System alerting Americans of a “heightened threat" from possible domestic extremists.

NYPD cop charged with soliciting sick videos from 46 minors on Twitter

NEW YORK — (DOJ, Eastern District of New York) — A criminal complaint was filed today in federal court in Central Islip charging Carmine Simpson with the sexual exploitation of children. The charges relate to sexually explicit images and videos of children that the defendant requested and received from minors who he targeted on Twitter. Simpson was arrested today and will make his initial appearance via videoconference this afternoon before United States Magistrate Judge A. Kathleen Tomlinson.

Seth D. DuCharme, Acting United States Attorney for the Eastern District of New York and William F. Sweeney, Jr., Assistant Director-in-Charge, Federal Bureau of Investigation, New York Field Office (FBI), announced the arrest and charge.

“Instead of protecting the community as a sworn police officer, the defendant has preyed upon and sexually exploited the most vulnerable members,” stated Acting United States Attorney DuCharme. “The protection of innocent children is a priority for the Department of Justice and this Office will continue to make every effort to ensure that those who contribute to the victimization of children will be brought to justice.” Mr. DuCharme extended his grateful appreciation to the FBI Violent Crimes Against Children Squad for its investigative work and the New York City Police Department (NYPD) for its assistance on the case.

“As a law enforcement officer, Mr. Simpson swore an oath to protect the public he served. We allege he chose instead to manipulate some of our society’s most vulnerable citizens when he repeatedly enticed children to create sexually explicit videos and photos,” stated FBI Assistant Director-in-Charge Sweeney. “Much of this activity occurs through popular social media sites, so I’d ask parents and guardians to take some time to talk with your children about their online activities. You are the first line of defense in protecting our youth from predators. A moment of your time can save a lifetime of trauma. If you believe someone is trying to entice or sexually exploit your child, please report it to us by calling 1-800-CALL-FBI or going to tips.fbi.gov.”

According to court filings, Simpson, a police officer with the NYPD, allegedly targeted vulnerable children on Twitter for the purpose of having them create sexually exploitative photos and videos of themselves for the defendant. Simpson often represented to his victims that he was 17 years-old, and he sent them pictures of himself where he applied a filter to alter his own appearance so that he appeared younger. Simpson communicated with at least 46 children who appear to have been between the ages of 13 and 17. On Twitter alone, Simpson obtained at least 18 photographic images and 33 videos containing sexually exploitative material from children

If convicted of sexual exploitation of a child, Simpson faces a mandatory minimum of 15 years’ imprisonment. The charges in the complaint are allegations, and the defendant is presumed innocent unless and until proven guilty.

Has the Robinhood App Been Unmasked as the Sheriff of a Rotten System?

Thursday morning, untold numbers of people who invest in the stock market through the Robinhood app got an unpleasant surprise. The app informed them via instant message that they had canceled buying GameStop stock (symbol: GME). These individuals had not, in fact, canceled their buys. Robinhood canceled them, but pushed the action of canceling onto the customer.

Ironic, given Robinhood’s claims about its reason to exist.

Robinhood might amend that to “Let the people trade…as long as our hedge fund backers want them to.”

The unilateral cancelation of GME buys rocked the price and is not sitting well. Users have filed a class-action lawsuit against the app.

Discovery is going to be interesting.

This is all in response to the Reddit r/wallstreetbets collective action to buy stock in the struggling but popular video game seller GameStop—to wreck the hedge fund Melvin Capital, which stood to gain on GME’s stock price falling. Melvin had overleveraged itself betting on that stock’s decline. Driving GME’s price up to new heights would put Melvin in a major and potentially catastrophic bind while potentially making the stock’s buyers very rich if they bought it at about $6 per share and it rocketed up into the hundreds. Most of the buyers from the r/wallstreetbets brigades were buying the stock fractionally via Robinhood, which bills itself as a free stock trading app. How free is it? Perhaps the class-action lawsuit will get to the bottom of that.

Trading stock on the belief that its value will rise or decline is perfectly legal. But unilaterally stopping people from trading, in order to shore up another hedge fund’s reported bailout of Melvin Capital, and impacting the value of the stock in question, might not be.

Melvin has reportedly been shored up by an investment from another hedge fund, Citadel Securities. Here’s where things get sticky. According to The Week:

Robinhood has framed the decision (to unilaterally stop the trading) as a way to “help our customers navigate this uncertainty” in its blog post. The Verge meanwhile noted one hedge fund suffering amid the GameStop surge was Melvin Capital Management, which another hedge fund, Citadel, has since bailed out. Citadel’s founder is Ken Griffin, who also founded Citadel Securities, a big investor in Robinhood that also works with TD Ameritrade and Charles Schwab.

The messages Robinhood sent to blocked buyers didn’t help anyone navigate anything. They merely said, incorrectly, that the buyer had canceled the buy. Robinhood had canceled the buy. Why and on whose behalf?

Things get even stickier. On Wednesday, a reporter asked White House spokeswoman Jen Psaki about the GME stock trading. Psaki attempted to deflect by reminding us that America has its first woman Treasury Secretary (Janet Yellen) who is “monitoring the situation.” Unusually, there was no Psaki promise to “circle back.” That’s flak-speak for “I don’t know but I don’t want to say ‘I don’t know’ so I’ll say I’ll get back to you in a way that sounds smart and trendy.”

Narrator voice: It’s neither smart nor trendy. It’s already been exposed as a crutch.

Psaki’s punt may have put the Biden administration in a bind with her short-sightedness.
