The White House on Monday confirmed illegal aliens who are convicted of rape, assault, DUI or drug-related crimes will not be deported.

 

US Immigration and Customs Enforcement is preparing to roll out new guidelines that will lead to far fewer arrests and deportations.

U.S. Immigration and Customs Enforcement is preparing to issue new guidelines to agents this week that could sharply curb arrests and deportations, as the Biden administration attempts to assert more control over an agency afforded wide latitude under President Donald Trump, according to internal memos and emails obtained by The Washington Post.

 

“Generally, these convictions would not include drug based crimes (less serious offenses), simple assault, DUI, money laundering, property crimes, fraud, tax crimes, solicitation, or charges without convictions,” acting director Tae Johnson told senior officials in a Thursday email advising them on how to operate while new guidelines are finalized.

 

The Biden administration is attempting to reorient ICE, a law enforcement agency that has seen its priorities swing wildly from one administration to the next. But frustrated ICE officials say the proposed changes will take away agents’ discretion and severely constrain their ability to arrest and deport criminals.

 

Fox News reporter Peter Doocy asked Jen Psaki how it is in the interest of public safety to no longer deport illegal aliens convicted of DUI and assault.

 

Psaki was clearly ill-prepared and stuttered through her non-answer.

Former Rivals Agree On Draghi To Lead Apolitical "Unity" Government In Italy

 

It has been nearly a week since former ECB President Mario Draghi accepted Italian President Sergio Mattarella's urgent request to form a new government of national unity after Italy's ruling coalition collapsed in a heap of acrimony.

 

This followed almost two years of being led by former law professor PM Giuseppe Conte, whose rule received plaudits from international technocrats, even as his colleagues in the parliament grew increasingly irritated, finally forcing Conte to resign late last month.

 

Conte's departure, and the collapse of yet another Italian government, clearly made the international neoliberal cabal anxious: should Italian lawmakers fail to agree, they worried, it could further destabilize Europe. So they hatched a plan: They would install former ECB President Mario Draghi to lead Europe's third-largest economy (despite being the archetypal "Davos Man", Draghi is still Italian after all) until the next scheduled election in 2023.

 

Offering some insight into just how terrified Italy's political parties have become of being blamed for the crash, the FT reported Monday that both the Five Star Movement and the League, formerly two partners in a ruling coalition, are pledging their support for Draghi, even after the Five Star slammed Draghi as a member of the "establishment" (akin to being labeled as a capitalist during the cultural revolution). Meanwhile, the League (Italy's right-wing anti-establishment and euroskeptic), has flirted with backing Draghi. League leader Matteo Salvini has said he would walk away if Five Star also backed Draghi has been an economist and a bureaucrat for his entire career, and thus has no history in electoral politics. But he still has a pretty strong reputation for his leadership of the ECB during the European debt crisis nearly a decade ago.

 

Five Star was founded by comedian Beppe Grillo, who - though he has been barred from running for office - retains an almost reverent appeal for many Italians. Although Salvini was the first to sign on, saying his party, the League, might be open to backing Draghi (Five Star's leaders initially ruled it out), he might have trouble following through with his promise for political reasons, as one professor explained to the FT.

 

Matteo Ricci, a former deputy leader of the Democratic party, said that the shift to supporting Draghi would be easier for the Five Star Movement than for the League, which has until recently remained far more hostile to Brussels.

 

“Over the years the Five Star Movement made a pro-European choice, the League has never made this choice,” he said.

 

“Salvini’s past with Le Pen and the other European sovereigntists speaks for itself.”

 

Though the new unity government's membership has yet to be decided, it's looking increasingly likely that Draghi is on track to win here (hardly a surprise, given the circumstances, and widespread fears about suffering more economic distress) However, we wouldn't be surprised to see markets, especially the spread between BTPs and German bunds (the 10-YRs), price in a little (or even a lot) more anxiety as all of Europe waits on tenterhooks for the decision.

Biden Quietly Revokes Trump’s Ban on Chinese Communist Propaganda in Schools

 

President Biden quietly revoked a Trump-era policy that compelled primary, secondary, and postsecondary institutions to disclose their relationships with Chinese Communist Party-funded Confucius Institutes.

 

The policy – “Establishing Requirement for Student and Exchange Visitor Program Certified Schools to Disclose Agreements with Confucius Institutes and Classrooms” – was proposed on December 31st, 2020.

 

“The rule would require colleges and K-12 schools that are certified to have foreign exchange programs to disclose any contracts, partnerships, or financial transactions from Confucius Institutes or Classrooms (the Confucius Institute offshoot for primary and secondary schools),” Axios noted.

 

And the Trump administration’s proposals were well-warranted: the well-funded, controversial operations disguise themselves as language and culture initiative despite being replete with “undisclosed ties to Chinese institutions, and conflicted loyalties,” Chinese state propaganda, and intellectual property theft, according to the Federal Bureau of Investigation (FBI) and U.S. Department of Justice (DOJ).

 

Records from the Office of Information and Regulatory Affairs, however, reveal that Biden nixed the policy on January 26 – less than a week into his White House tenure.

 

“A spokesperson for U.S. Immigration and Customs Enforcement confirmed that the policy was rescinded,” Campus Reform noted.

Gab’s success is particularly remarkable, considering the fact that the website has been “deplatformed” from mobile app stores, PayPal, and email marketing services.

 

The official Gab Twitter account revealed that the website had far outperformed legacy media on Monday, posting “Gab: ~272 million in Jan” next to a screenshot of traffic numbers from various corporate legacy media outlets.

Iowa's governor lifts statewide COVID mandates, encourages personal responsibility: No more mandatory masks, social distancing, or gathering restrictions

 

A couple of major cities are not thrilled

 

As of Sunday, citizens of the Hawkeye State are free to make more decisions for themselves as responsible adults following Republican Gov. Kim Reynolds' decision to lift several notable statewide coronavirus restrictions.

 

On Friday, Reynolds issued a proclamation repealing the state's limited mask requirements, social distancing requirements, and limits on gatherings, the Des Moines register reported.

 

Instead of the government mandating behavior of adults and continuing what has essentially become the quarantining of healthy people, Reynolds' proclamation promotes personal responsibility and common sense, as noted in Section One:

 

I continue to strongly encourage all vulnerable Iowans, including those with preexisting medical conditions and those over than 65, in all counties of the state to continue to limit their activities outside of their home, including their visits to businesses and other establishments and their participation in gatherings of any size and any purpose. And I encourage all Iowans to limit their in-person interactions with vulnerable Iowans and to exercise particular care and caution when engaging in any necessary interactions.

 

The proclamation, which extended Iowa's state of public health disaster emergency through March 7, went into effect Sunday morning and focuses on encouraging Iowans to take personal responsibility and make decisions that are in the best interest of their health during the pandemic.

 

The governor imposed a limited statewide mask mandate in November as cases surged nationwide, the Washington Post noted. But with a significant drop in cases and hospitalizations in the state, as well as increased vaccination availability for hundreds of thousands of Iowans, Reynolds elected to return personal choice on masks to adult Iowans.

 

Her newest proclamation also rolls back restrictions on social distancing and gatherings and replaces them with encouragement for organizers and hosts to "take reasonable measures" to protect the public health. However, there are no mandates and no enforcement mechanisms for the state to shut down gatherings.

 

Reynolds' action also lifted social distancing mandates that have restricted businesses like bars, restaurants, casino, and gyms, as well as sporting events.

 

The governor's spokesman, Pat Garrett, told the Register that the governor wants her fellow Iowans to have the freedom to take "reasonable" measures on their own, saying in an email to the paper that Reynolds "strongly encourages Iowans, businesses and organizations to take reasonable public health measures consistent with guidance from the Iowa Department of Public Health."

Two major cities disagree

 

At least two Iowa cities have declared that they will not be following the governor's lead and that mask mandates will continue to be enforced.

 

Des Moines Mayor Frank Cownie, a Democrat, announced that the city's mask mandate, which he imposed back in August, would remain in place.

 

"The governor's decision is confusing and can't be rationalized with the number of positive cases we continue to see across the state and here in Polk County," Cownie said Saturday, according to the Register. "With an alarmingly more transmissible version of the virus now detected in Iowa, it is more important than ever that our residents and visitors follow the advice of medical experts, keep social distance and whenever out in public, wear a mask."

 

Iowa City Mayor Bruce Teague, also a Democrat, instituted a mask mandate back in July. City Manager Geoff Fruin said following Reynolds' announcement that Iowa City is still under a mask order.

 

"Iowa City's mask order is not impacted by the Governor's latest order and is still in place through May 31, 2021," Fruin said on the city's website. "Residents should continue to wear masks in all public spaces within Iowa City in accordance with the City's order."

 

Iowa Attorney General Tom Miller, a Democrat, has gone on record repeatedly with his belief that cities do not have the legal power to enforce mask mandates, according to the Register.

Biden Justice Department Pick Opposed Enforcing Civil Rights Laws Against Blacks

 

The incoming Justice Department civil rights chief has a history of opposing civil rights prosecutions of black defendants, opposing a complaint against an African-American Democratic leader who discriminated against white voters.

 

As an NAACP lawyer, Kristen Clarke lambasted the Justice Department for bringing a complaint against an African-American party boss in Mississippi who worked to suppress white votes, according to a federal probe. On a separate occasion, a federal oversight commission investigated claims that Clarke worked with allies at the Justice Department to quash the prosecution of the Black Panthers who menaced voters outside a Philadelphia precinct in 2008.

 

Clarke's nomination to an influential Justice Department post will test the Biden administration's commitment to "equity-based" policy making, which purportedly promotes racial justice by giving special attention to marginalized groups. Clarke's professional history suggests a staunchly ideological approach to civil rights enforcement where touchstone civil rights laws are applied to advantage some demographic groups but not others.

 

Clarke made waves in 2007 as an outside critic of the Justice Department's civil prosecution of a corrupt party leader in Mississippi. A federal judge found that the leader, Ike Brown, violated the Voting Rights Act by suppressing white votes in a rural Mississippi county where whites are the minority. He was found to have pushed election workers to count deficient absentee ballots from blacks but disqualify ballots from whites with the same problems and held rigged caucuses in the homes of friends and supporters.

 

Then legal director of the NAACP's Legal Defense Fund, Clarke opposed the Justice Department's decision to prosecute him, according to 2010 testimony from Justice Department official Christopher Coates before the U.S. Civil Rights Commission.

 

Coates described a 2008 meeting with Clarke in which she "spent a considerable amount of time criticizing the division and the voting section for bringing the Brown case," and identified Clarke as part of a coterie of civil rights litigators who "believe incorrectly but vehemently that enforcement of the protections of the Voting Rights Act should not be extended to white voters but should be extended only to protecting racial, ethnic, and language minorities."

 

Unanswered questions also linger over Clarke's role in the Justice Department's abrupt retreat from the 2009 prosecution of two uniform-clad Black Panthers intimidated voters and poll workers outside a Philadelphia voting precinct. An internal Justice Department report said that the pair intimated voters, shouted racial epithets, and castigated a black couple serving as poll watchers for the Republican party. One of them carried a billy club.

 

Federal prosecutors brought a civil complaint against the two Black Panthers in 2009, alleging violations of the Voting Rights Act. The defendants never responded to the complaint—effectively a forfeit—so the government was poised to win its case by default. But on the cusp of victory, in May 2009 the Justice Department dismissed its case against one of the panthers and recommended reduced sentencing for the other.

 

USCCR began investigating her involvement following a press report that she was in touch with DOJ lawyers about the case.

 

In a deposition before the Civil Rights Commission the following year, Clarke acknowledged contact with two Justice Department lawyers about the case but denied those contacts were substantive. Coates, the Justice Department official, revealed a third alleged contact, testifying in September 2010 that Clarke approached one of his subordinates about the case in 2009.

Youtuber Shot Dead While Filming 'Prank' Video Attacking Strangers With Butcher Knife

 

An incident on Friday which led to the fatal shooting of a 20-year old Youtuber is under investigation. In Nashville, a permit is needed to carry a loaded handgun. Anyone above the age of 18 can, however, carry 'openly' so long as the weapon is not loaded.

 

A 20-year-old man who tried to "prank" an unsuspecting man by charging at him with a butcher knife was shot dead on Friday night, law enforcement announced.

 

Timothy Wilks died in the Urban Air Trampoline and Adventure Park parking lot, a statement by Metropolitan Nashville Police Department said.

 

A statement on Saturday said that officers responded at around 9:25 pm, local time, where they found 23-year old David Starnes Jr, who admitted to shooting Wilks after the latter appeared to attack him with a knife.

 

The 20-year old Youtuber and an unnamed friend were in the process of making a video in which they carry out fake attacks against strangers.

 

"Detectives were told that Wilks and a friend were participating in a “prank” robbery as part of a YouTube video and approached a group of people, including Starnes, with butcher knives", the announcement read.

 

Starnes told detectives that he was unaware that the knife attack was a prank, and shot Wilks in what he claims was self-defence.

 

Police are investigating and no charges have been made against Starnes or against Wilks' unnamed friend.

The stand your ground law in Tennessee permits people to use deadly force in self-defense if they feel they are in immediate danger of serious harm or death.

US Courts 'Clogged Up' With Eviction Cases As Activist Groups Fight Back

 

After his inauguration last month, President Joe Biden signed an executive order extending eviction moratoriums until the end of March. Even with the moratorium in place, Reuters reports evictions courts around the country are clogged up with cases.

 

Housing activists have mobilized to protect the working-poor who owe billions of dollars in back rent from being booted onto the streets. In Kansas City, Missouri, late last month, Judge Jack Grate held a virtual online court session for Tonya Raynor,64, who owed $2,790 in back rent.

 

As Judge Grate asked, "Miss Raynor, are you there?" - a chorus of people said, "This is not justice. This is violence." They said, "Judge Grate, you are making people homeless! You are killing people!"

 

The voices in Raynor's microphone belonged to members of KC Tenants, an anti-eviction group that has put immense pressure on Kansas City's eviction system. Similar groups have gained traction in other metro areas who chant slogans such as "Cancel Rent," "No Debt," and "No Evictions."

 

These groups call on the government to assist the working poor who have been financially devastated by the virus pandemic downturn.

 

Reuters notes that Judge Grate was overwhelmed by the protesters in the virtual courtroom, and he ultimately shut down the proceedings.

 

While eviction cases continue to climb, KC Tenants have delayed 854 evictions in Jackson County since January, according to Jordan Ayala, an eviction researcher and Ph.D. candidate at the University of Missouri-Kansas City, who studied the court filings.

 

Despite the US Centers for Disease Control's (CDC) nationwide ban on evictions since the beginning of the pandemic and extension of it through the end of March - there have been loopholes, and some 250,000 tenants have already been evicted in 27 states, according to Princeton University's Eviction Lab.

 

More than 40 million people owe $57 billion in back rent, a staggering number that continues to increase as the economy stumbles.

 

Housing experts have said KC Tenants' actions are similar to tactics used by groups during the Great Depression's rent strikes.

 

KC Tenants members have virtually invaded court eviction cases, chained themselves to courthouse doors and staged sit-ins to prevent in-person hearings, and protest judges' and landlords' homes on the weekends.
