The Senate voted Monday on the measure, which was supported by the entire GOP caucus, but stateSen. PHOENIX, AZ — On February 1, 2021 Republican State Sen. Paul Boyer (R. LD20) introduced SCR 1044 in the 55th Arizona Legislative Session,which will provide in-state tuition to all students who graduate from a high school in Arizona, regardless of immigration status.

Democrats reiterated Monday a threat to punish former President Donald Trump for not testifying at the impeachment trial in the Senate, which begins Tuesday.

 

In a short filing responding to Trump’s lawyer’s 75-page trial memorandum, submitted Monday, the House impeachment managers — all Democrats hand-picked by Speaker of the House Nancy Pelosi (D-CA) — wrote:

 

[T]he House has invited President Trump to voluntarily testify under oath, yet President Trump immediately rejected that opportunity to tell his story. The House will establish at trial that this decision to avoid testifying supports a strong adverse inference regarding President Trump’s actions (and inaction) on January 6.

 

The Democrats were responding to Trump’s lawyers’ claim that Democrats’ rushed impeachment, which defied all previous procedural conventions governing impeachment in the House, denied the president the constitutional due process of law.

 

The Fifth Amendment to the U.S. Constitution provides that “No person … shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.” The impeachment trial is not a criminal case; however, many constitutional scholars argue that the same principles ought to apply — there, above all.

 

When Rep. Jamie Raskin (D-MD) wrote to Trump’s lawyers last week, inviting Trump to testify, he made a similar threat: “If you decline this invitation, we reserve any and all rights [sic], including the right [sic] to establish at trial that your refusal to testify supports a strong adverse inference regarding your actions (and inaction) on January 6, 2021.”

 

As constitutional scholar Jonathan Turley observed, Raskin — a former law professor — is threatening to overturn centuries of progress, and jurisprudence, establishing that a defendant has the right not to testify against himself or herself, and that the exertion of that right does not create a negative inference about his or her guilt.

 

Turley wrote:

 

[T]he statement of House manager Rep. Jamie Raskin, D-Md., this week was breathtaking. A former law professor, Raskin declared that the decision of Trump not to testify in the Senate could be cited or used by House managers as an inference of his guilt — a statement that contradicts not just our constitutional principles but centuries of legal writing.

 

 

The statement conflicts with one of the most precious and revered principles in American law that a refusal to testify should not be used against an accused party.

 

 

Central to this right is the added protection that the silence of an accused cannot be used against him in the way suggested by Raskin. There was a time when members of Congress not only respected this rule but fought to amplify it.

 

 

The Supreme Court has been adamant that the type of inference sought by Raskin is abhorrent and abusive in courts of law.

 

The trial will start Tuesday at 1:00 p.m. ET, and will reportedly begin with four hours of arguments about the constitutionality of the trial, followed by a vote. Thereafter, each side will have 16 hours for opening arguments

National Institute of Allergy and Infectious Diseases director Dr. Anthony Fauci said Monday on Fox News Channel’s “Special Report” it was possible the level of coronavirus infections is “so low” by late fall, Americans could stop being advised to wear face coverings.

 

Baier asked, “Is there going to be a time when we are going to have no masks?”

 

Fauci said, “That will really be dependent upon how we get the level of the virus in the community down. If we can get — and I have used this as an estimate, it is not definitive — if we can get 70 to 85 percent of the population vaccinated and get to what we would hope would be to a degree of herd immunity, which really is an umbrella or a veil of protection against the community. Where the level of virus is so low, it’s not a threat at all. Then at that point, you can start thinking in terms of not having to have a uniform wearing of masks.”

 

He added, “But we’re certainly not near there yet. When do I think that would occur? It’s very difficult to predict, Bret, but if everything falls into the right place and we get this under control, it is conceivable that you might be able to pull back a bit on some of the public health measures as we get into the late fall of this year. But there’s no guarantee of that.”

Breitbart News Senior Editor-at-Large Joel Pollak asked Rep. Rob Wittman (R-VA) about Secretary of Defense Lloyd Austin’s claim that “extremism in the military” necessitates a 60-day “stand down” order across the armed services to address.

 

Last week, Austin issued a military-wide order for commanders to spend the next 60 days discussing “extremism” with military personnel.

 

“I’m very concerned about Lloyd Austin,” Pollak stated on SiriusXM’s Breitbart News Sunday. “He got a waiver from Congress just like James Mattis did. … Lloyd Austin said some really astonishing things in his confirmation hearing. He talked about enemies within the military, and now we’re going pause military operations over the next 60 days to make sure that there are no extremists, and by this, they mean extremists on the right within the military.”

 

Pollak continued, “The military is the most diverse institution in America, so I don’t know why they think they’re going find a bunch of white supremacists in the military. I think it’s kind of a Democratic prejudice against the armed forces and law enforcement in general.”

 

“I’m very concerned about Lloyd Austin,” Pollak added, “I don’t think he’s doing a good job. I think he’s doing a terrible job. I wish I shared your confidence, but to come in and say your first act is going to be this political purge of the military — I understand getting rid of people like Major [Nidal] Hassan, Islamic extremists, and if you’ve got information on white supremacists in the military, get them out — but we’re going to pause our military readiness of our entire force to ferret out people who might have had some reservations about the November 3rd election? I think this is crazy.”

Washington Post opinion writer Jennifer Rubin on Monday’s broadcast of MSNBC’s “All In” declared that the Republican Party was “all about identity.”

 

Rubin said, “What do they believe in? What proposals are they advancing? Aside from the ten Republicans who went to the White House with a smallish to tiny plan for rescue, the Republicans don’t believe in anything right now? They don’t believe that politics is a transactional business.”

 

She continued, “It’s all about identity. The need to control power because they convinced the base without it they’re doomed, Western civilization is doomed, white Christianity is doomed unless they hold power. So it is no longer about policies at all. It is simply about enflaming the base and making their own election a prerequisite of the continuation of life as they know it in America for their base.”

Democrats’ impeachment push against former President Donald Trump is a manifestation of the ruling elite’s contempt for those it views as its subjects, said Lee Smith, journalist and author of The Permanent Coup: How Enemies Foreign and Domestic Targeted the American President, on SiriusXM’s Breitbart News Sunday with host Joel Pollak.

 

“It is not about Trump,” Smith stated of the impeachment pursuit against the 45th president. “It’s about punishing the American voters. ‘We’ll tell you who to vote for.’ This is what happened in 2016, right? This is what Russiagate was about. ‘How dare you not vote for Hillary Clinton? … Because you didn’t, we’re going to make you feel pain. We’re going to use the president you elected as a mechanism.'”

 

“By putting Trump in pain, they used him as an instrument to hurt the American public. … It’s not just going to hurt Trump’s supporters. The purpose all along has been to undermine the foundations of the republic. That’s what they’ve done and that’s what impeachment is about. It’s to further humiliate the American voter for thinking that they have any choice over who may govern them,” Smith added.

Ron DeSantis on Going Maskless at Super Bowl: ‘How the Hell am I Going to Drink a Beer?

Florida Republican Gov. Ron DeSantis had probably the greatest explanation ever for a photo showing him maskless at the Super Bowl.

 

DeSantis brought up the photo on Monday, saying, “Someone said, ‘Hey, you were at the Super Bowl without a mask. But how the hell am I going to be able to drink a beer with a mask on? Come on. I had to watch the Bucs win,” according to Politico’s Marc Caputo.

 

The photo shows DeSantis in an executive suite at Raymond James Stadium, appearing to be discussing something with someone who is less than six feet away.

 

Tampa Mayor Jane Castor, though, was not in any mood to excuse the maskless Super Bowl fans. Castor was dour on all the fans without a mask.

 

“It is a little frustrating because we have worked so hard,” Castor said according to the Associated Press. “At this point in dealing with COVID-19, there is a level of frustration when you see that.”

 

Still, despite her earlier comments, Castor seemed to backtrack a bit by saying most did have masks.

 

“I’m proud to say the majority of individuals that I saw out and about enjoying the festivities associated with the Super Bowl were complying,” she said a few hours later. “They understood their level of personal responsibility, and they were doing the right thing. I’m very proud of that.”

 

The CDC also urged people to mask up for the Super Bowl. But the CDC went a step farther. The agency urged people not even to have Super Bowl parties. And if they did, the CDC warned people not to drink alcohol or even cheer out loud for their team.
