All NSA data (they have all of it) was legally obtained courtesy of the previous administration when they approved of the data collection system. As long as they remained in power, they could have (and did while they were in power) to use it as they saw fit, like spy on American conservatives. It takes a judge to sign off on searches of that data, which we've learned in a corrupt system is a rubber stamp process. That's the dark side misuse of that data. The military can also access that data if they have national security concerns. Those with high level (Q) security clearance have full access to that data, along with the military when it comes to national security issues. Then there's the declassification process.
