Ohio House Bill 90: Proponent Testimony Call to Action
This Wednesday, Feb. 17th, there is proponent (support) testimony for Ohio House Bill 90 (the new and improved version of SB 311).
Legislative analysis summary:
Permits the General Assembly to rescind orders and rules issued by the Governor or other agencies.
Establishes the Ohio Health Oversight and Advisory Committee, and grants the Committee the power to rescind certain orders and rules issued by the Governor and ODH. (NOTE: Gov. orders are evaluated by the committee 11 days after they are written. The committee will consist of 10 members: 5 Senate members (3 majority, 2 minority) be appointed by Senate President Huffman, and 5 representatives (3 Majority, 2 minority) to be appointed by House Speaker Cupp.)
Limits the duration of a public health state of emergency to 30 days unless extended BY the General Assembly. NOTE: Health Emergency automatically ENDS after 30 days unless the majority vote of the assembly allow it to continue.(This is the time where YOU stay in frequent communication with YOUR legislators telling them how you expect them to vote if they want to stay in office!)
During a public health state of emergency, requires the Governor and ODH to REPORT to the President of the Senate and the Speaker of the House of Representatives ANY actions taken in response to the emergency. (NOTE: Allows general assembly to vote on a simple resolution (at any time) that rescinds an order by the Governor. If passed, it can NOT be vetoed and the order no longer stands.)
The bill removes the word “ultimate” from existing law describing ODH’s authority over matters of quarantine and isolation.
When there is an emergency determined regarding a tainted/ poisoned consumable product, The bill specifically describes that situation as… "adulterated consumable product emergency” rather than a just a “public health emergency".
