The Hague court sides with activists, tells Dutch government to IMMEDIATELY lift ‘illegitimate’ curfew

The Dutch government has been told by the court to reverse its coronavirus pandemic curfew after The Hague ruled there was no legal basis for it and called it an infringement on people’s rights.

In a statement, The Hague declared that the government's use of the Extraordinary Powers of Civil Authority Act – an emergency act which allows the state to bypass the legislative process to impose a curfew in “very urgent and exceptional circumstance” – was not justified in this case during the Covid-19 crisis.

“The Preliminary Relief Judge ruled that the introduction of the curfew did not involve the special urgency required to be able to make use of the [act],” the Hague continued, noting that the government had had time to discuss such a curfew beforehand, before ruling that “the use of this law to impose curfew is not legitimate.”

The curfew is a far-reaching violation of the right to freedom of movement and privacy and (indirectly) limits, among other things, the right to freedom of assembly and demonstration.

The country’s Justice Ministry says it is now studying the ruling.

After the Dutch government imposed the curfew on January 23, citizens were legally required to stay home between the hours of 9pm and 4:30am unless they had a valid excuse, and they were warned that they could face fines if they refused to do so.

Valid excuses to go outside during the curfew included emergencies, essential work, to seek medical assistance, and to walk a dog on a lead.

The Hague's decision was made after a group known as the Virus Truth Foundation filed a lawsuit arguing that the curfew was an infringement on human rights and the Dutch constitution.

The Netherlands experienced several nights of rioting over the curfew, which resulted in burnt cars, looted business, clashes with police, and hundreds of arrests.

Citi Loses Court Battle Over $500MM "Fat Finger" Trade

Some Citigroup execs are about to have some serious explaining to do to their shareholders (though fortunately for the bank, outgoing CEO Michael Corbat is still at the rudder to take the PR hit).

After more than a year of fighting, Bloomberg reports that Citigroup has officially lost the court battle to recover some $500MM that was accidentally transferred to investors in a Revlon debt deal.

Citigroup shares retreated (but remained in the green) on the news, which was first reported by Bloomberg.

US District Judge Jesse Furman said 10 asset managers for the lenders – which include Brigade Capital Management, HPS Investment Partners and Symphony Asset Management - don’t have to return more than $500 million that Citibank said it mistakenly transferred in August while trying to make an interest payment.

We initially wrote about the issue last year, as it was becoming clearer that Citi's path to recovering the money might be legally fraught. Now, it looks like the bank will end up being stiffed for half a billion (earlier reports said the number at risk could be as much as $900MM) by a bunch of its clients.

As one twitter user pointed out, Citigroup is apparently eating its just desserts after helping corporate raider Ronald Perelman try to strip assets from Revlon.

Mom encouraged ‘sexual relationship’ between 13-year-old daughter and her 29-year-old abuser, police say

Police in Idaho Falls say the mother of a 13-year-old girl "encouraged and condoned" a relationship between her daughter and a 29-year-old man who is now under arrest for sexually abusing the child.

Bill Ernest Davenport was arrested and charged with felony lewd conduct with a minor after detectives discovered photos and a video on his phone showing him molesting the teenage girl, East Idaho News reported Sunday.

Law enforcement had been made aware of the alleged abuse by Child Protective Services in November and began to investigate the allegations. During the investigation, both the girl and Davenport initially denied that any abuse had occurred. But, according to court documents, Davenport would later acknowledge he was in a "boyfriend" and "girlfriend" relationship with the child.

When investigators searched Davenport's cellphone, they allegedly found several photos of him touching the child in a sexual manner and a video showing him molesting her.

Though the girl's mother denied knowing about the abuse, several other witnesses reportedly countered her claims, according to the Post Register.

"My interviews revealed that it was common knowledge among Bill, [the victim], and [the mother's] social circle that Bill and [the victim] were in a sexual relationship and [the mother] encouraged and condoned the relationship," the detective wrote in a probable cause affidavit.

After detectives discovered that Davenport and the girl shared a bedroom, they ordered DNA samples taken from the girl as well as from several items in the room for examination and testing at the Idaho State Laboratory.

Davenport was arrested last week and made his first court appearance on Thursday, where a judge set his bail at $15,000. If convicted, Davenport could serve up to a life sentence in prison. A preliminary hearing is scheduled for Feb. 24.

Detectives have reportedly recommended that the victim's mother be charged with injury to a child, but court records indicate that the mother has not yet been charged for her alleged involvement. Officials noted that the incident is still under investigation.

Democratic congressman sues Trump over Capitol riot under Civil War-era KKK Act, says he 'suffered emotional distress'

Mississippi Rep. Bennie Thompson is suing former President Donald Trump and his lawyer Rudy Giuliani, plus pro-Trump groups including the Oath Keepers and Proud Boys, for allegedly inciting the January 6 riot at the Capitol.

Thompson sued the former president on Tuesday for allegedly conspiring with Giuliani and the so-called “extremist” groups for supposedly attempting to prohibit the Senate from certifying the election results in which Democrat Joe Biden emerged victorious. The suit was filed by Washington lawyer Joseph Sellers and African American advocacy group the NAACP on behalf of Thompson.

Rather than focusing on allegations of incitement, Thompson’s suit claims Trump and his co-defendants “plotted, coordinated, and executed a common plan to prevent Congress from discharging its official duties in certifying the results of the presidential election.”

Giuliani and Trump specifically “engaged in a concerted campaign to misinform their supporters and the public, encouraging and promoting intimidation and violence in furtherance of their common plan” to promote Trump’s re-election “and to disrupt the legally required process before Congress to supervise the counting of the Electoral College ballots and certify the results of that count,” the suit charges.

As a result, Thompson was “hindered and impeded in the discharge of his official duties,” intimidated while attempting to serve in his official functions “when the Capitol was under attack,” and “suffered emotional distress,” the suit claims, demanding “an award of compensatory damages,” as well as “punitive damages” to deter others from behaving similarly in the future.

The lawsuit alleges a violation of the Ku Klux Klan Act of 1871, which was enacted to prevent conspiracies that used “violence and intimidation” to “prevent Members of Congress from discharging their official duties.”

Report: Second Underage Boy Accuses Lincoln Project Cofounder of Harassment

Somehow the disgraced Lincoln Project is even more disgraced now as news broke Monday of a second underage boy allegedly preyed upon by the left-wing super PAC’s cofounder John Weaver.

During an appearance on Laura Ingraham’s Fox News program, journalist Ryan Girdusky said, “I’m here to say I have made contact with another minor who was sexually harassed by John Weaver. He is still a minor today… John Weaver aggressively sexually harassed him.”

He added, “The allegations involving minors are now multiple, and there’s possibly more to come.”

Girdusky, who originally broke this story wide open, said that even though a month has passed since the story hit, he is still hearing from new people about Weaver’s alleged harassment — his pattern of soliciting young men by offering them “jobs and internships in exchange for sex.”

Girdusky clarified that these are not just verbal accusations. The alleged harassment involves direct messages by way of Twitter from Weaver to these young men. If they are indeed from Weaver, this is written proof of his behavior.

According to multiple sources, the Lincoln Project knew all about Weaver’s alleged predations going back as far as March 2020 but did nothing about it. The grift was just too lucrative. The far-left group scammed close to $90 million from gullible leftists, and only a third of that went to television advertising.

Some of the individuals came forward with new details on Monday after they were released from their nondisclosure agreements. Several said Sarah Lenti, a managing partner with the group who was previously its executive director, knew about the allegations against Weaver as early as May 2020. Lenti confirmed that some of the group’s co-founders knew about the allegations as early as March 2020. Schmidt and Galen were among those who knew, multiple sources said.

Unfortunately, there is nothing at all surprising about any of this. While everything is still in the “alleged” phase, we know for a fact that men who prey on children do not stop with just one.

Secondly, we also know that Washington, DC, is a cesspool that either participates in, enables, or tolerates the sexual abuse of children as long as the wrongdoer is a welcome part of the D.C. establishment. If nothing else, Jeffrey Epstein taught us that.

Epstein’s predations were an open secret in D.C. Weaver’s alleged predations were an open secret in D.C. going back, according to Karl Rove, to at least 1988.

Steve Schmidt, a Lincoln Project cofounder (who resigned in disgrace last week), was a Rove protégé.

Does anyone believe that Schmidt didn’t know about Weaver when Rove did?

China Threatens To Hobble US Defense Industry By Limiting Export Of Rare-Earth Metals

China has been quietly exploring the economic damage it could inflict to US and European companies - including defense contractors - if they were to impose export 'restrictions' on 17 rare-earth materials, according to a report in the Financial Times.

Notably, the US government relies on these rare earths for the manufacture of F-35 jets and other sophisticated weaponry, which use them for critical components such as electrical power systems and magnets.

"The government wants to know if the US may have trouble making F-35 fighter jets if China imposes an export ban," said one Chinese government adviser who spoke on condition of anonymity.

One rare earth metal for example, samarium cobalt, is used in precision guided missiles and fighter jets, and advanced communications systems.

Rolling Blackouts Across 13 States Beyond Texas

Blackouts will roll across the spine of the American Midwest, stretching from North Dakota to Oklahoma, amid the extreme cold snap that has disrupted power generation and sent demand soaring.

Southwest Power Pool, which manages power for 14 states, declared an energy emergency alert for its entire network this morning. It said it is ordering utilities to start rolling blackouts as seen this week in Texas.

SPP said that this was the first time it had ever had to order rolling blackouts.

“This is done as a last resort to preserve the reliability of the electric system as a whole,” the agency said. “It’s a step we’re consciously taking to prevent circumstances from getting worse, which could result in uncontrolled outages of even greater magnitude.

Tom Cotton: It Is Time to Send the National Guard Troops Home from D.C.

Tuesday, during an appearance on FNC’s “Fox & Friends,” Sen. Tom Cotton (R-AR) called on the National Guard presence on Capitol Hill in Washington, DC, to come to an end.

The Arkansas lawmaker explained how there was no Congress in session this week. However, the troops still remain.

“It is time to send the troops home,” he said. “Look, there are too many — too many troops left in Washington. I’m not aware of any threat to justify continued presence today around the Capitol, much less into the fall. I think Nancy Pelosi will have a lot of questions to answer about what she knew leading up to the riot on January 6. There was a clear failure by the security leaders on Capitol Hill to prepare for January 6. The officers of the Capitol police performed bravely, but they’re right to have no confidence in their leadership. That doesn’t mean, though, that we should turn the Capitol into an armed fortress or camp for thousands of soldiers. It means we should use common sense. And assess the threats that we face and respond accordingly. That big anti-riot fence with razor wire around the Capitol — it went up overnight after January 6.”

“If, for instance, Joe Biden comes to the Capitol and gives a joint session speech in the next few weeks, as new presidents tend to do, obviously there will be an increased security posture at that time,” Cotton continued. “But Congress isn’t even in session this week, yet we have thousands of troops guarding the Capitol where congressmen and senators and their staff work at a time when the security threats simply do not justify it, at least to my knowledge. If they do, Nancy Pelosi needs to come forth and explain why they do.”

Chinese Communist Party Using LinkedIn To Gather ‘State Secrets’

The Chinese Communist Party is using platforms such as LinkedIn to gather “state secrets” from Westerners.

“Spies are creating fake business profiles on the professional networking site so that they can identify targets and obtain classified information. Sources warn that they have offered lucrative business opportunities and enticing sums of money to lure present and former government and private sector workers with access to classified information or commercially sensitive technology,” The Times summarizes.

The story highlights the experience of 56-year-old Phillip Ingram, a former colonel specializing in cyberintelligence work and chemical, biological, radiological and nuclear weapons, conversing with an account under the name of “Robin”;

Ingram said: “There was nothing on his profile that suggested which company he worked for, just generics. That seemed odd.” As the conversation continued Robin’s requests became more concerning. He said that “we would want to get inside information that isn’t easily accessible to anyone”. When Ingram pushed for more detail Robin said: “You can guess the sort of stuff I’m after.”

Ingram had already guessed that the profile had been faked by a Chinese intelligence officer before Robin said that Ingram would be required to travel to China to present his report. “I said I’d rather meet in London but he refused,” Ingram said.

His suspicions were confirmed when Robin suggested that they switch to an encrypted email service that could not be accessed inside China except by intelligence services. Robin emailed him on it within ten minutes.

“At that stage I was 99.99 percent sure it was someone linked to the Chinese government,” Ingram said. “It was classic recruitment. If I’d decided to go to China they’d have sent me back to get other bits and pieces. They’d have effectively recruited an agent. If I went and I wasn’t co-operative, or they weren’t certain I was in their back pocket, they would have engineered activities to gather compromising material for blackmail.”

UK Regulator Stops BLM Registering as Political Party – ‘Likely to Mislead Voters’

Britain’s Electoral Commission has rejected efforts to register Black Lives Matter as a political party on grounds that it would be “likely to mislead voters”.

“The application to register Black Lives Matter as a political party was refused by the Commission on the basis that the proposed name is likely to mislead a voter as to the effect of their vote,” said a spokesman for the controversial regulator in comments reported by MailOnline.

“As part of our considerations we examined the existing groups by the same or similar names in the UK. Having contacted a number of groups, they confirmed that the party was not associated with them,” the spokesman explained.

“Our assessment concluded that, whilst the BLM movement is a grassroots movement, it was still likely that the proposed name would mislead a voter as to the effect of their vote. This was on the basis that a reasonable voter could assume that the party represents, or is in some way associated with, these groups when that is not the case.

“If a name cannot be accepted, the associated application must be rejected. In addition, other elements of the application were rejected, including the constitution and financial scheme.”

The problems with the constitution were not enumerated, however.

The Black Lives Matter UK organisation confirmed that is was not behind the efforts to register a BLM political party to contest elections, telling the MailOnline that it had “absolutely no connection, affiliations or other and no individual or group has informed or made us aware of their intentions of forming a political party under the name of Black Lives Matter. It is not us.”

BLM UK added: “Those of all ethnicities and from all nations who believe in racial equality are anti-racists, we stand together… Some content published on [our] website may have political elements by the nature of a society and state governed under a system of democracy; however we operate in a humanitarian capacity and concern before all else.”

BLM UK is not without its own controversies, however, having been accused of antisemitism after attacking the “settler colonial pursuits” of Israeli Jews and declaring that “we loudly and clearly stand beside our Palestinian comrades” in 2020.

Brexit champion and Reform UK party leader Nigel Farage has also condemned Black Lives Matter as “a dangerous, Marxist organisation, hell-bent on anarchy” which wants to defund the police and has backing from the likes of George Soros.

The people who are behind the failed effort to register a BLM party is undisclosed, according to the MailOnline, but Sasha Johnson, a prominent BLM activist and self-styled Black Panther, has already launched her own Taking the Initiative Party, which among other things wants the state to create a Race Offenders Register in which people who express views they consider problematic would be officially listed, like sex offenders.

“A lot of racism happens at work and places of education in a micro-aggressive way. If you exhibit an element of bias at work, you should probably receive a warning first [before later being added to the register] so people know in future that you hold these views,” said Johnson, who also believe the police are “no different from the KKK“ and wants black people to receive Holocaust-style reparations.
