That is an excellent question. Piecing together the facts, they accepted the case(s) some time ago, but now they won't hear them because they're somehow "moot"?

They did not elaborate or explain the WHY it is now moot. If it were already taken up by a military court/tribunal then the case before them would indeed be "moot" as it's been removed from their jurisdiction.

They must have had jurisdiction when they agreed to put them on the docket. Something changed between that time and yesterday's debacle.

I really, really don't want to believe that the SCOTUS is that comp'd. (Roberts, yeah).
