Cuomo administration withheld information regarding nursing home deaths out of fear the data would “be used against us” in a federal investigation

 

Those who made Democratic New York Gov. Andrew Cuomo an exemplar of pandemic leadership are abandoning his side as news of his alleged cover up of the amount of nursing home deaths in New York continues to unravel.

 

Democratic New York Gov. Andrew Cuomo was commended by corporate media, heralded by Hollywood, and defended by powerful Democrats for his COVID-19 response.

 

Cuomo issued a March 25, 2020 order that required nursing homes to accept recovering COVID-19 patients from the hospital. In May, Cuomo rescinded the order. Cuomo’s government omitted individuals who lived in nursing homes or long-term care facilities from their data on nursing home deaths because, according to a May Daily Caller News Foundation report, while the individual may have contracted the disease in the nursing home, they died in the hospital.

 

Over the course of the nearly two month period when Cuomo’s directive was active, more than 9,000 COVID-19 positive patients were forced back into nursing homes, which was 40% higher than the state’s official tally, according to The Associated Press. In late January, Cuomo’s administration admitted that at least 12,743 nursing home residents had died from COVID-19 — a number 50% larger than the previous figure.

 

The New York Post reported that Cuomo’s secretary to the governor, Melissa DeRosa, told New York Democratic leaders the Cuomo administration withheld information regarding nursing home deaths out of fear the data would “be used against us” in a federal investigation. She told lawmakers the administration “froze” “Because then we were in a position where we weren’t sure if what we were going to give to the Department of Justice, or what we give to you guys, what we start saying, was going to be used against us while we weren’t sure if there was going to be an investigation,” the New York Post reported.

 

CNN has reportedly forbid Chris from interviewing and covering his brother, as reported by USA Today.

 

Democratic New York state Sen. Jessica Ramos followed up the news of Cuomo’s coverup by calling for a “full investigation” into the Cuomo administration’s management of COVID-19 nursing home data Feb. 13, which she saidthey “knowingly chose to lie” about. Ramos was joined by other New York Democrats in calling for Cuomo to be stripped of his emergency powers.

 

Democratic members of the New York State Assembly also called for Cuomo to be stripped of emergency powers in a letter circulated to other assembly members, according to the the New York Post.

 

The letter also accused Cuomo of federal obstruction of justice. “It is now unambiguously clear thatthis governor has engaged in an intentional obstruction of justice, as outlined in Title 18, Chapter 73 of the United States Code,” the letter read, according to the New York Post. The letter was signed by nine Democrats, and severely angered Cuomo. Democratic Queens Assemblyman Ron Kim, one of the letter’s signatories, said Cuomo personally called him to lambaste and threaten him.

 

“He goes off about how I hadn’t seen his wrath and anger, that he would destroy me and he would go out tomorrow and start telling how bad of a person I am and I would be finished,” Kim told the New York Times.

 

Republican members of the New York State Assembly also took action against Cuomo by suggesting the legislature should form an impeachment commission to “gather facts and evidence” surrounding the Cuomo COVID-19 scandal, Republican Minority Leader Will Barclay said.

 

“The Cuomo Administration’s nursing home cover-up is one of the most alarming scandals we’ve seen in state government,” Barclay told Fox News in a statement. “It is incumbent upon the Legislature to undertake a comprehensive, bipartisan review of the Cuomo Administration’s policies, decisions and actions on this matter and render a decision on what steps must be taken to hold the governor accountable,” Barclay added.

Kim confirmed that ==the New York State Assembly was moving toward an impeachment probe in an interview on the “Skullduggery”= podcast. “Of course, I’m prepared to comply and spend as much time handing over as much evidence as they want,” he said of his previous claims about Cuomo’s bullying tactics. In an op-ed for Newsweek, Kim called for the impeachment of his state’s governor. “It is time to be brave, to hold him accountable, to investigate his cover-up of nursing home information,” Kim wrote in the op-ed. Eleven New York Democratic leaders then introduced a resolution to censure Cuomo on Feb. 22.“During this entire ordeal where the governor claims to not have had time and human resources to comply with requests for information, the governor did have time to write a book congratulating himself for New York’s COVID-19 response, have a self-congratulatory poster created and circulated before the worst of the pandemic was,”the resolution’s text said.

 

Other Democrats, such as Democratic New York City Mayor Bill De Blasio, said Cuomo’s tendencies to try and intimidate his political rivals is nothing new. “That’s classic Andrew Cuomo. A lot of people in New York state have received those phone calls,” De Blasio said in response to the alleged incident involving Cuomo and Kim on MSNBC’s “Morning Joe.” “You know, the bullying is nothing new,” De Blasio went on to say.

 

National politicians have also called for a look into Cuomo’s actions over the course of the COVID-19 pandemic. Democratic New York Rep. Alexandria Ocasio-Cortez said “I support our state’s return to co-equal governance and stand with our local officials calling for a full investigation of the Cuomo administration’s handling of nursing homes during COVID-19,” in a Feb. 19 statement.

Republican members of the House Oversight Committee have requested that Democratic Chairwoman Rep. Carolyn Maloney subpoena Cuomo to testify in a Feb. 24 letter. “Additionally, we formally request a thorough investigation by the Oversight Committee… We owe it to the thousands of families who lost loved ones because of Governor Cuomo’s alleged recklessness,” the letter read, according to Fox News.

 

Federal prosecutors are reportedly investigating the Cuomo cover up as well, a Feb. 18 report from The Albany Times-Union claimed. Former Acting Assistant U.S. Attorney General John B. Daukas argued in an Feb. 22 op-ed published by the Wall Street Journal that, based on his current knowledge, Cuomo’s actions could have been “a conspiracy to defraud the United States and… obstruct justice.”

 

Lindsey Boylan, whose LinkedIn page says she served as Deputy Secretary for Economic Development & Special Advisor to Cuomo, posted a thread on Twitter Dec. 5, which claimedworking under Cuomo was the “most toxic” working environment she’d ever been in. Boylan later tweeted out on Dec. 13 that Cuomo had sexually harassed her “for years,” and that “Many saw it, and watched.” In a Feb. 24 Medium post, Boylan expounded on her experiences working for Cuomo and outlined how he allegedly sexually harassed and assaulted her by kissing her “on the lips” at work and suggesting they play “strip poker” on a flight returning from official business. Cuomo has denied Boylan’s accusations repeatedly.

Cuomo’s popularity has suffered a hit amidst these ongoing scandals, and is just holding on to a positive approval rating of 51%, a Siena College poll found. A petition to impeach Cuomo, launched by Republican New York State Assemblyman Kieran Lalor, garnered 18,000 signatures in just three days.

Mike Linndell said he’s not backing down from speaking out against voter fraud and is “putting everything on the line” to bring the truth to the American people.

 

In an interview Tuesday, Lindell asserted he has“100 percent evidence” of malfeasance during the election by Dominion Voting Systemswho has accused the MyPillow CEO of defamation.

 

“They sued my company, which had nothing to do with this and there’s 2,500 plus employees,” he stated. “It’sshameful what Dominion has done to our country, and go to the private sector level and attack my company.”

 

However, Lindell said he will continue to fight despite being put in physical danger and having incurred massive financial losses. He called on Dominion to allow machine inspections and said as a business owner himself, he understands the need for transparency and would gladly open up his business for review if someone were to question the integrity of his product.

 

“So Dominion I ask you, and I’ve asked this, what are you hiding? I know what you’re hiding,” he stated. “They want to suppress me, cancel me out, get rid of Mike Lindell because this is what’s gonna take down that election and this is the hope that we have in this country.”

 

Lindell added, Dominion’s lawsuit in a roundabout way is actually serving the American people as it provides him with legal grounds to release previously unseen evidence. He went on to stress electoral integrity should not be a partisan issue.

 

“This problem runs so deep and this cancel culture…it’s not just Dominion and not just Smartmatic, but look at the machine,” he contined. “They’re all part of this attack on our country.”

 

Lindell said he plans to continue his work exposing electoral fraud and warned if the current system is not reformed “the USA as we know it will be gone.”

Judge rules Arizona Senate can access 2020 election ballots

PHOENIX (AP) — A judge ruled Friday that the Arizona Senate can get access to 2.1 million ballots and election equipment from Arizona’s most populous county so it can audit results of the 2020 election that saw Democrat Joe Biden win in the state.

 

Maricopa County Superior Court Judge Timothy Thomason’s decision comes after a protracted battled between the Republican-controlled state Senate and the GOP-dominated Maricopa County board over subpoenas issued by the Senate.

 

The five-member Board of Supervisors argued that the ballots were secret, that the Legislature had no right to access them and that the subpoenas issued by Senate President Karen Fann were for an illegitimate purpose, among other arguments.

 

The Senate’s lawyers contended that the constitution gives the Legislature the role of maintaining the purity of elections and make sure voter integrity is protected, that the subpoenas were legal and a proper use of legislative power.

 

In his ruling, Thomason agreed with the Senate on all those arguments, saying the subpoenas “are legal and enforceable.”

 

“There is no question that the Senators have the power to issue legislative subpoenas,” Thomason wrote. “The Subpoenas comply with the statutory requirements for legislative subpoenas. The Senate also has broad constitutional power to oversee elections.

 

“The Arizona legislature clearly has the power to investigate and examine election reform matters,” the ruling says. “The Subpoenas also do not violate separation of powers principles. Production of the subpoenaed materials would not violate confidentiality laws.”

 

The ruling appears to end a bitter fight that has divided two elected Republican-controlled bodies who became embroiled in a battle prompted by then-President Donald Trump’s loss in Arizona.

 

Board Chairman Jack Sellers said the ruling “brings clarity to whether Senate subpoenas apply to ballots that, per state law, must be kept private following an election; as well as the many other documents and equipment demanded.

 

“We respect his legal opinion and will immediately start working to provide the Arizona Senate with the ballots and other materials,” Sellers said in a statement after meeting with county lawyers. “These items are in addition to the more than 11GB of data already provided. We hope senators will show the same respect and care we have for the 2.1 million private ballots and use them in service of their legislative duties.”

 

Fann has said she wants the audit to prove one way or another whether the victory of President Joe Biden was legitimate. Court challenges in Arizona and other battleground states where former President Donald Trump lost found no evidence of fraud, miscounts or other problems.

 

Reached by phone while driving to her home in Prescott on Friday morning, Fann said she had not yet talked to Senate lawyers other than to be told she had won.

 

“We are thrilled and grateful that the judge was able to see the big picture in this whole issue,” she said. “That this has never been about overturning an election. This has always been 100% about voter integrity and finding the answers to all of our voters’ questions about the safety and security and validity of the Arizona electoral system.”

 

The county Board of Supervisors has pointed to 'repeated checks' that show the election was 'free and fair' and 'properly conducted'. They also did 'two additional audits' in an effort to mollify (sure up) the Senate.

Early this week, they released the results of those new audits of their equipment that showed no malicious software or incorrect counting equipment and that none of the computers or equipment were connected to the internet. Previous reviews and a hand recount of a sample of ballots also found no issues.

 

The state Senate wants its own forensic audit. The Senate fell one vote short of finding the five-member board in contempt earlier this month.

 

The county Board of Supervisors previously turned over reams of data but balked at handing over the actual ballots or the tabulation machines, saying the ballots were by law secret and the machines would be compromised.

 

Fann said she now will move forward with a full forensic audit, working from the audits the county just completed. That effort was incomplete, she said, and only looked at vote counting machines and software.

 

“This will certainly give us the opportunity to get a more independent forensic auditor in there to verify that work,” she said. “And then do the rest of the audit, which actually verifies the ballots and more sampling of the signatures.”

 

Fann said she wants to make a deeper diver into questions Republicans have raised about the state’s mail-in ballot system. Arizonans have embraced mail voting, and more than 80% of voters cast ballots early by mail or in-person.

 

“I really want to get questions answered about how many mail ballots are going our to people who are no longer living, or are no longer living in Arizona, or going to wrong addresses, and what we can do to fix those problems,” Fann said.

 

Democratic Sen. Martin Quezada said any new audits won’t persuade Republicans who argue without evidence that Trump lost the election because of fraud.

 

“If anything this is going to further rile up a base of people who want to believe that this election was stolen,” Quezada said. “If this was going to answer questions, I think any of the previous multiple audits that have already been done would have answered those questions.”

 

Thomason lamented that the courts had become embroiled in a political fight, calling the “highly bitter dispute” between “dedicated public servants” in two branches of government “regrettable” and noting he had urged them to reach an agreement outside of court.

 

“They apparently have not done so. Our governmental officials should not be spending valuable resources on lawyers, ‘fighting’ with another branch of government over what materials can be provided to another branch of government under a subpoena,” Thomason wrote. “Rather, the citizens expect their governmental officials to work cooperatively for the common good. It is highly unfortunate that that has not happened here. When government officials resort to ‘name calling’ and threats, something has gone terribly wrong.”

Hundreds of children who crossed the United States-Mexico border unaccompanied are now in border patrol custody as immigrants continue to "flood over the border," according to Daily Telegraph columnist Miranda Devine.

 

She said these sorts of migration episodes were going on during the Obama administration.

 

“Of course the so-called cages that were built for children were built under President Obama, which Democrats never mentioned when they criticized the Trump administration,” she said.

 

“Donald Trump had managed to bring that border crossing problem to a trickle”.

 

Ms Devine pointed to a mass exodus from Honduras toward the United States.

 

“Because of course that border wall was never finished and Joe Biden’s now ceased any work on it and there are lots of unaccompanied children … they have to be in custody,” she said.

 

“But I mean what else are they going to do? These are children with no parents visibly around … and so they need to be housed and fed and safely cared for.”

I have long advocated that the practice of law is nonpartisan. There is no room for politics in a court of law. Lady Justice wears a blindfold. Every person is equal in the eyes of the law.

 

When politics infects the administration of justice, bad things happen. The worst being an injustice is inflicted on a party. An injustice on one is an injustice to ALL in a system based on the rule of law.

 

Look back earlier this week and this year to the failure of the U.S. Supreme Court to accept 2020 election cases for review and decision.

 

In my opinion, the Court had a duty to accept the cases and issue a ruling on the competing legal issues. The ultimate ruling should have been a legal ruling based on the law regardless of which side prevailed. The law is the law.

 

In my opinion, the problem with SCOTUS’ action (or inaction) is that the failure to review the cases in the first instance was a political decision.

 

While politics obviously plays a role in the selection and confirmation of Supreme Court justices, political considerations must END when a Justice takes the sworn oath to interpret and apply the law pursuant to the Constitution. Being faithful to that sworn oath is the ONLY safeguard to insure that we have EQUAL JUSTICE UNDER THE LAW.

 

Now let’s next examine the problem on a personal level.

The personal issue is the actions being taken by the State Bar of Georgia against me. Look at the Bar’s unjustified demand that I submit to a mental health examination without telling me the basis for the demand and without even identifying the examiner. Talk about a total absence of due process!

 

The State Bar also threatens my Bar license based on my personal expressions of free speech and my involvement in lawsuits which challenge the validity of the 2020 election. Talk about an effort to exceed the lawful scope of its duties to regulate the practice of law!

 

Why is the State Bar of Georgia engaging in an unjustified and unlawful witch hunt against a member of the Bar with an unblemished 43-year record?

 

Politics.

 

The reality is that the GA State Bar for the past many years does not represent the interests of We The Lawyers who make up the Bar of Georgia. The GA State Bar only represents and advocates the interests of the political officials who hold the key to power in the organization. In short, the State Bar of Georgia is a political organization. Not good for the practicing lawyers who should have the power to regulate themselves as members of the Bar.

 

Sounds kinda like what has happened to our country, doesn’t it? The government “officials” have forgotten about We The People.

 

It is time for We The People to clean up government and return the power to the People where it rightfully resides in the first instance.

 

It is time for We The Lawyers in Georgia to clean up the State Bar of Georgia and return the power to the practicing lawyers where it rightfully resides in the first instance.

 

The practicing lawyers in Georgia are intimidated and fearful of speaking up against the State Bar of Georgia about its clear mistreatment of me. These lawyers need to reach deep inside themselves and find the courage to fight back for me. While the GA State Bar is now coming after me, sooner as opposed to later the State Bar will be coming after them based on politics.

 

It is time for lawyers around the country to wake up and put aside preferences and stand for principles. It is time for ALL lawyers to take politics out of the practice of law and fight honestly for what is right.

 

The practice of law is nonpartisan.
