No, because most Special Prosecutors are assigned to investigate sitting presidents, which means current DOJ/FBI agents have the appearance of a conflict of interest, so the Special Prosecutor and his team are chosen from the private sector. Because Durham was appointed before Biden was elected, and was already working the case, he was given Special Prosecutor status to keep Biden from ending his investigation after the inauguration (like he did to the Cuomo investigation). It's a situation that hasn't happened since the Special Council law was passed to replace the Independent Council law (after the Clinton Investigation).
