There's going to be legal problems with the NCAA.

 

A legal minefield that could cost SD taxpayers a lot of money and make SD college/university athletes ineligible for NCAA competition.

 

She can't make decisions in a vacuum with the possible ramifications and needs to have the bill fully vetted by lawyers and the path forward weighed carefully.

 

If Trump can't make a dent in the current US legal system wrt to a questionable election, what chance does a SD governor have? Reality is, IMO, SD will lose any and all lawsuits and the taxpayers will fork out a lot of money for nothing.

 

It's not her fault government entities are as fucked up as they are.

Only way out, IMO, is just have 3 teams per sport; varsity, JV and freshmen.

 

All gender designations have an equal opportunity to try out. May the best man win.

 

Pro sports are in that format, actually. Women/transgenders aren't banned, they're just not good enough.

 

The emphasis on kids sport's programs should be moved to private clubs, who probably (I'm not completely sure) could legally institute biological gender based teams. Takes sports out from under the government auspices.

 

Works well in Europe. Really talented kids can move to clubs more commensurate with their ability and compete at higher levels at an earlier age. That's the reason, for example, why small countries can be soccer powerhouses. Kids with potential get poor technique corrected before they become a habit and their overall skills refined earlier by licensed coaches.
