Sidney Powell Files Motion to Dismiss Dominion's $1.3 Billion Lawsuit

 

Dominion Voting Systems filed a defamation lawsuit in January against lawyer Sidney Powell, seeking at least $1.3 billion for Powell’s claims that the election technology company rigged the presidential election for Joe Biden.

 

In a motion filed in federal district court in Washington, DC on Monday, the former Trump campaign attorney asked a judge to dismiss the defamation suit filed against her by Dominion Voting Systems.

 

In her motion, Powell argued that the court doesn’t have jurisdiction because the election technology company did not properly tie her supposed defamatory statements to Washington, DC. Powell in her request asked the judge to consider transferring the case to her home state of Texas if her motion to dismiss the case is rejected.

 

"All the allegedly defamatory statements attributed to Defendants were made as part of the normal process of litigating issues of momentous significance and immense public interest," the motion reads.

 

In her filing, Powell said her claims about Dominion are protected by the First Amendment.

 

“In light of all the circumstances surrounding the statements, their context, and the availability of the facts on which the statements were based, it was clear to reasonable persons that Powell’s claims were her opinions and legal theories on a matter of utmost public concern. Those members of the public who were interested in the controversy were free to, and did, review that evidence and reached their own conclusions – or awaited resolution of the matter by the courts before making up their minds,” the motion states.

 

If the case against Powell is dismissed, Dominion would not be able to take the case to trial, and Powell would have to present evidence that the claims about the company were true or she had a reason to believe such claims.

 

In an emailed statement to Bloomberg, Dominion attorney Tom Clare addressed Powell’s motion.

 

“Powell’s attempt to dismiss the case contradicts her claim that she wants to present her evidence in court. Dominion Voting Systems is eager for the case to move forward and intends to hold Powell accountable,” Clare noted.

 

Dominion filed the lawsuit against Powell in early January, just days after former US president Donald Trump loyalists breached the US Capitol.

 

"The recent attacks on the democratic process are not singular or isolated events," Dominion CEO John Poulos told reporters at the time, The Hill reported. "They are the result of a deliberate and malicious campaign of lies over many months. Sidney Powell and others created and disseminated these lies, assisted and amplified by a range of media platforms."

 

Dominion has also filed $1.3 billion defamation lawsuits against MyPillow CEO Mike Lindell and former Trump attorney Rudy Giuliani, accusing the pair of also tainting the company’s reputation with their baseless groundless about voter fraud.

Despite the United Kingdom’s high rates of adults receiving vaccinations, the head of immunizations for Public Health England, Mary Ramsay, insists that ‘low-level restrictions’ be maintained into the foreseeable future.

 

Policies such as mandated social distancing and public mask use is being proposed to extend “for years” according to a leading pandemic doctor in England. Although UK Prime Minister Boris Johnson has announced plans for lifting legal limits and restrictions in England on June 21, Ramsay warned that the government should be more cautious and “look very carefully before any restrictions are lifted.”

 

Last Friday, England set a record for most mRNA inhibitors 711,156 people given the “jab” in a single day. According to the Independent UK, half of the adult population has officially been vaccinated, which was regarded by England’s Health Secretary, Matt Hancock, as a “phenomenal achievement.”

 

However, not phenomenal enough to lift any low-level restrictions despite this being a big talking point to encourage people to take the shot, according to public health officials.

 

In addition to Ramsay, a government advisor to Johnson, suggested that the influx of tourists coming to England for the summer may present an issue that conflicts with the plan to ease legal mandates on June 21.

Vice President Kamala Harris started laughing when asked Monday if she would be visiting the border amid the surge in illegal immigrants entering the country.

 

“Not today!” Harris said at the Jacksonville International Airport, before cracking up in response to the reporter’s question. “But I have before and I’m sure I will again.”

 

The recent surge at the U.S.-Mexico border has resulted in record-level numbers of illegal immigrants entering the country, triggering the first crisis for President Biden since he took office.

 

The Biden administration will be sending officials to Mexico and Central America to address the surge, NBC News reported Monday. But their response has still drawn widespread criticism from both Republicans and Democrats, and a bipartisan call for action.

 

Republican Texas Sen. John Cornyn and Democratic Arizona Sen. Kyrsten Sinema, whose states are directly affected by the crisis, called on the administration to find a solution.

 

“Your administration should take immediate action in two areas: ensuring there are sufficient resources and facilities at the border to manage the crisis and taking concrete steps to improve the asylum process. Both of these are critical to improving how our nation manages this situation,” Cornyn and Sinema wrote in a letter to the president.

Democrats Introduce New Green New Deal Bill Calling Fossil Fuels 'Racist'

 

The Hill reports that Rep. Always On-Camera (D-New York) and Sen. Elizabeth Warren (D-Not An Actual Cherokee) have introduced a new bill that would “invest” $500 billion to “create” “green jobs.”

 

Use of multiple scare quotes is intentional. Neither the race-hustling professor nor AOC know much about job creation, having never created any meaningful number of non-government jobs.

 

Government “investing” necessarily entails government taxing, or government just printing more money, which neither the Democrats nor The Hill note. Those green jobs supposedly already exist anyway; why else would John Kerry tell the Keystone XL pipeline workers whose jobs his boss destroyed to go build solar panels?

 

The so-called green economy also relies extensively on mining and minerals processing, which aren’t very clean processes. In fact, those technologies depend on rare earth minerals, which mostly cannot be mined in the United States due to environmental regulations. They’re mined extensively in China, which doesn’t regulate as heavily, leaving the mining operations dirtier.

 

Buried in the two leftists’ announcement is this little gem.

 

“The BUILD GREEN Infrastructure and Jobs Act will make the big federal investments necessary to transform our country’s transportation system, confront the racial and economic inequality embedded in our fossil fuel economy, and achieve the ambitious targets for 100% clean energy in America.”

"The View" co-host Meghan McCain blamed former President Donald Trump for a surge in racist attacks on Asian Americans and apologized or her own comments that might have aided that agenda.

 

McCain made the comments in a tweet Monday after she was criticized by John Oliver on "Last Week Tonight with John Oliver."

 

"I condemn the reprehensible violence and vitriol that has been targeted towards the Asian-American community. There is no doubt Donald Trump's racist rhetoric fueled many of these attacks and I apologize for any past comments that aided that agenda," McCain tweeted.

 

McCain's admission followed a mainstream media narrative that Trump's rhetoric blaming China for the coronavirus contributed to racist attacks on Asian Americans.

 

She had posted a meme decrying "Asian Hate" in a tweet after a lethal attack at three massage parlors in Atlanta that took the lives of six Asian women. Police have said that the suspect in the attack blamed his actions on a "sex addiction."

 

Oliver pounced on the meme to attack McCain and make the same charges against her as many had made against Trump.

 

"I think if the left wants to focus on P.C. labeling this virus, it is a great way to get Trump re-elected," said McCain in the video from March 2020. "I don't have a problem with people calling it whatever they want. It's a deadly virus that did originate in Wuhan."

 

"Oh good!" Oliver responded sarcastically.

Somehow, I don’t think Joe Biden understood what he thought Vladimir Putin understood about what they mutually understood. If I had to guess, I’d say that Mr. Putin understood Joe Biden to be the most pathetic blustering schlemiel he’d ever encountered on the international scene. But that must have been before Mr. B was installed in the White House by powers and persons unseen because it’s evident now that his handlers do not allow him to talk to foreign leaders, not even on the phone. Ms. Harris does that.

 

The alleged president went on to tell Mr. Stephanopoulos that Mr. Putin was “a killer” who would “soon pay a price” for interfering in the 2020 election. In turn, Mr. Putin promptly called the Russian ambassador back home “for consultations,” which is generally what happens when one country makes warlike noises to another country.

 

Mr. Putin added a tantalizing taunt days later, saying. “I’ve just thought of this now. I want to propose to President Biden to continue our discussion, but on the condition that we do it basically live, as it’s called. Without any delays and directly in an open, direct discussion. It seems to me that would be interesting for the people of Russia and for the people of the United States. I don’t want to put this off for long. I want to go to the taiga this weekend to relax a little,” Mr. Putin went on. “So, we could do it tomorrow or Monday. We are ready at any time convenient for the American side.”

 

Do you suppose Vladimir Putin is having some sport with Mr. Biden, this lightweight even among US politicians, with brain-rot to boot? Pretty soon, the president’s handlers will have to forbid him to open his pie-hole in public altogether. No more one-on-one interviews even with slow-pitch party shills like Mr. Stephanopoulos. They’ll just wheel him into the rose garden periodically like a cigar store Indian for proof-of-life demonstrations and leave the management of the nation… to others.

 

And how’s that going after a couple of months? Apparently, economic collapse is not enough for the party in charge of things now. They’re strangely compelled to seek every possible opportunity to insult the public’s intelligence while destroying what’s left of American culture. Case in point out of Nancy Pelosi’s Congress: HR1, the so-called “For the People Act,” institutionalizing ballot fraud in US elections. The law would make permanent the Covid-19 emergency mail-in voting system, over-riding whatever each state’s election law says — which makes the act appear patently unconstitutional — plus permitting same-day motor-voter registration of any live body, citizen or not, plus removing all voter ID requirements, and much more to ensure the country is never again threatened by a fair election.

 

Next up: HR5, the so-called “Equality Act,” institutionalizing the notion that categories of “male” and “female” are mere cultural constructs and must in no way be allowed to order any cultural activity from school to work to leisure. The bill was initially conceived to harden into law President Obama’s EO expanding the Department of Education’s Title IX rules on school sports — which eventuated in “trans women” disrupting girls’ sports. Now, men pretending to be women (and vice-versa) will be allowed to disrupt everything else in American life, especially the civil courts, with frivolous lawsuits.

Historic Selloff In Treasuries

 

In the past few months many have said the treasury market was oversold. That was irrelevant because the long bond yield had a fundamental reason for increasing. Imagine if a stock gets a buyout offer and it spikes. No one would short that stock because it is technically overbought. You’d only short it if you think the buyout offer won’t go through. Technical signals generally shouldn’t be the only reason you make a trade.

 

As you can see from the chart below, this has been the 3rd largest year to date drop in the long bond since 1973. That includes a period with spiking rates. This move has now gotten historic. Don’t get too excited though because the timing of selloffs matter when you’re looking at year to date numbers. It’s random that the confluence of events leading to the selloff in treasuries occurred at the end of last year and the beginning of this year.

You need to decide how much room the trade has left. If you think the 10 year yield can go to 2%, why fear a 10 basis point drop because the long bond is oversold? If anything, you should add to the trade if the yield falls enough when it corrects. On the other hand, if you think the 10 year yield peaked, any short term down move is problematic. You should exit the trade now. This scenario example essentially explains how the near term price action of an investment is irrelevant if you don’t plan on selling. However, it is everything if you want to sell.

Factor Movement For Dummies

 

You can pretty much tell by looking at a stock’s chart whether it is a long or short duration play. There aren’t many stocks that aren’t on one side. Fundamental investors are getting very impatient with the action because for the past few months, actual company performance hasn’t mattered. The only thing that has mattered is how it does with rising rates.

 

If you’re a long term investor, this is mostly short term noise. The problem is if you are a long term investor, you shouldn’t exclusively fill your portfolio with growth stocks with high multiples. Many investors did this which is why they are forced to worry about the 10 year yield. People ignored diversification because they didn’t see interest rate risk as real until it hurt them.

Ultrasound reads monkey brains, opening new way to control machines with thought

 

The most advanced mind-controlled devices being tested in humans rely on tiny wires inserted into the brain. Now researchers have paved the way for a less invasive option. They’ve used ultrasound imaging to predict a monkey’s intended eye or hand movements—information that could generate commands for a robotic arm or computer cursor. If the approach can be improved, it may offer people who are paralyzed a new means of controlling prostheses without equipment that penetrates the brain.

 

“This study will put [ultrasound] on the map as a brain-machine interface technique,” says Stanford University neuroscientist Krishna Shenoy, who was not involved in the new work. “Adding this to the toolkit is spectacular.”

 

Doctors have long used sound waves with frequencies beyond the range of human hearing to create images of our innards. A device called a transducer sends ultrasonic pings into the body, which bounce back to indicate the boundaries between different tissues and fluids.

 

About a decade ago, researchers found a way to adapt ultrasound for brain imaging. The approach, known as functional ultrasound, uses a broad, flat plane of sound instead of a narrow beam to capture a large area more quickly than with traditional ultrasound. Like functional magnetic resonance imaging (fMRI), functional ultrasound measures changes in blood flow that indicate when neurons are active and expending energy. But it creates images with much finer resolution than fMRI and doesn’t require participants to lie in a massive scanner.

 

The technique still requires removing a small piece of skull, but unlike implanted electrodes that read neurons’ electrical activity directly, it doesn’t involve opening the brain’s protective membrane, notes neuroscientist Richard Andersen of the California Institute of Technology (Caltech), a co-author of the new study. Functional ultrasound can read from regions deep in the brain without penetrating the tissue.

 

Still, gauging neural activity from a distance means sacrificing some speed and precision, says Andersen’s co-author, Caltech biochemical engineer Mikhail Shapiro. Compared with electrodes’ readings, functional ultrasound provides “a less direct signal,” he says, so “there was a question of how much information [ultrasound images] really contain.” The images could reveal neural activity as the brain prepared for a movement. But was there enough detail in that signal for a computer to decode the intended move?

 

To find out, the researchers slotted small ultrasound transducers, roughly the size and shape of a domino, into the skulls of two rhesus macaque monkeys. The device—attached by a wire to a computer—aimed sound waves down into a region of the brain called the posterior parietal cortex, which is involved in planning movements.
