Biden admin calls on SCOTUS to let police enter homes, confiscate guns without a warrant

On Wednesday, the U.S. Supreme Court will hear oral arguments in a case about whether law enforcement officers can enter people’s home and confiscate guns without a warrant, Forbes reported.

This comes in the wake of two mass shootings in the past eight days that have renewed the gun control debate, which has been relatively dormant throughout the coronavirus pandemic.

Caniglia v. Strom, Forbes senior contributor Nick Sibilla wrote, is a case that could have wide-ranging consequences for policing, due process, mental health, as well as the Fourth Amendment. Notably, as part of the case, the Biden administration and attorneys general from nine states are calling on the court to uphold warrantless gun confiscation.

The case all started with an elderly couple’s dispute over a coffee mug in August 2015.

To summarize the story, an argument led to the husband—Edward Caniglia—grabbing a handgun, putting it on the kitchen table, and telling his wife Kim: “Why don’t you just shoot me and get me out of my misery?” This led to more arguing and eventually to Mrs. Caniglia spending the night in a motel. She phoned her home the next day but got no answer, which prompted her to call the police in Cranston, Rhode Island and ask them to conduct a “well check” on her husband and to escort her home.

The police, however, did not conduct the check according to the books. They then insisted that Mr. Caniglia go to the hospital for an evaluation, though Mr. Caniglia refused, emphasizing that his mental health wasn’t their business. Mr. Caniglia agreed only after police promised—albeit falsely—they would not confiscate his guns while he was away.

Furthermore, officers then told Mrs. Caniglia that her husband had consented to the seizure, and she led them to the two handguns they owned, which were then seized. Despite Mr. Caniglia being immediately discharged from the hospital, police only gave back the firearms after he filed a civil rights case against them.

Significantly, when police confiscated the handguns, they did not allege it was to prevent imminent danger. Rather, they argued their actions were a manner of “community caretaking,” a slim exception to the warrant requirement in the Fourth Amendment of the Constitution.

As Sibilla explained, the community caretaking exception was initially created by the Supreme Court about half a century ago and was designed for cases involving impounded cars and highway safety, because police are often called to car accidents to remove nuisances like inoperable vehicles on public roads.

In Video: Houthis Shot Down US MQ-9 Drone Over Central Yemen

On March 24, the Houthis (Ansar Allah) released a video documenting the shooting down of a US-made MQ-9 combat drone with an anti-aircraft missile.

The drone was shot down over the central Yemen province of Ma’rib a day earlier. According to the Houthis claims, the drone was conducting “combat operations.”

In the video, the drone can be seen receiving a direct hit from an anti-aircraft missile right after firing a munition. Brig. Gen. Yahya Sari, a spokesman for the Houthis, said that the drone was targeted with a “new missile,” without providing any additional information.

The Houthis operate upgraded Soviet air-defense systems as well as air-to-air missiles which had been modified to be launched from the ground.

The MQ-9 “Reaper,” which was first presented by General Atomics in 2007, has an endurance of 14 hours. The combat drone can carry more than 1,000 kg of precision-guided weapons.

The drone was likely operated by the US military or the Central Intelligence Agency (CIA) which are known to be engaged in a drone war in Yemen.

The Houthis are currently leading a large offensive on the Saudi-led coalition and its proxies in Ma’rib. The US combat drone may have been conducting operations against the Yemeni group in support of the coalition.

WashPost lies about Sidney Powell, her Voter Fraud Court Claims

Cross-posted from TGP FactCheck

Washington Post’s Aaron Blake completely misrepresents Sidney Powell’s court filings, turning them into a false confession that she never believed her claims of voter fraud

In fact, Powell’s filing is quite clear that she does believe her claims about voter fraud, and publicly posted the evidence she used to make her determination

Blake lies to his readers and is committing serious journalistic malpractice to suit a left-wing narrative

The 2020 election was defined by accusations of voter fraud, and yet the media immediately after the election and subsequently, have sought to delegitimize any accusation of fraud. Even as hundreds came forward to offer eyewitness statements about fraud, still the official media narrative was that there was no such thing and, even if there was a little, there was never enough to make a difference. Lawyers who sought to prove the fraud in court, including Sidney Powell, Rudy Giuliani, among others, were subject to official ridicule by the media.

The main antagonist of most voter fraud accusations, Dominion Voting Systems, has filed billion-dollar defamation lawsuits against several of the lawyers and figures who argued to consider the evidence of voter fraud in court.

Aaron Blake at the Washington Post is continuing this narrative by misquoting and lying about the supposed admissions of her attorneys in filing a Motion to Dismiss in federal court. If you actually read the Motion as filed, however, it is clear that Blake’s characterization of the Powell filing is a major misrepresentation and false.

Major Violations:

Journalistic malpractice

Lying

Misrepresentation

Lying headline

Sidney Powell was a well-known federal criminal defense attorney who published the book “License to Lie” about the systemic problems at the Department of Justice and among federal prosecutors. She took over the Mike Flynn prosecution and quickly turned a losing criminal case involving a false guilty plea, into an almost total exoneration for Flynn. During the election, when Powell claimed that she had seen evidence of systemic fraud, and specifically fingered Dominion Voting Systems as the culprit, it gave supporters of former President Donald Trump enthusiasm that the fraud they believed occurred would be addressed.

Yet repeated tribunals and authorities refused to act on the evidence, statements and allegations. Canvassing boards certified the results as untainted by fraud, legislatures certified the results even though many within the state were complaining and lawsuits were pending, and many courts threw out suits for reasons of legal technicalities like standing, or because the judge found the accusations lacking credibility when considering the word of the government officials who were claiming the results were free of fraud.

Psaki Brushes Off Reporter Asking Why Hunter Biden Received $3.5 Million From the Mayor of Moscow’s Wife

White House Press Secretary Jen Psaki on Wednesday was asked about the $3.5 million Hunter Biden received from the wife of the former mayor of Moscow.

Psaki brushed off the reporter’s question as if it was total nonsense with no documents to back up the claims.

“I am not familiar with that claim. It does not sound like it is backed up with a lot of evidence,” she said.

Last September the Senate Finance and Homeland Security Committees released a devastating report on the Biden crime family and backed up their claims with documents from the Treasury Department.

How much more evidence does Psaki need?

According to documents the Senate committees obtained from the Treasury Department:

Hunter Biden received a $3.5 million wire transfer from Elena Baturina, the wife of the former mayor of Moscow on February 14, 2014 and another $241,797 to a bank account for Rosemont Seneca Thornton from May-December 2015.

Joe Biden and his corrupt son Hunter still have not been held accountable for their international money laundering scheme.

Psaki treated the reporter as if the Hunter Biden story was just an internet rumor.

Trump brought up the $3.5 million payment to Hunter Biden during one of the presidential debates.

“China ate your lunch, Joe!” Trump said. “And no wonder, your son goes in and he takes out billions of dollars to manage — he makes millions of dollars,” Trump said to Biden.

Trump continued, “And also, while we’re at it, just out of curiosity, the Mayor of Moscow’s wife gave your son $3.5 million. What did he do to deserve it? What did he do with Burisma?”
