The burnt body of an unidentified man was discovered at Bongolethu Primary School in Browns Farm yesterday.

 

On Sunday, a 23-year-old man was stoned to death, allegedly by an angry mob, after being accused of attempting to rob a resident in Kosovo, Samora Machel, in Philippi.

 

On Friday, an unidentified man was found on the street after allegedly being beaten to death. He was accused of attempting to steal a cellphone in Litha Park, Khayelitsha.

 

Last Monday, 24-year-old Samkelo Nyeka was burnt and stoned to death after being accused of stealing clothes.

 

The body in Browns Farm yesterday was found by the school’s caretaker, Mziwethu Mketo.

 

“I found the body at around 9am while doing my routine patrol. He was visibly burnt.

 

“I rushed to let the principal know and he immediately sent the children home because we were trying to protect them from seeing the body, trying to shield them from the trauma,” said Mketo.

 

Gugulethu Development Forum secretary Vincent Domingo said that the spike in incidents of alleged mob justice stemmed from a deeper issue.

 

“Our communities are under siege from crime and they feel that they need to protect themselves. This is a reflection that they are slowly losing faith in the police and it needs attention.”

Well, this isn't a good look for Jessie Duarte: The ANC stalwart has been caught blasting the Zondo Commission, while leaping to Jacob Zuma's defence.

 

Senior members in the ANC are at the mercy of a ‘mole’ it seems, after another secret audio clip was publicly leaked on Tuesday. Just days after Cyril Ramaphosa’s private conversation with Jacob Zuma was uploaded online, Deputy Secretary-General Jessie Duarte has suffered the same fate – but her utterances are much more explosive.

 

The senior politician can be heard criticising Raymond Zondo, who is currently the head of the State Capture Inquiry. The DCJ has had a number of high-profile showdowns with Jacob Zuma – who may yet go to prison for ducking the Commission. Duarte, however, has picked her side in the ongoing battle…

After tuning the Deputy Chief Justice, she then laid into Zondo’s senior – Mogoeng Mogoeng. The 67-year-old accused the Chief Justice of ‘having no understanding of the Constitution’, and fears his religious beliefs are a danger to South Africa.

Over 300 chickens have been struck down by this outbreak of Bird Flu, and this commercial chicken farm in Ekurhuleni is now under quarantine.

 

A commercial chicken-layer farm in Ekurhuleni, Gauteng has had an outbreak of Avian Influenza – also known as Bird Flu – this week, and the deadly pathogens have led to an emergency response from the Land and Agriculture Department.

 

Furthermore, the Gauteng veterinary authorities have placed the farm under quarantine, while investigating the outbreak. Ministry spokesperson Reggie Ngcobo in the statement said authorities were also performing back and forward tracing to determine the extent of the outbreak and assist with safe disposal of dead chickens and disinfection of the farm.

 

“The samples from this farm that were sent to the laboratory tested positive for the H5 strain of avian influenza (Bird Flu). It must be said that this farm was also part of the H5N8 highly pathogenic avian influenza (HPAI) outbreak in 2017.”

Farmers have been told to look out for the tell-tale signs of Bird Flu, which become easily noticeable if they encounter an outbreak. Over 300 birds have succumbed to the disease in Ekurhuleni, and many more birds have been killed to prevent the spread of the disease further. The most recognisable symptoms of Avian Influenza include:

 

 Quietness and extreme depression.

 A sudden drop in production of eggs, many of which are soft-shelled or shell-less.

 Wattle and combs become red and swollen.

 There is also swelling of the skin under the bird’s eyes.

 They experience coughing, sneezing, nervousness signs, and diarrhoea.

 Affected birds also have haemorrhages (blood spots) on the hock.

Ugandans are making disparaging comments on social media about the multibillion-dollar oil pipeline deal that the country has signed with Tanzania and Total. The secrecy surrounding it has raised fears of corruption.

 

Uganda, Tanzania and the French oil company Total, along with its investment partner in Uganda, the China National Offshore Oil Corporation (CNOOC), signed a series of agreements on Sunday to build a heated pipeline that will carry crude oil from western Uganda to the Indian Ocean coast.

 

The deal, worth $3.5 billion (€2.9 billion), and the secrecy surrounding the details have raised public fears of corruption.

 

Uganda's crude oil is highly viscous, which means that it needs to be heated to remain liquid enough to flow. The East African Crude Oil Project Pipeline (EACOPP) could be the longest electrically heated crude oil pipeline in the world, at 1,400 kilometers (850 miles). Construction is expected to begin this year.

 

Tanzania's new leader, President Samia Suluhu Hassan, was in Uganda to witness the signing of the documents — perhaps her most important executive action since her inauguration in March.

 

The event was "an auspicious occasion" that would unlock the development of the region's oil resources, she said. The shareholder agreements cover the construction of the pipeline, which is designed to connect oil fields near Lake Albert to the Tanzanian port of Tanga.

 

Ugandan President Yoweri Museveni hailed the deal as a major milestone and a victory for the countries.

 

Watchdog groups and others also have warned against the personalization of Uganda's oil resources and heavy borrowing by national budget authorities anticipating oil revenue.

 

Civil society groups led by the African Institute for Energy Governance (AFIEGO) have been urging the governments of Uganda and Tanzania and the oil companies to call off their plans.

 

The AFIEGO noted that some of the people affected by the pipeline have not been compensated and that the oil developments are also taking place in an ecologically sensitive conservation area.

 

In an interveiw with DW, Diana Nabiruma, the communications head for AFIEGO, said: "Previously Uganda has signed secret agreements, and Ugandans have lost. For instance, the president told us that electricity in Uganda is expensive because government officials conspired to sign agreements that favor bidding companies. Now we are seeing this being repeated in the oil sector."

 

They continue to question the fact that the oil deals are still secret despite Uganda being a member of the Extractives Industries Transparency Initiative, Nabiruma added.

 

President Museveni, who has led Uganda since 1986, has sometimes suggested that the discovery of commercially viable oil quantities in 2006 created an opportunity for him to remain in power. "They are targeting my oil," he said of his challengers in the country's 2016 presidential election.

 

His personalization of the oil fields quickly dashed hopes in Uganda that the country could become an oil Eldorado. After that, the scramble to evict residents began and was often perpetrated by Museveni's cronies and members of his inner circle.

Covering the murder trial in Piet Retief turned into a strange daydream shot through with hatred, incompetence, and old-fashioned gullibility.

 

There are two versions of how Zenzele and Mgcini Coka died on 9 April, but there was only one crowd outside the bail hearings of those the state has accused of the crime. The ANC and EFF demonstrations looked separate, but only for about ten minutes; they merged after the slogan ‘down with the farmer’ went through a few loud speakers.

 

The substance of the first day’s bail hearing can be summarized as follows. The prosecution alleges that there is a ‘schedule 6’ offence in play (worse than ‘schedule 5’ murder), meaning that murder was committed pursuant to a ‘conspiracy’ or ‘syndicate’ operating with ‘common purpose’. This means, in laymen’s terms, that the farmers can be thought of as having acted as a gang (a boer-gang) and that the accused should therefore only be allowed bail in extraordinary circumstances. The defence has rejected this, but the matter could not be fully heard yesterday.

 

Before the hearing began there was excitement outside in the form of rocks being thrown at police and journalists across a barbed wire barricade from among the crowd holding placards condemning ‘1652’ people [white South Africans]; ‘inyama’ which technically means ‘flesh’ but is a parochial term for white South Africans; ‘umlungu’ whose technical meaning is debated but means white person; and ‘amabhunu’, which again can mean all farmers or mean only white farmers, depending on context.

 

The other chief targets were ‘amaphoisa’, the police, and the DA. The crowd also pulled barbed wire into itself, a curious point for later reflection.

 

Even after the proceedings began, court testimony was punctuated by an occasional flash-bang detonation outside, though in the absence of rocks there was a period between 1pm and 2pm when (emptied) beer bottles became the preferred means of political expression, striking the tarmac with percussive hisses while music blared through amped speakers. After the court adjourned, the ‘DJ’ played a happy tune, warming up a speech that consisted of the chant ‘We are angry until further notice’ on repeat.

 

On leaving the court shortly after 2pm, I wanted to find the police liaison officer (other cops will not talk to journalists in public) to ascertain a key fact of the day. Police outside the courthouse directed me to Captain Masuku, the local communications chief, who ‘will be here in five minutes’. Half an hour later he had not arrived, and I was told to look for someone with three stars on his shoulder, a captain, in the course of which I passed the now diminished crowd of protesters, some of whom called me ‘umlungu’, ‘Verwoerd’, and ‘vokken van Riebeek’.

 

Captain Gwebu told me to go and find Captain Masuku at a Total garage three blocks down the road. I arrived at the garage and saw no police. Instead there were protesters, many in ANC- and EFF-branded attire, one of whom, in a plain green shirt, shouted ‘Umlungu’ at me repeatedly while staring me down. As I turned the car around, he kicked a tire and shouted ‘Umlungu, vok off’.

 

Another young man ran from the front, hurling a rock at me full tilt, and the last thing I heard before the smash was ‘Umlungu ngizokubulala’ [white person, I will kill you]. I heard another thud on the roof.

 

Captain Gwebu was not impressed into action, nor were any of his colleagues. I was, however, told that a new, higher-ranking liaison officer had arrived from out of town. So, finally, I interviewed Colonel Mdhluli, asking the simple question about whether the police violated a court order that day, on which you will receive a later report, but not before giving eNCA the chance to finish their interview with the colonel.

Thereafter, I went to the police station to report the incident formally. There I saw two other vehicles that had been damaged by stone-throwers, and, having found their owners, discovered that their encounters with lawlessness had also occurred while driving past the same Total garage, a route on which one had been directed by police.

 

Shortly before 4pm, a third motorist arrived who had been attacked in the same way at the same place. This woman was visibly shaken, and teary. She struggled to control her voice as she asked me where to go to report the incident. She made phone calls in German and then told me that had she not installed extra-strength windows, she would now be dead. ‘The hatred, I couldn’t believe the hatred,’ she said, over and over.

 

Since a racial slur was yelled at me when the IRR car was struck, I should add that all the others (including those whose attacks I have reviewed on video but who did not go to the police station) were also white. In addition, I saw several black motorists around the Total garage who were not attacked.

 

Given the facts to hand, it stands to reason that the car attacks were driven by racism. This is not to say that the ideology of hate being expressed by brute force only affects white people.

 

I tried to get my vehicle repaired, but found businesses were closed, as were restaurants and most else besides. My mind flashed back to one of the young women in the photograph below – who also asked not to be named, but wanted her picture taken – who works at a nearby funeral home. She had said: ‘You must be scared of these people. We are scared.’

 

It would be a mistake to think that there are only victims of one colour, but it would also be mistake to overlook the method in the mob’s madness. Jurgen Gevers had posted days before that the Mkhondo Local Municipality Facebook official account should not have condemned the accused before all the facts of the Coka brothers’ deaths had been established. For this he was targeted on Facebook, and then his butchery was the only reported business to be vandalized on the day the bail hearings started – close to where the IRR car’s windscreen was smashed.

 

The reason why I had been sent to the Total garage to seek out Captain Masuku was that he had gone there to investigate a stabbing, allegedly by the protesters opposing the granting of bail to the five accused. The stabbed individual, not named by police, was reportedly in hospital in a serious condition.

 

My own fault in this matter is gullibility. When Captain Gwebu told me go and find Captain Masuku at the Total garage, I had asked, ‘What is the nature of the situation?’ He replied that Captain Masuku was investigating this stabbing, and that I should go and find him there.

 

‘Surely’, I assumed, this means there is a neat yellow-and-black police tape around the scene and that police officers are there, forensic tests are being done for blood and fingerprints, and witnesses are being interviewed. ‘Surely’, I assumed, I would be safe on arrival. ‘Surely’, I assumed, Captain Gwebu would only send me there if the situation had calmed down to the point that Captain Masuku would have a minute to spare for a journalist.

 

Between these cardinal points – foolish gullibility, incompetence, and hatred – a political map could be drawn that covers more than the three blocks between the Total garage and the magistrates court in Piet Retief. Our good fortune is the chance to learn a lesson from the experience. Not everyone has the chance.

The defence team in the Piet Retief bail hearing expressed an alarmed objection to magistrate Simon Fankomo when they noticed that investigating officer Warrant Officer Vukile David Nhlapho’s testimony was seemingly being relayed to him in messages scribbled on a board by someone else in the courtroom, and held up for him to read.

 

Once it was drawn to the court’s attention, there followed a detailed legal debate until the court adjourned for lunch. When the hearing resumed, there was no further prompting.

 

Defence counsel J G Cilliers SC said he was ‘flabbergasted’ by what amounted to tampering with a witness.

 

Your correspondent had noticed this procedure taking place repeatedly for more than hour before it was spotted by the defence team.

 

The apparent prompting of Nhlapho – which a legal expert described to the Daily Friend as ‘extremely worrying’ – came during his examination by Advocate Robert Molokoane, acting for the state.

 

At issue was whether or not the five men facing charges of murder, attempted murder, kidnapping, and defeating the ends of justice arising from the murder of brothers Zenzele and Mgcini Coka on the farm Pampoenkraal on 9 April, should be granted bail.

 

The five accused – farmers Daniel Malan, Cornerlius Greyling, Othard Klingenberg, Ignatius Steynberg, and farm manager Zenzele Yende – all completed the submission of their affidavits in support of being released on bail.

 

The bulk of yesterday’s hearing was devoted to Warrant Officer Nhlapho’s testimony.

 

He submitted that the accused did the commit the crimes detailed in the charge sheet, and argued that the element of common purpose was present in that they had conspired to act as they had.

 

Nhlapho urged the court to deny the five bail on the grounds that releasing them would undermine peace across the country, and in the Piet Retief district in particular. He said that the case had taken on a racial slant; police had received reports over the past week of white people being attacked, while the broader community believed that if the accused were released it would signify there was no justice in South Africa.

 

Advocate Cilliers SC drew the court’s attention to the fact that none of the witnesses on whose testimony the prosecution had built its case had had anything to say about how the farmers at the scene of the murders of the Coka brothers had been injured, including Hans Moolman, who remains in hospital recovering from an injury caused by a blow to the head.

 

Cilliers asked Nhlapho if he did not find it ‘strange’ that so many witnesses had claimed to have seen the events of 9 April, and that objective evidence showed several farmers had been severely injured, yet none of the witnesses had said anything about the injuries or how they were caused.

 

Nhlapho said it was not significant, and that more witnesses might come forward.

 

The matter was adjourned until Monday.

Security camera footage depicting events leading up to the deaths of Amos and Zenzele Coka on 9 April materially contradicts witness testimony against the four farmers and a farm manager charged with the murders, the defence told the court in Piet Retief this morning.

 

The state questions the reliability of the footage, suggesting that it may have been edited. However, investigating officer Warrant Officer Nhlapho, who attended a viewing of the footage today by the state and defence teams, admitted that witness accounts were ‘incorrect’ in material respects, telling the court that some of the witnesses the state was relying on had told ‘a blatant lie’.

 

The contents of the footage of events at the farm Pampoenkraal on 9 April were relayed to the court by Nhlapho at the resumption today of the bail hearing of the five accused, farmers Daniel Malan, Cornelius Greyling, Othard Klingenberg, Ignatius Steynberg, and farm manager Zenzele Yende. They face charges of murder, attempted murder, kidnapping, and defeating the ends of justice.

 

The defence argued that the video evidence had only recently brought to its attention and that its material contradiction of the state’s witnesses rendered the case against the five accused so weak that bail must be granted.

 

The footage, which the Daily Friend has seen, evidently shows that the first altercation on 9 April on Pampoenkraal farm took the form of several men, armed with large sticks, invading the farm and harassing farm workers. It furthermore shows that Amos Mgcini Coka was forcefully removed from the scene by one of the farm workers.

 

This contradicts the version given by the state, according to which seven peaceful unarmed work-seekers arrived on the scene to meekly seek jobs. It also contradicts witnesses’ claims that Amos Coka was removed in the hands of those with whom he arrived at the farm: in the video footage, it is evident the farm worker who scrummed Amos Coka out was his own brother, Zenzele Coka.

 

The defence maintains that Amos Coka later shot dead his brother, Zenzele, who had remained loyal to his employers at Pampoenkraal.

 

Piet Retief was quieter this morning than last week, as the men returned to the dock.

 

More than 200 police officers have been deployed in the town to keep the peace. Policing were monitoring people coming into town, and at least one arrest was made earlier today.

 

In addition, a larger barbed-wire perimeter has been drawn around court, providing more secure lines of defence and ensuring that amplified speeches and songs are beyond earshot of the court. Movement in the town was being monitored from the air by a police helicopter.

 

The scene this morning was in stark contrast to last week’s events when the start of the bail hearing was accompanied by stones being thrown at police, journalists, and others – damaging several cars – and police using stun grenades as a crowd-control measure.

Seven Chinese nationals face 160 counts, many of them relating to the violation of labour laws in South Africa

 

Seven Chinese nationals who were arrested on charges of human trafficking and contravening South Africa’s labour laws, are expected to return to the High Court in Johannesburg on Monday, April 26, 2021.

 

The matter continued the previous week, but had to be adjourned because Chichewe and Mandarin interpreters were not available at the time.

 

The accused – Kevin Tsao, Chen Hui, Qin Li, Jiaqing Zhou, Ma Biao, Dai Junying and Zhang Zhilian – have already been indicted on charges of human trafficking, debt bondage, kidnapping and pointing of a firearm.

 

The four men and three women were nabbed in November 2019 as part of a sting operation conducted by the department’s Inspection and Enforcement Services (IES) branch in Gauteng, the South African Police Service (SAPS), the Department of Home Affairs and the Hawks.

 

CHINESE NATIONALS ACCUSED OF TRAFFICKING 91 MALAWIANS

 

The suspects are said to have trafficked illegal immigrants into South Africa and subjecting them to forced labour. Authorities pounced on them in a factory which staffed with 91 Malawian nationals – including 37 children.

 

The Department of Employment and Labour is involved in the matter and seeking prosecution against the group.

 

“The accused are facing schedule six offences and will face 160 counts relate to contravention of the Compensation for Occupational Injuries and Diseases Act (COIDA), Occupational Health and Safety (OHS) Act, Unemployment Insurance Act, Unemployment Contributions Act, Prevention and Combating of Trafficking in Persons Act, kidnapping, contravention of Immigration Act, knowingly employing illegal foreigners, human trafficking, kidnapping, pointing a firearm, debt bondage, benefitting from the services of a victim of trafficking, conduct that facilitates trafficking, illegally assisting person(s) to remain in South Africa and failure to comply with duties of an employer”

It would later emerge that the victims were transported into the country using containers. The Malawians are alleged to have been brought to South Africa by a middleman known as “the transporter” who is still on the loose.

 

Six out of the seven accused are currently out on bail ranging from R30 000 to R70 000, but have been ordered to adhere to strict conditions that restrict their movement and ability to conduct business.

 

Accused number 7 in the matter, Zhang Zhilian, is currently in custody after she was caught trying to flee the country on 24 February 2021. She was nabbed at the OR Tambo International Airport.

About 100 people representing anti gender-based violence groups marched to a Durban mall and the Point Road police station on Monday over the alleged sexual abuse of three women.

 

The uproar was triggered after the women, who were employed as cleaners in the mall, were allegedly sexually assaulted at work by their manager and supervisor. They were also allegedly turned away by the police when they tried to report the abuse.

 

Nkosinathi Sisya, secretary-general of the Phepha Foundation, said the aim of the protest held on the eve of Freedom Day, was to raise awareness about gender-based violence and femicide in the workplace

 

“We want to expose the people who take advantage and abuse women in the workplace. We are saying we are tired of sitting helplessly while our mothers and sisters are being sexually harassed and assaulted at their work. Today there should be justice seen for them,” said Sisya.

 

“The SA Police Service assisted the victims with the opening of cases, conducting site visits at the crime scene where critical evidence which included used condoms was discovered.

 

George Mystris, legal representative for China Mall, accepted a memorandum from the group and confirmed that the two men had recently resigned after the allegations against them.

 

At the police station, Phumelele Mngomezulu, an official from the KwaZulu-Natal premier’s office, handed over a memorandum calling for officers to be trained on handling rape and abuse complaints.

 

“We also want this station to reopen all cases which were closed without the consent of the victims. We want those who are implicated in closing these cases to be investigated. The premier always speaks about government employees having to deliver according to their jobs. We ask the same of the police,” said Mngomezulu.

 

The acting station commander, Col QV Ngubane, accepted the memorandum and undertook to investigate the cases and report back to the Phepha Foundation. She said a task team had been appointed to deal with the complaints.

 

Both the mall management and the police station have been given seven days to respond to the memorandum.

While it had long been known that the two factions in the ANC – the one aligned to Ramaphosa and the other to Magashule (the so-called ‘Radical Economic Transformation’ grouping), the embattled SG had rarely, if ever, directly pointed fingers at the party’s leader.

 

ACE MAGASHULE POINTS FINGERS AT RAMAPHOSA

 

Ace Magashule is as candid as can be when coming to his stance on Cyril Ramaphosa and his plans to bag another term in office, claiming he (Ramaphosa) is hell-bent on “capturing” the secretary general’s office, which is considered the most powerful position in the ANC.

 

“The real motive behind my being purged is the desire to remove me, by hook or by crook, from the all-powerful position of SG so the road to the re-election of president Cyril Ramaphosa and his faction in the next national conference is made easier. Suspended ANC secretary general Ace Magashule

 

To take things back, this is how it started: the ANC had suspended Magashule after he refused to step aside, in abidance to its step-aside policy, which directs members who face serious charges before the courts, to temporarily vacate office.

 

Magashule faces fraud, money laundering and corruption charges in connection to a R255 million asbestos tender in the Free State, which was awarded when he was premier, in 2014 – this means he was one of members, to which the policy applied.

 

Things then got complicated when he issued a letter of suspension to Ramaphosa (despite he being suspended himself). He contended that he was still the SG and would continue carrying out his duties, however the ANC dismissed this and reaffirmed his suspension, subsequently ordering him to apologise.

The Cape Town Anti-Gang Unit member is accused of providing murder-accused Nafiz Modack with confidential police information.

 

One of the many bombshells revealed during the appearance of alleged Cape Town gang leader Nafiz Modack on Friday was the State’s outlining of charges levelled against one of his six co-accused – a South African Police Service (SAPS) member named as Sergeant Ashley Tabisher.

 

Tabisher, who was promoted to the rank of Sergeant in 2018 and assigned to the newly formed Anti-Gang Unit (AGU), was arrested shortly after Modack and charged with corruption and money laundering related to the dissemination of confidential information to alleged gang members.

 

STATE OUTLINE CHARGES AGAINST ‘CORRUPT’ AGU MEMBER

 

The State’s submission to the Cape Town court outlined how Tabisher had established a relationship with Jenick Adonis and Amaal Jantjies, who are understood to have been working with the AGU to supply them with information related to illegal firearms.

 

“Adonis and Jantjies co-operated with the AGU hoping that they would assist them in obtaining bail for Accused 5 in a matter that he was being tried for at Khayelitsha Regional Court, or in the alternative to assist him (Accused 5) in obtaining a reduced sentence in Khayelitsha Regional Court upon conviction in that case.”

 

The State allege that during that time, Tabisher and other members from the AGU were responsible for the transportation of the two women to and from a Khayelitsha Court.

 

“Tabisher was also directly in contact with them and facilitated the information that he had received from them,” the State claimed.

 

In the weeks that followed, Tabisher allegedly made contact with Adonis and Jantjies, with Modack alleged to have demanded that the pair ascertain information from the SAPS member relating to a series of raids on his private residences at the time.

 

“Modack wanted to be prepared for the AGU beforehand,” they claim.

 

MODACK ‘DEMANDED TIP-OFF’ FROM TABISHER

 

Tabisher is then accused of having done what was asked of him and tipped-off Modack to the imminent raids, with the officer then handed RI0 000 and a cell phone, which was valued at approximately R3 500.

 

On Friday, Lieutenant Colonel Philani Nkwalase said in a statement after Modack was charged with Kinnear’s murder that the officer had exchanged confidential police information with a suspected gang leader.

 

“Modack faces a charge of corruption along with AGU Sergeant Ashley Tabisher for allegedly offering him R10 000 in exchange for information on police operations against him (Modack). They further worked in concert with Amaal Jantjies to infiltrate the AGU, whilst Jantjies was also charged for the failed hand grenade incident,” he said.

 

The State claimed that Tabisher’s actions amounts to the “illegal, dishonest, unauthorised, incomplete carrying out or performance of any powers, duties or functions” and said that he had without doubt abused his power as a representative of South African law Enforcement.

While delivering Q4 crime statistics, on Friday, Cele said sexual violence, including rape, meted against women in SA is simply shameful.

 

Police Minister Bheki Cele delivered the fourth quarter SAPS crime statistics 2020/2021 on Friday 14 May and boy did it paint a grim picture. While there has been a decline in sexual offence cases, including rape, a number not far off from 10 000 doesn’t sound good either.

 

Keeping in mind that these statistics portray a picture from January to March 2021 – a mere three months.

 

CRIME STATISTICS FOR RAPE

 

Let’s get straight to it, shall we? A staggering 9 518 people were raped between January and March this year. That’s nearly 10 000 people in the space of just three months. While it’s a high number, Cele says it is down from the same period last year.

 

“This is a decrease of 387 cases, amounting to an almost 4% decrease compared to the previous reporting period,” said Cele.

 

What’s disturbing though, is that the majority of these cases took place at the house of the victim or the house of the alleged rapist.

 

“A sample of 6 893 of the rape incidents revealed that 4 130 of such incidents took place at the home of the victim or the home of the alleged rapist,” said Cele.

 

The Eastern Cape’s Lusikisiki police station recorded the highest incidents of rape, overtaking the Inanda station, which has sadly held the number one position for some years.

That’s according to the Crime Stats for January-March 2021, and it makes for a grim read.

 

WHERE ARE THE MOST MURDERS COMMITTED IN SOUTH AFRICA?

 

The town is just to the southwest of Pietermaritzburg, and has seen its murder rate rocket in the past 12 months, jumping from 43 in Q4 of 2019/20 to 73 this time around. Murder cases have almost trebled here since 2018.

 

Two other towns in KZN also complete the top three, with Inanda and Umlazi reporting a combined 124 murders between them in the first three months of 2021. There are six locations in the top 10 that reside in the Western Cape, and Ivory Park is the sole representative for Gauteng amongst the top-reported police stations.

Further details of Health Minister Dr Zweli Mkhize having allegedly benefited from the Digital Vibes contract have emerged, thanks to Daily Maverick’s investigative journalism efforts. The latest revelations come just days after the publication uncovered damning links between Mkhize and the communications company – R300 000 sent to a company belonging to the minister’s son Dedani Mkhize.

 

Here’s a short recap: It was learnt via Daily Maverick that two women linked to Mkhize – Tahera Mather and Naadhira Mitha benefited from Digital Vibes’ R150 million contract with the Department of Health by working for the company as paid consultants.

 

It is alleged that Digital Vibes wildly inflated the costs of setting up Mkhize’s briefings during the COVID-19 pandemic, with funds from the DoH funneled into a host of obscure third-party bank accounts. The minister has vehemently denied having any knowledge of these irregular processes, however, and maintains his innocence.

 

DIGITAL VIBES BOUGHT A CAR FOR MKHIZE JR.

 

Now it has also emerged that in May 2020, Digital Vibes forked out R160 000 for a 2003 Toyota Land Cruiser at a Pietermaritzburg car dealership. Who drives the vehicle? None other than Zweli Mkhize’s son. If the latest probe is anything to go by, the suggestion is that Mkhize Jr. has been benefitting from the lucrative contract.

 

At the time of the transaction, the Department of Health had only paid about R50 million to the company. According to Daily Maverick, other than two minor payments from the Municipal Infrastructure Support Agent, an entity of the Department of Cooperative Governance and Traditional Affairs (Cogta), Digital Vibes’ source of income has primarily come from the department.

 

The Digital Vibes saga has prompted calls for Mkhize to be given the axe. For now, the Special Investigating Unit (SIU) is still busy with the probe and said it would only be concluded at the end of June. Julius Malema ended up giving an interview to eNCA by mistake on Tuesday - and the EFF aren't happy with the broadcaster they are meant to be boycotting.

 

The EFF have been left outraged by what they perceive as ‘paparazzi tactics’ from eNCA. They have accused the broadcaster of securing an interview with Julius Malema via deceptive means, circumventing the media boycott the Red Berets have imposed upon the station in the past year.

 

JULIUS MALEMA ‘TRICKED’ INTO INTERVIEW WITH ENCA

 

Following chaotic scenes in the Pan African Parliament on Tuesday, a brief intermission was staged. In that time, Malema went to the sidelines and spoke with the media. Little did he know that one of the interviewers was from eNCA, and the party has since complained that the ‘lack of branding’ on their technical equipment was designed to trick Juju.

 

In a bellicose statement issued late on Tuesday, the EFF has branded the incident as a ‘disgusting and desperate act’. Malema gave Khaya James just a few minutes of his time, somewhat unwittingly, but the fallout has been nuclear since.

 

EFF RAGE AGAINST ‘STOLEN INTERVIEW’

 

The EFF, in typically uncompromising fashion, now wants the stolen interview removed from eNCA’s broadcasting platforms. They aren’t happy with this alleged act of deceit, and needless to say, their boycott remains firmly in place.

 

“The actions of the eNCA journalist were not only unethical, but disgusting for the fact their employer deliberately used a microphone with no branding, meaning they knew the interview was being done deceitfully. The ANC seems to be distancing itself from the EFF’s demand that the Ad Hoc Committee responsible for drafting a land expropriation-without-compensation (EWC) constitutional amendment bill should drastically change the existing text of the EWC Bill to give the state custodianship over all the country’s land.

 

This divergence emerged from last Friday’s meeting of the Ad Hoc Committee, when the EFF once again pushed strongly for the state’s existing custodianship of water and mineral resources to be extended to all land – and the ANC seemed to demur.

 

The EFF has been demanding state custodianship over all land for many years. On this basis, as the EFF puts it, all title deeds will become ‘meaningless’ and current landowners will need (revocable) 25-year leases from the state to keep using the homes, farms, factories, or other business premises they previously owned.

 

The ANC has been less overt in pushing for land custodianship but has long supported the idea. This was particularly evident in the Preservation and Development of Agricultural Land Bill of 2014, since withdrawn, which planned to give the state custodianship over all non-urban land.

 

In January 2019, moreover, a senior land department official, Masiphulo Mbongwa, told the World Economic Forum meeting in Davos (Switzerland) that the government planned to amend the property clause in the Constitution and then adopt a National Land Act – modelled on relevant water and mining legislation – which would give the state custodianship over all land.

 

Cold water on the EFF’s demand

 

At the Ad Hoc Committee meeting on 21st May, the ANC nevertheless poured cold water over the EFF’s demand that the state’s custodianship of the country’s land should be written into the Constitution.

 

Custodianship would have ‘a deleterious effect on all existing rights in land’, said the ANC’s Vuzumusi Xaba, for it would mean the ‘cancellation’ of all such rights. How would the ANC explain this, he queried, ‘to the residents of KwaMashu, Ntuzuma, Alexandra, Soweto, and Nyanga, who had recently been given full title deeds by the government to the houses they had occupied for decades before 1994?’

 

Now that the ANC government had restored the dignity that apartheid had so long denied them, ‘how would he explain to them that their rights would be cancelled and converted to leasehold?’ How would he explain such a shift to the communal property associations to which land had been restituted? And ‘how would he explain to the residents in Bishopscourt, Sandton and Westville that state officials would administer and supervise the proposed new [custodianship] tenure on their property?’

 

Mr Xaba’s claim that the ANC is solely responsible for expanding home ownership to black South Africans ignores all that the National Party government belatedly did, from the late 1970s to the early 1990s, to transfer such ownership to millions of black people in Soweto and a host of other townships. It also fails to acknowledge the breadth of home ownership in South Africa today, for this currently extends to some 11 million families of whom close on 8.8 million are black.

 

In addition, while it might seem that Mr Xaba is opposing the EFF’s dangerous custodianship ploy as a matter of principle, he is in fact keeping the back door to this open. For Mr Xaba also wants to retain the ‘deprivation’ clause in Section 25(1) of the Constitution – which the EFF seeks to remove – because he sees it as providing a crucial foundation for uncompensated custodial (and other) takings in the future.

The value in the ‘deprivation’ clause

 

Section 25(1) currently says that ‘no one may be deprived of property’ unless this is done under ‘a law of general application’ and in a way that is not ‘arbitrary’. The great value of ‘deprivation’ as opposed to ‘expropriation’, says Mr Xaba, is that deprivation need not be accompanied by the compensation that expropriation generally requires.

 

At last Friday’s committee meeting, Mr Xaba put it thus: ‘The Constitution provides two ways in which the state may interfere with property rights, which are deprivation and expropriation. The two have a different meaning. Whilst expropriation is deprivation, deprivation is not expropriation… In expropriation, the expropriated property vests with the state. In deprivation, there is no [such] vesting… It was through deprivation that the state became the custodian of mineral rights.’

 

A week earlier, at the Ad Hoc Committee’ s meeting on Friday 14th May, Mr Xaba had also stressed the importance of ‘retaining deprivation as it is’. He then said: ‘It [deprivation] authorises a limitation in the use, enjoyment or disposal of property…without compensation. The right in land may be terminated with no requirement for the state to pay any compensation, as opposed to expropriation. Expropriation occurs around the world [and] it is legally expected that there be some compensation.’

 

The EWC Bill was needed to circumvent this global expectation and achieve the objective of ‘having land without paying a cent’. However, the EWC Bill should not ‘get rid of the other instrument, deprivation, that is provided for in the Constitution’, for ‘the state could invoke this when [it] needed to deal with the issue of deprivation’ in the future.

 

Mr Xaba’s explanation of the difference between deprivation and expropriation is difficult to follow. However, the conflicting judgments of the Pretoria high court and the Constitutional Court in the Agri SA case help explain his point.

 

Conflicting judgments in the Agri SA case

 

The Agri SA case began after a company called Sebenza (Pty) Ltd found it lacked the funds needed to convert an unused ‘old-order’ mining right it had bought in 2001 for R1m into a ‘new-order’ mining right under the Mineral and Petroleum Resources Development Act (MPRDA) of 2002.

 

This was important because the MPRDA not only vested all mineral resources in the custodianship of the state, but also required that all unused old-order rights be converted to new-order rights within a year – failing which they would ‘cease to exist’.

 

Since Sebenza could not afford the application fee for this conversion, its unused mining right came to an end after a year, prompting it to sue for compensation. Agri SA, a lobby group for commercial farmers, many of whom had earlier owned unused old-order rights to the minerals beneath their land, took over the claim and brought it before the Pretoria high court.

 

The high court found that Sebenza had lost all the competencies of ownership it had previously enjoyed, while the MPRDA had given the mining minister substantially similar powers. The state had thus acquired ‘the substance of the property rights’ that Sebenza had previously owned – and it made no difference that the state’s competencies were termed ‘custodianship’ rather than ‘ownership’. Expropriation had indeed occurred and compensation of R750 000 was payable.

However, this ruling was in time taken on appeal to the Constitutional Court, which overturned it. The main judgment was penned by Chief Justice Mogoeng Mogoeng, who ruled that ‘the assumption of custodianship’ did not amount to expropriation because it did not make the state the owner of the right in issue.

 

Stated the chief justice: ‘Whatever “custodian” might mean, it does not mean that the state has acquired and thus become the owner of the rights concerned.’ No expropriation had thus occurred and so no compensation was payable.

 

What the Pretoria high court had seen as a meaningless distinction between the state’s powers as ‘owner’ or ‘custodian’ thus became an issue of major legal and monetary importance. Chief Justice Mogoeng’s approach also suggested that Sebenza’s ownership of the mining right – for which it had paid R1m – had simply vanished into thin air, whereas it had in fact been transferred to the state, as the high court had acknowledged.

 

Chief Justice Mogoeng’s ruling is clearly flawed, for it overlooks the generally accepted meaning of ‘expropriation’ in domestic and international law, was criticised for this by three Constitutional Court judges, and opens the way to other uncompensated takings carried out under the rubric of ‘custodianship’.

 

The flawed Mogoeng judgment was also confined to the particular facts and so cannot be used to found a broader legal principle. This defective ruling is nevertheless what underpins Mr Xaba’s enthusiasm for the ‘deprivation’ clause – and his belief that the state can use it to take custodianship of land at some future point without compensation having to be paid.

 

Has the ANC leopard changed its NDR spots?

 

Has the leopard then changed its spots? Does Mr Xaba’s criticism of the EFF’s custodianship proposal – and his newly expressed concern about the property rights of homeowners in areas ranging from KwaMashu to Bishopscourt – mean that the ANC no longer wants the custodianship of all land?

 

Or is the ANC simply playing a longer game? Is it using its EFF catspaw to generate enormous anxiety over the custodianship issue, so that it can then distance itself from the EFF’s proposal and thereby win broad public praise for its supposed moderation?

 

Does the ANC hope that public relief over this issue will then make it easier to achieve its real objective – which is probably to change the EWC Bill so that it strips the courts of their current powers to adjudicate on the compensation payable on expropriation and confines them to reviewing the reasonableness of executive decisions on what those amounts should be?

 

Does the ANC also believe that the deprivation clause it wants to retain will indeed give the state the capacity to take custodianship of all land at some time in the future – and ‘with no requirement…to pay any compensation’, as Mr Xaba puts it?

Mr Xaba’s current concern for property rights may seem like a breath of fresh air and bring hope to many that the ANC is drawing back from its damaging EWC plans. In a host of other spheres, however, the ruling party’s determination to expand state ownership or control – as a crucial element in its socialist-orientated National Democratic Revolution (NDR) – continues apace.

 

To name but a few examples, the ANC is still pushing ahead with:

  • the damaging Expropriation Bill of 2020, with its ‘nil’ compensation provisions and skewed procedural rules;

  • the National Health Insurance (NHI) Bill of 2019, which could in time see the transfer to the NHI Fund of medical scheme reserves currently valued at R90bn;

  • the erosion of pharmaceutical patent rights, ostensibly to help counter the Covid-19 pandemic;

  • a 20% ‘free carry’ for the state in all oil and gas exploration and extraction operations;

  • the diversion of pension savings into flawed infrastructure projects (and the ruling party’s patronage machine) under pending changes to Regulation 28;

  • state ‘co-ownership’ for all data privately generated from ‘South African natural resources’ (whatever that might mean); and

  • the effective prohibition of privately-owned firearms used in self-defence.

 

All of which suggests that the leopard’s spots remain just the same as before. And that, as the end-May deadline for the drafting of the EWC Bill draws ever closer, South Africans might suddenly find themselves confronted by the removal of the courts’ powers to adjudicate on compensation – and with no time left over to voice their strong objections.

The Gauteng Police Commissioner, Lt.-Gen. Elias Mawela, announced the decrease in his quarterly review of the province’s crime statistics.

 

In the past, the police force along with other security authorities had been much more frequently involved in anti-crime operations aimed at apprehending offenders.

 

During such operations, motorists would be stopped to check whether their driver’s licences are valid and whether their vehicles are roadworthy. Vehicles were also searched for weapons, stolen goods and illicit firearms.

 

Between January and March 2020, 19 206 people were arrested for a variety of offences and during the same time period this year, that number decreased to 13 482.

 

The sharp drop in visible policing operations is undoubtedly a call for Lt.-Gen. Mawela to step in and ensure that the police service in Gauteng is managed effectively and efficiently.

 

Combating crime in Gauteng is of the utmost importance and, thus, the police must not limit its operations due to logistical problems.

 

In light of the rising number of murders and attempted murders in the province, it is imperative that the police force fulfils its constitutional duty to ensure the safety of the people of Gauteng.

The business group Sakeliga has just released a government impact study on the Expropriation Bill obtained through a Promotion of Access to Information Act (PAIA) request. It appears that prior to Sakeliga’s PAIA-request, the study has been withheld from public consideration.

 

The document, a socio-economic impact assessment (SEIA) initiated by the Department of Public Works and Infrastructure, outlines government’s assessment of the costs and benefits of the controversial Expropriation Bill. Impact assessments are required in terms of a 2015 Cabinet decision to ensure that the costs of legislative and policy changes, as in the Expropriation Bill, do not outweigh the benefits.

 

The SEIA is supportive of confiscation of property without compensation and reveals various institutions’ purported support for the proposal. In fact, the study claims there is unanimous support for the Bill among the entities it consulted.

 

Sakeliga is imploring the groups listed in the document – which include Agri SA, the Banking Association of South Africa, and the American Chamber of Commerce, among others – to verify that the study accurately records their supposed support of the Bill. At the same time, it appears that opposing voices, from organisations such as Sakeliga, the Institute of Race Relations, and the Free Market Foundation, among others, are not considered in the SEIA, thus creating the façade of unanimous support among civil society for the Bill.

 

Gerhard van Onselen, Sakeliga senior analyst, notes that “Impact studies are typically measured against international standards. The present assessment, in our estimation, does not meet the benchmarks of a rigorous regulatory impact assessment. It rather reads like a political justification for expropriation policy and does not really account for the cost of the proposal.”

 

Among other things, the document claims banks will benefit from an increase in their mortgage books due to expropriation and state policy. Sakeliga regards this claim as factually unfounded.

 

“Moreover”, continues Van Onselen, “the document also does not model the impact of expropriation policies on for instance GDP trend growth, unemployment, investment, and poverty. Instead, it only concerns itself with direct costs to the state – for instance, defending against litigation – and not economic consequences.”

 

“While the 1975 Act is far from perfect, at present it offers more protection to property owners than the proposed Bill does. It guarantees the payment of solatium – money for inconvenience – in addition to market value as a baseline of compensation. The new Bill removes solatium, streamlines the expropriation process for government at the expense of property owners, and even allows government to confiscate property without compensation,” argued Van Staden. “The bill can in no way be described as fair or constitutionally-aligned.”

 

Sakeliga is considering further action to address the obfuscation of adverse economic realities at the hand of the so-called “study”.

Tighter lockdown restrictions are becoming increasingly likely, with President Cyril Ramaphosa having said on Tuesday that he is “deeply worried” about soaring COVID_19 infection rates, particularly in Gauteng.

 

“We are involved in a very, very serious situation in relation to the pandemic in Gauteng. We are also seeing cases rising in other parts of the world and here in the Western Cape. I was talking to premier Alan Winde earlier and we are seeing signs of that.”

Shadow World Investigations researcher Paul Holden on Tuesday told the state capture inquiry the cost of state contracts channelled to Gupta-linked entities was an estimated R57bn.

 

The figure was an R8bn jump from Holden’s previous calculations when he testified at the same forum last month.

 

He said the figure had changed because transactions that had been left out of his previous report were now included. These included:

 

• a payment by Transnet to Essa-controlled Regiments/Trillian, which pocketed R1bn;

• Eskom payments to Gupta entities;

• payments to The New Age newspaper by the department of water & sanitation; and

• other small payments Holden had missed in his initial report presented at the inquiry.

 

Of the R57bn, said Holden, R16.2bn was paid “directly or indirectly” to the Gupta enterprise, “all of which was drawn from SA state funds or kickbacks relating to state capture”.

 

“One of the most disturbing features of following the Gupta enterprise has been discovering these incredibly elaborate onshore and offshore bridges. In total, looking at these bridges, we have identified 3,659 separate transactions moving from these onshore and offshore bridges into the Hong Kong/China laundering network.”

African National Congress (ANC) president Cyril Ramaphosa has bemoaned the extent of political killings, particularly those targeting fellow comrades.

 

Ramaphosa delivered a virtual address to the eighth Regional Conference of Norman Mashabane Region in Limpopo on Monday, 21 June 2021.

 

His comments come in the wake of a shooting at an ANC branch meeting in Lephalale‚ Limpopo‚ which reportedly left two members dead and 14 seriously injured. According to police,

 

’’We should strive to root out these negative tendencies in the movement where thugs are rented to disrupt meetings. They are rented to intimidate and even kill members of the ANC,’’ Ramaphosa said.

 

“The prestige of the ANC should not be sacrificed at the altar of political expediency and thuggery. When we see thugs among us we must call them out because the ANC is not an organisation of thugs. Cyril Ramaphosa has said that the culprits of the attacks among ANC members are people who feel unduly entitled to positions.

 

Ramaphosa said the ones behind the attacks are the types of comrades who just want to plunder resources and not serve people.

 

“My view is that those types of comrades are those who just want to plunder resources of our people and not serve our people. Those who want to serve our people are disciplined‚ are orderly‚ are humble — people who put the interests of the ANC ahead of their own,” he said.
