WASHINGTON - The judge hearing the Texas antitrust lawsuit against Alphabet Inc's Google put limits on what the search giant's in-house lawyers can see in an order aimed at ensuring that confidential information used in an upcoming trial remains secure.

 

The issue is a key one for companies that have not been identified but that gave information to the Texas attorney general's office for its investigation and fear that their confidential data, like strategic business plans or discussions about negotiations, could be disclosed to Google executives.

 

The order issued by Judge Sean Jordan of the U.S. District Court for the Eastern District of Texas allows Google's in-house counsel to see information deemed "confidential" but they are then limited in advising on some competitive and other decision-making for two years regarding the companies whose data they see.

The lawyers representing the family of Ashli Babbitt, the Air Force veteran slain by Capitol Hill police during the mostly peaceful Capitol Hill protests, is pledging to continue their legal fight for justice over Babbitt’s death after the Department of Justice declined to prosecute – or even name – the officer who fired the shot that ended Babbitt’s life.

 

“Today the United States Attorney for the District of Columbia announced that it will not pursue criminal charges against the Capitol Police officer who shot Ashli Babbitt in our Nation’s Capitol on January 6, 2021,” the press release opened. They then lambast the Department of Justice for a statement many found puzzling, “Specifically, the investigation revealed no evidence to establish that, at the time the officer fired a single shot Ms. Babbitt [sic], the officer did not reasonably believe that it was necessary to do so in self-defense or in the defense of the Members of Congress and others evacuating the House Chamber.”

 

Terry Roberts, the family’s attorney, replied, “This double-negative is an odd way of explaining the basis for not bringing charges. It painfully glosses over the obvious problem of squaring the decision not to prosecute with the known facts.” Roberts added, “The actual evidence is this: the officer shot an unarmed woman who was not an immediate threat to him or any Member of Congress.”

The New York Times has finally confirmed what many political observers had been saying all along about the Capitol riots: It was pre-planned, the Capitol Police knew it was coming, and authorities effectively gave a ‘stand down’ order.

 

A new 104-page report dropped by an internal investigator shreds authorities for intentionally hampering the police response on what has subsequently been claimed was a “coup,” an “insurrection,” and an attempt to “overturn” the results of the 2020 election.

 

The Inspector General of the Capitol Police laid bare all of the disturbing issues involved with the way the January 6th Electoral College security was mishandled.

 

“A new report by the Capitol Police’s internal watchdog found that department leaders overlooked key intelligence in the run-up to the riot on Jan. 6, including a warning that ‘Congress itself is the target,’ and barred the force’s riot response unit from using its most powerful crowd-control measures,” the New York Times reported.

 

“The 104-page document, entitled ‘Review of the Events Surrounding the Jan. 6, 2021, Takeover of the U.S. Capitol,’ is the most searing portrait yet of the lapses and miscalculations around the most violent attack on the Capitol in two centuries,” the Times continued. “It adds significant new detail not unearthed in congressional hearings and is likely to inform a coming overhaul of the agency promised by lawmakers.”

Biden DOJ Pick Struggles to Defend Record on Black Panther Prosecutions

 

Justice Department nominee Kristen Clarke struggled to explain her criticisms of a civil rights case lodged against members of the New Black Panther Party during her confirmation hearing Wednesday.

 

Clarke tried to duck questions about her opposition to prosecuting two Panthers for civil rights violations in the 2008 election while testifying before the Senate Judiciary Committee. Republican lawmakers say the Black Panther case is a troubling indicator of her approach to enforcing civil rights laws.

 

Clarke's history of opposing civil rights prosecutions of black defendants has made her nomination contentious. If confirmed, she will lead the Justice Department's Civil Rights Division and serve as top prosecutor for a range of nondiscrimination statutes.

 

Sen. Mike Lee (R., Utah) asked Clarke directly if the Justice Department was wrong to pursue a case against the Panthers. Clarke dodged, saying the department has the prerogative to bring any cases it deems appropriate. Lee doubled down, asking if she wanted prosecutors to abandon the case.

 

"I may have espoused that opinion publicly, but so did many people," Clarke replied. "I think there were many people who deemed that a weak case."

President Donald Trump and his supporters filed dozens of legal cases challenging the 2020 election results, submitting volumes of evidence and sworn testimony from eyewitnesses to fraud.

 

Legacy media personalities are very fond of saying all of those cases failed.

 

In fact, ABC's George Stephanopoulos earlier berated Sen. Rand Paul, R-Ky., with, "No election is perfect. But there were 86 challenges filed by President Trump and his allies in court, all were dismissed. Every state certified the results. Can't you just say the words, this election was not stolen?"

 

The senator pointed out at that time that the problems simply weren't addressed.

 

"There were lots of problems and there were secretaries of state, who illegally changed the law and that needs to be fixed, and I'm going to work harder to fix it and I will not be cowed by people saying 'Oh, you're a liar,'" Paul told the anchor.

 

"Let's talk about the specifics of it. In Wisconsin, tens of thousands of absentee votes had only the name on them and no address. Historically, those were thrown out. This time they weren't. They made special accommodations 'cause they said, 'Oh, it's a pandemic and people forgot what their address was.'"
