Former Chief Executive Officer of Publicly Traded Petrochemical Company Pleads Guilty to Foreign Bribery and Securities Law Violations

A Brazilian national who previously served as a chief executive officer (CEO) of Braskem S.A. (Braskem), a publicly traded Brazilian petrochemical company, pleaded guilty today to conspiring to divert hundreds of millions of dollars from Braskem into a secret slush fund and to pay bribes to government officials, political parties, and others in Brazil to obtain and retain business.

 

According to court documents, between approximately 2002 and 2014, Jose Carlos Grubisich, 64, a citizen of Brazil — who served as the CEO and a member of the board of directors of Braskem as well as in various capacities for Braskem’s parent company, Odebrecht S.A. (Odebrecht) — engaged in a scheme to bribe Brazilian government officials in violation of the Foreign Corrupt Practices Act (FCPA). As part of the scheme, Grubisich and his co-conspirators diverted approximately $250 million from Braskem into a secret slush fund, which Grubisich and others had generated through fraudulent contracts and offshore shell companies secretly controlled by Braskem.

 

Grubisich admitted that while CEO of Braskem, he agreed to pay bribes to Brazilian government officials to ensure Braskem’s retention of a contract for a significant petrochemical project from Petroleo Brasileiro S.A. (Petrobras), Brazil’s state-owned and state-controlled oil company. Grubisich also admitted that, as Braskem’s CEO, he falsified Braskem’s books and records by falsely recording the payments to Braskem’s offshore shell companies as payments for legitimate services. Grubisich also signed false Sarbanes-Oxley certifications submitted to the U.S. Securities and Exchange Commission (SEC) that, among other things, attested that Braskem’s annual reports fairly and accurately represented Braskem’s financial condition, and that Grubisich, as Braskem’s principal officer, had disclosed all fraudulent conduct by Braskem’s management and other employees with control over Braskem’s financial reporting.

 

“As CEO of a publicly traded company, Grubisich and other senior executives at Braskem engaged in a large-scale, sophisticated international bribery and fraud scheme and then lied to U.S. shareholders and authorities to conceal their criminal conduct,” said Acting Assistant Attorney General Nicholas L. McQuaid of the Justice Department’s Criminal Division. “Today’s guilty plea demonstrates the Department’s commitment to holding individuals accountable for corrupt and fraudulent conduct, including those at the highest corporate echelons.” “Grubisich abused his position of trust as CEO of Braskem to both facilitate and conceal the payment of millions of dollars in bribes so that Braskem could increase its profits and its senior executives — including Grubisich himself — could personally benefit,” said Acting U.S. Attorney Mark J. Lesko of the Eastern District of New York. “This office is committed to the prosecution of corrupt gatekeepers, including officers and directors of public companies, who, like Grubisich, use the United States’ financial system to commit crimes.”

 

Grubisich pleaded guilty to one count of conspiracy to violate the anti-bribery provisions of the FCPA and one count of conspiracy to violate the books and records provision of the FCPA and to fail to accurately certify Braskem’s financial reports. Grubisich has also agreed to pay approximately $2.2 million in forfeiture. He is scheduled to be sentenced on Aug. 5, and faces a maximum penalty of 10 years in prison.

 

In December 2016, Braskem and Odebrecht each pleaded guilty in the Eastern District of New York to separate one-count criminal informations charging them with conspiracy to violate the anti-bribery provisions of the FCPA. Braskem settled with the SEC in related proceedings on the same day.

 

The FBI’s International Corruption squad in New York is investigating the case. The Justice Department’s Office of International Affairs also provided substantial assistance. The department also expresses its appreciation for the assistance provided by the SEC’s Division of Enforcement, Ministério Público Federal and the Departamento de Polícia Federal in Brazil, the Office of the Attorney General in Switzerland, the Swiss Federal Office of Justice, and the governments of Portugal, Andorra, United Kingdom, and Panama.

FedEx shooting: Eight killed and many injured during incident at facility in Indianapolis

Eight people have been killed in a shooting after a former employee opened fire at a FedEx facility in Indianapolis.

At least four people are in hospital - one with critical gunshot injuries - while two others were treated at the scene and released following the incident late on Thursday. Several others walked into hospitals in nearby areas.

The gunman also took his own life and police said they believe there is no longer an active threat to the community.

 

Officers were called to reports of gunfire just after 11pm and arrived to an active shooting situation. Investigators are working to gather information on the suspect, who has not yet been identified, but was a former company employee, FedEx spokesperson Bonny Harrison said on Friday.

It is also unclear what the motive was behind the attack and whether the gunman worked at the facility. Footage from the scene shows police tape in the car park outside and multiple emergency service vehicles.

 

Family members have gathered at a local hotel to wait for word on their loved ones. A witness, who said he works at the facility, told WISH-TV that he saw a man with a gun after hearing several gunshots. "I saw a man with a submachine gun of some sort, an automatic rifle, and he was firing in the open," said Jeremiah Miller.

 

Another witness said his niece was sitting in her car when the gunfire began. "She got shot on her left arm," said Parminder Singh. "She's fine, she's in the hospital now." His neice had said she did not know the gunman.

 

Indianapolis Police officer Genae Cook said: "Today it is very heartbreaking and, you know, in the Annapolis Metro Police Department, the officers responded, they came in, they went in and they did their job. "A lot of them are trying to face this because this is a sight that no one should ever have to see."

The FedEx facility is close to Indianapolis International Airport. A spokesperson for the delivery service said the company was aware of the incident and was "working to gather more information".

US Congressman Andre Carson, a representative for Indiana, said he was "heartbroken" following the attack and was "praying for all affected by this tragedy". "I am communicating with local authorities to get all details of the attack and my office stands ready to help everyone affected in any way we can," he said.

It is the latest in a string of recent mass shootings in the US, including three this year in Indianapolis alone.

I’m giving serious consideration to acid-washing—I love when he uses phrases he doesn’t understand—him out of existence. He doesn’t stand a chance of ever touching me. We can do it. Thoughts?”

 

Clinton, as Trump’s rival at the time, must be held to a higher standard than the average disgruntled Trump hater. In addition, she had a back and forth with Podesta, and that equals conspiring. Still, there’s more.”

He asked the military police guarding the chamber doors if the military’s witness was ready to testify. The M.P.s left the room a moment and returned with none other than John Podesta, shackled at the wrists and donning a white prison jumpsuit. As reported previously, U.S. Special Forces operating on Trump’s authority had arrested Podesta and his wife, Mary, on Easter Sunday.

“Please tell this tribunal, and now you may qualify your answer, exactly what Clinton said,” Vice Adm. Hannink asked.

“Hillary and I got together in Chappaqua, it was three days after debate number 2, and she asked me to hire someone to kill Trump. In the end we never did it, too risky, but for days she kept nagging me incessantly to take care of it. She was ready to pay $5,000,000,” Podesta said.

Vice Adm. Hannink asked Podesta whom he had planned to hire.

“She has many ex-agency—CIA—friends. I had a list of four or five,” Podesta said. “I paid one 2.5, wired to an offshore account, and would’ve paid the remainder on completion of the contract.”

“On Hillary Clinton’s instructions,” Vice Adm. Hannink asked. “Yes.”

Hannink asked the name of the would-be assassin, and Podesta said he was promised he wouldn’t have to disclose the names of contract killers with whom he and Clinton had associated.

“Was it Hillary Clinton’s idea to call it off?” Vice Adm. Hannink asked.

“No, it was mine. In fact, I thought it so risky, I went behind her back to abort it. The guy kept the 2.5, per the arrangement,” Podesta replied.

“And you’re not fabricating testimony because you’ve been guaranteed a sentence less than capital punishment in exchange for your cooperation?” Vice Adm. Hannink said.

“What I’ve said today is the truth. Hillary Clinton is a murderous, narcissistic, vicious woman,” Podesta said, and was escorted from the tribunal chamber.
