Sadly my takeaway is that he isn't spending his days preparing for the cases he will oversee @ Gitmo.

That was one of the theories as to why he resigned early, and the one I found most appealing and latched onto to keep my hope alive. That he stepped down to focus on the arrests and the cases he built on all the DS actors @ gitmo trials..
