The Department of Justice (DOJ) Office of the Inspector General (OIG) initiated an investigation upon receipt of information from the Department of Homeland Security (DHS), Homeland Security Investigations (HSI), alleging that a then AUSA may have misused the AUSA’s government position. At the time of HSI’s referral to OIG, the AUSA had already retired.

 

The OIG investigation substantiated the allegation that the AUSA sent an email from the AUSA’s DOJ email account to a third party on behalf of the AUSA’s spouse in connection with a tax matter, and in doing so violated applicable federal ethics regulations regarding misuse of position and DOJ policy regarding the use of DOJ computers and computer systems. The AUSA’s email could have given the false impression that the AUSA was acting in an official capacity on behalf of the AUSA’s spouse.

 

When contacted by the OIG for a voluntary interview, the then former AUSA declined to be interviewed. The OIG does not have authority to compel or subpoena testimony from former Department employees or non-Department employees.

 

The OIG has completed its investigation and provided its report to EOUSA for its information and to the Department’s Office of Professional Responsibility for appropriate action.

Unless otherwise noted, the OIG applies the preponderance of the evidence standard in determining whether DOJ personnel have committed misconduct.
