Although they could go the regulatory route, the former White House chief of staff said Congress is more likely to pass legislation that would “break up” Big Tech monopolies. “When you look at Google and Facebook, they have more power over what we read and what we see than any in the media,” he said. “… Google and Facebook and YouTube actually control much of what America sees, whether it’s you and I talking right now and it gets reposted on any of those platforms, they have the ability to actually raise that profile or lower it. And so, it is time that we breakup Big Tech, not just regulate it.”

Investigation finds massive wrongdoing by prosecutor in case against ex-Missouri governor

 

St. Louis prosecutor Kimberly Gardner engaged in 62 acts of misconduct that resulted in 79 false representations during prosecution of Eric Greitens, memo alleges Missouri's chief legal disciplinary officer accused St. Louis' top prosecutor of sweeping misconduct in the failed prosecution of former Gov. Eric Greitens, saying she lied to judges in court filings and testimony, withheld exculpatory evidence from the defense, misled her own prosecution team and violated the constitutional right to a fair trial.

 

St. Louis Circuit Attorney Kimberly Gardner, one of the early local prosecutors bankrolled by liberal megadonor George Soros since 2016, engaged in 62 acts of misconduct that resulted in 79 false representations during Greitens' now-dismissed criminal prosecution, according to Chief Disciplinary Counsel Alan Pratzel's memo obtained Wednesday by Just the News. "Probable cause exists to believe that the respondent is guilty of professional misconduct," Pratzel declared in a 73-page memo that repeatedly accused Gardner of withholding evidence of innocence and providing a false portrait to the courts, the defense and even her own prosecution team. Pratzel also accused Gardner of lying during the disciplinary proceedings, long after the case was dismissed against Greitens, a former Navy SEAL and rising Republican star who was forced to resign as governor in 2018 less than two years after he was sworn in. The disciplinary action against Gardner follows the 2019 indictment of her former chief investigator in the case, ex-FBI agent William Tisaby, on seven felonies alleging he committed perjury and evidence tampering during the Greitens probe. Gardner also remains under criminal investigation by a special prosecutor as Tisaby awaits a trial that has been delayed by the COVID-19 pandemic.

 

The unraveling of the criminal case was highlighted in a Just the News investigative report last year, prompting some to compare Gardner's actions to the FBI's now-confirmed misconduct during the pursuit of then-President Donald Trump during the Russia collusion probe. Pratzel concluded that Gardner had violated her responsibilities as a lawyer and a prosecutor, essentially suborning Tisaby's perjury by "failing to take reasonable remedial measures when she knew Tisaby was giving false answers to questions." "She offered and elicited false testimony when questioning Tisaby" during a deposition ordered by the court and also provided inaccurate information to a fellow prosecutor during a private session in the judge's chambers that later led that prosecutor to make false statements to court, the memo alleged.

 

Gardner, St. Louis' first black chief prosecutor, filed an initial response to the allegations, suggesting race and politics were involved in the disciplinary action but acknowledging she made mistakes in the Greitens prosecution. "In hindsight, were each and every one of Ms. Gardner's actions in the intense, fast-paced Greitens investigation and prosecution perfect? No, but that is not the measure or purpose of the attorney discipline," her legal team wrote. She claimed that she has been the "target" of attacks for her "tireless and courageous efforts to reform the criminal justice system" and was being treated differently compared to other lawyers. "Attacks on Ms. Gardner have taken many forms, ranging from overtly racists emails sent to her office to investigations and lawsuits against her," her reply alleged. She also showed her continued disdain for Greitens, calling him a Republican "golden boy." Gardner has been the object of frequent controversy and criticism, including as the focus of an ongoing special prosecutor's criminal investigation in the Greitens case, and was recently removed by a court in the prosecution of a St. Louis couple accused of brandishing weapons during last year's Black Lives Matter protests.

Memos hint Zuckerberg to continue big spending on Georgia election workers, infrastructure

 

Facebook founder Mark Zuckerberg's multimillion dollar investment in the 2020 presidential election process may extend into this year or beyond, at least if Fulton County is any measure. Georgia's largest county, which encompasses the blue-leaning city of Atlanta, received more than $6.3 million in private grants from the Zuckerberg-funded Center for Tech and Civic Life (CTCL) to conduct elections during the 2020 pandemic, but recently reported it did not use all the money last year. Now it would like to spend $858,667 in leftover proceeds in the future, according to county election officials' memos obtained by Just the News under the state's Freedom of Information Act.

 

CTCL, which got hundreds of millions from Zuckerberg and his wife to spend during the 2020 election, also hinted of bigger plans for the future in its after-action questionnaire for Fulton County. "If your annual budget for elections permanently doubled, what would you be able to accomplish that you can't accomplish now?" the questionnaire asked. Conservatives have raised serious concerns about CTCL grants, saying they appeared to be heavily focused on Democratic election strongholds in 2020 and amounted to an unprecedented back door for private money to influence neutral election judges and administrators. The group counters it was simply helping election coordinators get through an unprecedented pandemic. In its application to extend leftover funding to June 30, 2021, Fulton County said it would use the money on "temporary staffing support," "vote by mail/absentee voting equipment and supplies" and "election administration equipment," the memos show.

 

The memos also provide an extraordinary window into the differences between what Georgia's largest county said it would spend CTCL money on and what it actually spent the grants on. For instance, Fulton County said in its application and plan for the grant money that it would spend $209,713 for voter education on mail-in ballots, but it reported in its extension request as having spent no money in that category. A separate report claimed the county spent $58,593 on voter education. Similarly, the memos show the county requested $6,309,436 from the Zuckerberg-funded organization for 2020 and spent $5,478,297 by the end of the year, leaving $889,732.37 unspent. But the grant extension request used different numbers, reporting $5,450,769 was spent by Dec. 31, 2021, and $858,667 was left over.
