Don’t call yourself a supporter of the First Amendment while attempting to punish a media outlet for criticizing you.

 

The office of Baltimore's top prosecutor, State's Attorney Marilyn Mosby, is trying to convince the Federal Communications Commission (FCC) to investigate the city's Fox affiliate because of its critiques of her.

 

This is not, of course, how Zy Richardson, Mosby's communications director, frames the issue in the May 5 letter she has sent to FCC Chairwoman Jessica Rosenworcel. Richardson attempts an argument that Fox affiliate WBFF's coverage of Mosby is "misleading, racist, and extremely dangerous."

 

What the letter is actually complaining about, though, is constitutionally protected speech. Part of the letter's "evidence" is that WBFF simply runs far more stories about Mosby than the other Baltimore networks. Richardson incorrectly argues that the "tone" of Fox's coverage violates FCC rules. She writes that Fox News is "infamous for its bias against people of color," shifting abruptly to a complaint about Tucker Carlson's commentary, which has nothing to do with whether WBFF's coverage of Mosby is some sort of regulatory violation.

 

One of many problems with this claim is that there's actually no sign of these alleged racist dog whistles in the six pieces she linked to. The pieces all involve analyses of the decisions being made by her office, like fewer prosecutions of low-level crimes and drug crimes, travel funded by outside organizations, and oversight of her office. All of this is completely fair game for network coverage, and several of them even include responses by her office.

According to Chronicle, the city school district and teachers' union agreed to a deal that would bring the class of 2021 to school "for at least one day before the end of the school year" so that "the city's public schools can qualify for $12 million in state reopening funds."

 

To obtain the reopening funds, California law required school districts to reopen in-person instruction for elementary students and at least one entire middle or high school grade. The deadline to qualify for the funds is May 15, one day after the SFUSD and San Francisco teachers' union suddenly agreed on an in-person return for seniors.

 

As part of the deal, seniors will be allowed to attend in-person at "one of two school sites," and instead of instruction from their teachers, they will receive "in-person supervision."

A lawsuit intended to stall forest management projects on the Sierra, Sequoia and Stanislaus National Forests will only contribute to more catastrophic wildfires, insect infestation and disease on public lands. If the goal of this litigation is truly to “protect” the Pacific fisher, an otter-like animal, delaying these projects for years could have unintended consequences for this species, its habitat and those of us who live near these national forests.

 

All three national forests suffer from overstocked conditions that are contributing to high tree mortality. As we witnessed during the Creek Fire, dead and dying trees serve as fuel for unnaturally severe wildfires that result in significant losses of fisher habitat. Wildfires are also converting forests into non-forests. On the Sierra National Forest, it is estimated over 583,000 acres are now brush fields and are in need of reforestation.

 

Sadly, these litigious organizations are environmental denialists. They refuse to consider the empirical evidence their policies regarding forest management have had. Rather than reduce carbon emissions, mega-fires have set California and other Western states behind in their carbon reduction efforts and the protection of its ecosystems.
