Dr. Lyle Rapacki interviews Arizona Senator Sonny Borrelli and Col. Phil Waldron about the Arizona forensic audit. They discuss the latest refusal of the Maricopa County Board of Supervisors to turn over the routers, and other obstacles.

 

Responding to the numerous requests for County Supervisor arrests, Borrelli explains that the Senate does not “have the authority to put anyone in jail… We don’t have prosecutorial authority. That would go through the AG.”

 

Waldron completely debunks the “audit” performed by Maricopa County. The 2 “auditors” chosen by the County were from FEC approved laboratories — labs not audit firms. Even an FEC official admitted that the firms are “not approved auditors” and “it would be doubtful if they could detect any fraud in the systems.” Waldron further points out that if the admin passwords were not available, Pro V&V and SLI could not have verified the software on the machines as specified in their scope of work. “One way or another, the Board of Supervisors are lying — they’re either lying about the passwords or lying about the specificity of the [fake] “audits” they conducted,” Waldron says.

 

According to Waldron, there are 8 other states (in addition to Arizona) currently conducting audits.

Yes, they should be in jail. But how to accomplish that is the more difficult question. Nick Moseder (who we love) comes down pretty hard on the AZ Senate for not enforcing their subpoena against the Maricopa Supervisors. Here are some nuances to consider:

 

First, as far as we understand it, the new subpoenas would compel sworn testimony (https://t.me/ArizonaConservatives/1654) from the Supervisors and/ or request the admin passwords from Dominion (https://t.me/ArizonaConservatives/1699), which is different from issuing a second subpoena for items already requested. Having the Supervisors testify under oath is actually an interesting strategy.

 

Second, as Senator Borrelli (https://t.me/ArizonaConservatives/1703) explains, the Senate does not have the authority to put people in jail. If a person is held in legislative contempt, they can be brought before the state Legislature and charged with a class 2 misdemeanor. The problem is that tie-breaking RINO Senator Paul Boyer voted against holding the Supervisors in contempt.

 

Who else could potentially enforce the subpoena? Soros-backed Sheriff Penzone (https://t.me/ArizonaConservatives/1660) who wrote a letter (https://t.me/ArizonaConservatives/1656) stating that personal information from his office was held on the County routers? Unlikely. AG Brnovich who has been a reluctant supporter of the audit and is friendly with Soros-backed audit obstructionist Katie Hobbs (https://t.me/ArizonaConservatives/1430)? Unlikely.

 

Yes, the Senate subpoenas need to be enforced. But rather than throw around the the easy-to-say “Arrest them!” criticisms — let’s think through how to make this happen.

Federal Judge Dismisses Twitter’s Attempt to Prevent Investigation by Texas Attorney General

 

A federal judge dismissed a lawsuit by Twitter against Texas Attorney General Ken Paxton that was designed to keep him from investigating the company.

 

Judge Maxine Chesney on Tuesday sided with Paxton, calling Twitter’s lawsuit “premature.” Chesney added that Twitter’s First Amendment claims of protection against investigation were “unpersuasive,” especially since Paxton had not in any way penalized the company.

 

Paxton also added the following in a statement:

 

Twitter’s lawsuit was little more than an attempt to avoid answering my questions about their large-scale censorship and content-moderation policies,” said Attorney General Paxton. “The public deserves the truth about Twitter’s seemingly biased practices. I will continue to fight for transparency in order to ensure a truly free online community. Any companies that violate Texas law by misleading consumers will be held accountable.

 

In an earlier release, he explained his rationale for the investigation.

 

First Amendment rights and transparency must be maintained for a free online community to operate and thrive. However, the seemingly coordinated de-platforming of the President of the United States and several leading voices not only chills free speech, it wholly silences those whose speech and political beliefs do not align with leaders of Big Tech companies. Every American should be concerned about this large-scale silencing and the effects it will have on the future of free speech,” said Attorney General Paxton. “The public deserves the truth about how these companies moderate and possibly eliminate speech they disagree with. I am hopeful that these companies will set aside partisan politics and cooperate with these CIDs in order to get to the bottom of this contention and ensure a truly free online community consistent with the highest American ideals.

 

The best way to deal with these social monopolies that have far too much control over speech in America is to break them up. No one cares if Parler bans Joe Biden or the New York Times comments section bans Donald Trump because they’re not monopolies. Break up monopolies like Google, Facebook, and Twitter, and guess what? They cease to become a threat to free speech. Failing that, Republican attorney generals need to follow Ken Paxton’s lead and go after these monopolies that are censoring their constituents. The greater the concentration of power, the bigger threat there is to your freedom, and contrary to what some people may believe, that threat is not solely limited to the government.
