approach from two angles:

 

domestic intelligence is "allowed" to monitor and sift through data stored within our borders.

 

if black-hats managed to push the data abroad, covertly, then domestic intelligence may be de-facto breaking the rules unknowingly by sifting through domestic data which has crossed the border.

 

two, black-hats may be pushing data abroad simply to make it easier to avoid internal-affairs snooping.

 

it seems to me that the implication is that some who have maintained security clearance have used it before and after they left office to set up a network of illegal data collection.

right now, with the internet as a database, if i know two specific things about you, or three general things, i can tell you who you are, where you live, and who your family is.

 

that's just imperfect human intuition mining.

 

tech companies have been organizing and perfecting for long enough that it must be a given that a) a database exists with all of your relevant information and b) the technology to see patterns and find info about you has already been developed.

 

effectively, it can be mined, it's already being mined, and your statement is probably fifteen years too late to even be late.
