This isn't how i read it. I read it as "if [they] get convicted, and the jury doesn't unanimously vote for death, they get a new trial or a lesser sentence. " they're trying to escape the grim reaper.

I think they're trying to make it impossible to receive the death penalty. Any jury with 1 liberal on it keeps them off death row. They're guilty and now they're trying to tip the scales of justice to save their own skin.
