Vatican to criminalise sexual abuse of adults by priests

The Catholic Church is changing its laws to explicitly criminalise sexual abuse of adults by priests, and to include laypeople who hold church office in sanctions for similar crimes.

Aiming to address the church’s handling of sexual abuse, the law will recognise adults can also be victimised by priests who abuse their position of authority.

Non-clergy employees, such as school principals and parish economists, will also be liable for punishment for abusing adults or children.

Announced by the Vatican on Tuesday, the changes come after 14 years of study, with new provisions in the criminal law section of the Vatican’s Code of Canon Law, the in-house legal system of the Catholic Church.

Pope Francis approved the changes to the law, which will also criminalise the grooming of minors or vulnerable adults by priests to compel them to engage in pornography.

It’s the first time church law has officially recognised as criminal the method used by sexual predators to build relationships with their victims to then sexually exploit them.

The law also removes much of the discretion that had long allowed bishops and religious superiors to ignore or cover up abuse, making clear they can be held responsible for omissions and negligence in failing to properly investigate and sanction errant priests.

But while a bishop could be removed from office for “culpable negligence” or failing to report sex crimes to church authorities, there is no punishment in the law if he fails to report the crime to the police.

Recently Pope Francis passed new laws punishing bishops and senior members of the church who failed to protect their followers, and the new criminal code incorporates those changes.

According to the new law, priests who engage in sexual acts with anyone — not just a minor or someone who lacks the use of reason — can be defrocked if they used “force, threats or abuse of his authority” to engage in sexual acts.

Ever since the 1983 Code was first issued, lawyers and bishops have complained it was completely inadequate to deal with the sexual abuse of minors, since it required time-consuming trials.

Victims and their advocates, meanwhile, argued it left too much discretion in the hands of bishops who had an interest in covering up for their priests.

The Vatican has been making small changes over the years to address the problems and loopholes.

The changes come following the #MeToo movement, in which the Church had its own reckoning - this time with abuse of adults by people in positions of responsibility.

The Vatican has long considered sexual relations between a priest and an adult as sinful but consensual.

But it appears to have had a rethink following the scandal over the ex-Cardinal Theodore McCarrick, the former archbishop of Washington.

Even though the Vatican knew for years he slept with his seminarians, McCarrick was only put on trial after someone came forward saying he had abused him as a youth.

Pope Francis eventually defrocked him in 2019.

"The project we are sharing with the World Health Organisation in Libya responds to one of the main objectives of our hospital, which is the sharing of knowledge achieved in the fields of clinical and research. The use of the Medtraining platform and distance learning technology helps us to pursue this goal more effectively and quickly". This statement by Mariella Enoc, President of the Vatican's Bambino Gesù Children's Hospital, shines light on the significance of the initiative that was launched at the beginning of last year with the aim of promoting and supporting professional updating of health personnel in Libya, especially in the paediatric field.

Present for the public launch of the Medtraining project were Mariella Enoc, the WHO representative in Libya Elizabeth Hoff, Italy's vice-Minister of Foreign Affairs Marina Sereni, and one of the founders of the Bambino Gesù Hospital, Maria Grazia Salviati.

The Medtraining channel

Originally, the agreement called for doctors and nurses from two paediatric hospitals in Tripoli and Benghazi to come to the Bambino Gesù for a period of between three and six months. However, the outbreak of the pandemic in March 2020 made it impossible to start the project. That led to the idea of setting up a multilingual platform: the Medtraining distance medical education channel for developing countries, and then expanding it.

The first course involving 156 nurses from eight hospitals in the North African country started a few weeks ago. In addition to Tripoli Children's Hospital and Benghazi Children's Hospital, the Sabha Medical Center (the main hospital in the southern part of Libya), the hospitals of Sirte and Misurata in the Tripolitania region and the Cyrenaica hospital centres of Derna, Al Bayda and Tobrouk, all in the north of the country, are taking part in the "distance" learning.

Five languages for five specialisations

The Medtraining platform offers different training modalities and interfaces in five languages: Italian, English, Arabic, French and Spanish. The courses uploaded on the platform, once translated into the different languages, can be easily replicated and offered to countries with the same training needs.

Intensive care, neonatology, haematology, cardiology and cardiac surgery are the specialities first identified for further training. These are now joined by onco-haematology, palliative medicine and psychosocial support. As soon as the health situation allows, training will also be provided in the presence of some of the health workers involved in the project at the Bambino Gesù in Rome.

WHO honoured to partner the Vatican Hospital

In an interview with Vatican Radio, Elizabeth Hoff, said "it is a a great honour for the WHO to continue the partnerships established 5 years ago with the Vatican and the Bambino Gesù in Syria." She added that the project is now being extended to include Libya and is receiving an enthousiastic response from the nurses working in different Libyan hospitals.

"Already 130 have started and we are expecting many more to enroll," she said.

Reaching those who are most vulnerable

Hoff noted that the Holy See and the UN have many values in common, including neutrality and impartiality "and making sure that we reached the most vulnerable." This, she said, "is what we are trying to do."

And amongst the most vulnerable are the many migrants and refugees currently hosted in Libya living in very difficult circumstances. "Pope Francis," Hoff said, "has given us all an example that we have to live up to, always bearing in mind the humanity and the love for our neighbour and those who need it the most. So this is what we are striving toward: to make sure that we really meet the needs of those who need it the most."

The WHO representative expressed her hope that soon it will be possible to "have the face-to-face discussions with Libyan doctors and nurses and to have the experts coming from here [the Vatican] to work hand-in-hand in a different way, like we did before," the pandemic. She is confident, she added, that the Libyans will take over when their capacity has been built.

Expanding the project

Currently, Hoff concluded, the partnership is working in Syria and Libya, but she said she has hopes it will one day be extended to Afghanistan and to Yemen, two countries in which the population is so vulnerable, and "we also bear in mind this wonderful visit of Pope Francis to Iraq to see what we can do for the groups there who are in need of support."

"This interview with Professor Milton P. Siegel, who for 24 years was the Assistant Director General of the World Health Organization, was recorded in 1992 by Dr. Stephen D. Mumford,

President of the Center for Research on Population and Security. This is the first time that it has been made available to the public.

Because of his position and the length of his tenure, Professor Siegel is considered among the world's foremost authorities on the development of World Health Organization policy.

In this interview, he reveals the influence of the Vatican in shaping WHO policy, particularly in blocking adoption of the concept that overpopulation is a grave public-health threat –

a concept which, in WHO's early years, enjoyed a broad consensus among member countries.

Without this separation of population dynamics from WHO public-health policy, the Vatican would have found it much more difficult to subsequently manipulate governments

on such issues as family planning and abortion. National leaders would have been able to refer to the international consensus, as demonstrated by WHO policy. WHO, they could have insisted,

has determined that family planning and abortion – like clean water, good nutrition, and immunizations – are necessary to protect public health.

Professor Siegel decided to speak out on the subject.

As he was involved in the WHO at an early stage, his personal experience provides ample evidence that the Vatican influenced WHO policy development from the outset,

during the early period of the Interim Commission in 1946. In its 63-year history, this international health body has had a deplorable record in family planning.

Its commitment has been minuscule, and even today family planning accounts for only a tiny fraction of its budget.

Professor Siegel joined the World Health Organization in 1946, when it was still in its formative stages – under the umbrella of the United Nations, created just the year before.

Because of his earlier work in North America and the Middle East, he was asked, in effect, to be one of WHO's "founding fathers". So he came on board on the senior staff of the Interim Commission.

Dr. Brock Chisholm of Canada was the Executive Director of the Commission, which set up the permanent organization with headquarters in Geneva, Switzerland.

Dr. Chisholm was chosen to be WHO's first Director General."

Archbishop of Vancouver expresses deep sadness over residential discovery

Archbishop J. Michael Miller of Vancouver expresses his “deep sadness” following the discovery of the bodies of 215 children buried at the site of a former residential school in Kamloops, Canada.

In a statement, Arcbishop Miller said, “I am filled with deep sadness at the troubling news about the 215 children found buried at the Kamloops Indian Residential School.”

“The pain that such news causes reminds us of our ongoing need to bring light to every tragic situation that occurred in residential schools run by the Church.

The passage of time does not erase the suffering that touches the Indigenous communities affected, and we pledge to do whatever we can to heal that suffering.”

Kamloops Bishop Joseph Nguyen also expressed his sadness, saying “I humbly join so many who are heartbroken and horrified” by the news.

“On behalf of the Roman Catholic Diocese of Kamloops, I express my deepest sympathy to Chief Rosanne Casimir of the Tk'emlúps te Secwépemc Nation and to all who are mourning this tragedy and an unspeakable loss. No words of sorrow could adequately describe this horrific discovery.”

The remains of 215 children, some as young as 3 years old, were found buried on the site of what was once Canada's largest Indigenous residential school.

Chief Rosanne Casimir of the Tk’emlups te Secwépemc First Nation said that the remains were confirmed last weekend with the help of ground-penetrating radar. She also said the deaths were undocumented.

The Kamloops Indian Residential School was founded in 1890 and administered by religious authorities and the government.

The Catholic administered school had as many as 500 students in the 1950s. It closed in 1978.

Canadian Prime Minister Justin Trudeau said the discovery was a "painful reminder" of a "shameful chapter of our country's history".
