Even though congress and judiciary chose to allow Bidan to assume the chief executive position does not mean military had to accept Bidan as CiC if they have proof he was not legally elected, and they do.
Ratclliffe's report on foreign interference in the elections got to the military on Jan 19 instead of the end of December. Trump left the chief executive role on Jan. 20.

At about 30 minutes in, Dave goes back to the arrest question and Savin alludes to Trump as, essentially, a 2nd president, thus protected, and that his rallies will be great.
