Judge Travis Kitchens sentenced man to 3 years for punching another inmate (but he'll only serve another 104 days) but gives him NO TIME for raping a 14 yr old girl.

 

Judge Hands Down Light Sentence for Child Rapist

 

On June 3, 2021, Eli Donavan Salina Binnion, age 22, was sentenced by the Honorable Travis E. Kitchens, Jr., 'presiding judge of the 258th Judicial District Court in Polk County, on the charges of Sexual Assault of a Child which occurred July 1, 2018 and Aggravated Assault Causing Serious Bodily Injury which occurred on September 2, 2018. Binnion had previously pled guilty to both charges.

 

As to the charge of Sexual Assault of a Child, according to the probable cause affidavit prepared by the Livingston Police Department, on July 2, 2018, that agency investigated an incident that occurred at the Hampton Inn Hotel, located at 225 Commerce Lane in Livingston. An officer met with and spoke to the father of the 14 year old victim and learned that his daughter knew her perpetrator and identified him as Eli Binnion. The child was in room 115 at the hotel and was picking things up for her father which had been left behind in the room. According to the victim, Binnion entered the room behind her, grabbed her by the arm and threw her on the bed and forcefully held her down. Binnion then pulled down his pants and got on top of her while she was continuously trying to get him to stop and trying to kick him. She stated that Binnion pulled down her shorts, pulled her panties to the side and forced his male organ into her female organ, while forcing his arm across her chest. The child received a medical examination, a forensic interview was conducted, and evidence collected.

 

On the charge of Sexual Assault of a Child, a second degree felony, for which the range of punishment is 2 to 20 years, Judge Kitchens made no finding of “guilt” and placed Binnion on deferred adjudication probation for 10 years with multiple conditions including serving an additional 180 days in the Polk County Jail and registering as a sex offender. The State, through Assistant District Attorney Rachel Ellsworth, stated their opposition to the decision of the court to place the Defendant on deferred adjudication probation.

 

As to the charge of Aggravated Assault Causing Serious Bodily Injury, a second degree felony for which the range of punishment is 2 to 20 years, Kitchens assessed punishment at 3 years confinement in the Institutional Division of the Texas Department of Criminal Justice. Having previously served 991 days in the Polk County Jail pending disposition of the case, Binnion will complete this sentence in approximately 104 days.

 

The Aggravated Assault charge against Binnion arose from an incident which occurred while Binnion was incarcerated in the Polk County Jail. According to the probable cause affidavit filed by Polk County Sheriff’s investigators, on September 2, 2018, deputies spoke with Anthony William Slaton, who advised that Eli Donavon Binnion punched him more than once with a clinched fist.
