Boris Epshteyn said that no one can state for certain that it would be unconstitutional for former President Donald Trump to be reinstated to the presidency since the U.S. Constitution does not prohibit reinstatement and the issue has never been ruled upon.

During an interview with Dr. Gina Loudon on Real America's Voice, Epshteyn, a former Trump 2020 strategic advisor, predicted that the matter will land in the nation's high court.

Epshteyn said that "the interplay of the 10th Amendment" to the U.S. Constitution, the 12th Amendment and Article II, "would suggest that states do have a right to decertify. And from then, it's an open question what happens next."

He said that after information becomes available from state audits, "decertification should happen because that's the correct step from the states. And from then on in terms of deciding what to do about the federal election, well, there's gonna be an open question," he noted, remarking that he believes that the matter will go before the Supreme Court.

Just today, in another big victory for Trump and Barr, a federal judge ruled that the plaintiffs (ACLU, BLM, etc) in various lawsuits against Trump, Barr, and other former administration officials over the incident could not provide sufficient evidence that there was a conspiracy to deny protesters their First Amendment rights. The judge also ruled that Trump and Barr “are entitled to qualified immunity as the plaintiffs have not plausibly alleged a violation of law”:

A U.S. judge on Monday dismissed most claims filed by the American Civil Liberties Union of D.C., Black Lives Matter and others who in lawsuits accused the Trump administration of authorizing an unprovoked attack on demonstrators in Lafayette Square last year.

The plaintiffs asserted the government used unnecessary force to enable a photo op of Trump holding a Bible outside of the historical St. John’s Church. But U.S. District Judge Dabney L. Friedrich of Washington called allegations that federals officials conspired to make way for the photo too speculative.

The judge’s decision came in a 51-page opinion after the Justice Department requested she toss four overlapping lawsuits naming dozens of federal individual and agency defendants, as well as D.C. and Arlington police, in the June 2020 incident.

Nxivm sex-cult “slave master” Allison Mack helped federal prosecutors bolster their case against Keith Raniere by providing them with an audio recording of the leader talking about branding the group’s members, a new report said.

Mack’s cooperation was revealed in a sentencing memo filed by prosecutors on Monday where they ask Brooklyn federal judge Nicholas Garaufis to give the 38-year-old former “Smallville’’ TV actress a reduced sentence in return for her speaking up, according to Variety.com.

“Although Mack could have provided even more substantial assistance had she made the decision to cooperate earlier, Mack provided significant, detailed and highly corroborated information which assisted the government in its prosecution,” prosecutors said in the memo obtained by the outlet.

Mack is set to be sentenced June 30 after pleading guilty in April 2019 to racketeering and racketeering conspiracy charges that included extortion and forced labor.

She confessed to being part of Nxivm’s secret DOS slave-master group in which some members were branded like cattle with Raniere’s initials and blackmailed into having sex with him and others.

In the audio Mack handed over to prosecutors, she and Raniere could be heard talking about the branding ritual, the report said.

“Do you think the person who’s being branded should be completely nude and sort of held to the table like a, sort of almost like a sacrifice?” Raniere says in the recording.

“And the person should ask to be branded,” he adds. “Should say, please brand me it would be an honor, or something like that. An honor I want to wear for the rest of my life, I don’t know… And they should probably say that before they’re held down, so it doesn’t seem like they are being coerced.”

Raniere was sentenced in October to 120 years in prison.
