Six People Arrested and Indicted in Alleged Illicit Massage Parlor Operation

 

RALEIGH, N.C. – Six women from Flushing, New York, and Little River, South Carolina, were arrested on June 16 and 17, 2021, on charges involving conspiracy, bribery, and operating illegal massage parlors offering prostitution and indicted on June 22, 2021.

 

According to court documents, Ok Hwa Lee, Shanyu Song, OgBun Park, XueJin Bai and Ming Ji Cao allegedly conspired to pay bribes to a law enforcement officer (who was actually an undercover agent posing as a corrupt law enforcement officer) to provide protection for the operation of illegal massage parlors in Cary and Wilmington, where sexual services were offered. An indictment charges them with conspiracy, bribery, and operating an illegal prostitution enterprise in interstate commerce.

 

Xiang Yue Jin, charged separately, allegedly also bribed an undercover agent, believing that he would protect her illegal massage parlors (where sexual services were offered) from law enforcement scrutiny. An indictment charges her with bribery and operating an illegal prostitution enterprise in interstate commerce.

 

G. Norman Acker, III, Acting U.S. Attorney for the Eastern District of North Carolina made the announcement. The Department of Homeland Security – Homeland Security Investigations is investigating the case with assistance from the Federal Bureau of Investigation, the Wake County Sheriff’s Office, the Durham County Sheriff’s Office, the Cary Police Department, the New Hanover County Sheriff’s Office, the Wilmington Police Department, the Horry County Police Department, the United States Marshals Service, and other state and local investigators. Assistant U.S. Attorneys Erin C. Blondel and Bryan Stephany are prosecuting the case.

Middlesboro Man Convicted of Child Pornography Charges

LONDON, Ky. – A Middlesboro firefighter was convicted late Monday, by a federal jury sitting in London, of receiving and possessing child pornography, on a Middlesboro Fire Department laptop.

 

The jury convicted Robert Christopher England, 35, after 30 minutes of deliberations, following a five-day trial.

 

According to the evidence at trial, England received child pornography on three separate occasions and possessed a collection of over 600 images, between April of 2017 and June 23, 2018. England’s fire department laptop was seized, on June 23, 2018, by the Middlesboro Police Department. At the time, England was serving as a Lieutenant within the Middlesboro Fire Department. A forensic review conducted by the Kentucky State Police Electronic Crimes Branch showed evidence of dark web access via Tor Browser and child pornography “playlists” created in ManyCam, a web conferencing program.

 

England was indicted in October of 2018.

 

Robert M. Duncan, Jr., United States Attorney for the Eastern District of Kentucky, James R. Brown, Special Agent in Charge, Federal Bureau of Investigation (FBI) Louisville Division; and Acting Commissioner Col. Phillip Burnette, Jr., Kentucky State Police, jointly announced the jury’s verdict.

 

The investigation was conducted by the FBI and the Kentucky State Police Electronic Crimes Branch. The United States was represented in the case by Assistant U.S. Attorney Jenna E. Reed.

 

England will appear for sentencing, before U.S. District Judge Claria Horn Boom, on March 16, 2021. He faces a maximum of 20 years in prison for each count. However, the Court must consider the U.S. Sentencing Guidelines and the applicable federal sentencing statutes before imposing the sentence.

 

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse, launched in May 2006 by the Department of Justice. Led by U.S. Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet as well as to identify and rescue victims. Construction Company Owners Pleaded Guilty to Defrauding Federal Program Intended for Service-Disabled Veteran-Owned Small Businesses

Two Texas construction company owners have pleaded guilty in a long-running scheme to defraud the United States.

 

Michael Wibracht of San Antonio, Texas, the former owner of several companies in the construction industry, conspired to defraud the United States in order to obtain valuable government contracts under programs administered by the U.S. Small Business Administration (SBA) for which neither his nor his co-conspirators’ companies were eligible. One co-conspirator, Ruben Villarreal, also of San Antonio, pleaded guilty on Nov. 20, 2020, to participating in the same conspiracy.

 

“For many years, this conspiracy undermined the integrity of the federal procurement process,” said Acting Assistant Attorney General Richard A. Powers of the Department of Justice Antitrust Division. “This conduct robbed opportunities from honest businesses, especially those owned by historically disadvantaged individuals and service-disabled veterans.”

 

According to court documents filed in the Western District of Texas in San Antonio, Wibracht, Villarreal, and other co-conspirators conspired to defraud the United States by interfering with the function of the SBA and fraudulently obtaining money from agencies of the United States as early as 2004 continuing at least through 2017. As part of this scheme, the conspirators installed Villarreal, a service-disabled veteran, as the ostensible owner of a general construction company held out as a Service-Disabled Veteran-Owned Small Business (SDVOSB). Wibracht and other co-conspirators, however, exercised disqualifying financial and operational control over the construction company. The conspirators concealed that control in order to secure over $250 million in government contracts that were “set aside” for SDVOSBs in order to benefit their larger, non-qualifying businesses. The SBA administers the SDVOSB program, which is designed to increase the number of government contracts awarded to small businesses owned and controlled by service-disabled veterans. To qualify as an SDVOSB, a company, among other things, must be owned and controlled by a service-disabled veteran.

 

“These plea agreements showcase the unique expertise of the U.S. Army CID’s specialized unit, the Major Procurement Fraud Unit,” said Special Agent in Charge Ray A. Rayos of the Southwest Fraud Field Office of the U.S. Army Criminal Investigation Command’s Major Procurement Fraud Unit. “Together, with our partner agencies and the Department of Justice Antitrust Division, those individuals responsible for engaging in a complex and long running scheme to defraud the United States government have been brought to justice.”

 

Wibracht pleaded guilty to one count of conspiring to commit wire fraud and defraud the United States. Villarreal pleaded guilty to conspiracy to defraud the United States and is scheduled to be sentenced before Judge Xavier Rodriguez on June 23, 2021. Both men face a maximum penalty of five years in prison and a $250,000 fine. The maximum fine for an individual may be increased to twice the gain derived from the crime, or twice the loss suffered by victims of the crime, if either of those amounts is greater than the statutory maximum fine. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

 

The SBA Office of Inspector General, Army Criminal Investigation Command’s Major Procurement Fraud Unit, General Services Administration Office of Inspector General, Department of Veterans Affairs Office of Inspector General, and DCIS are investigating the case, with assistance from the U.S. Attorney’s Office for the Western District of Texas and the Army Audit Agency.
