There may be two militaries.
The military that the public is aware of, as large as it is, is rife for infiltration in the rank and file and corruption in the officer ranks that prey on sociopaths whose only objective is to rise in the ranks.
If there is such a scenario, that military can't defend a domestic, existential threat to CONUS. This military is primarily used to wreak havoc WW.
Now, however, the enemy is already inside the gate and may be wielding a doomsday weapon used as a threat.
In the present situation, we may have a government controlled by belligerents who seized power via a fraudulent election and are now wielding power under the threat of releasing a destructive weapon, bio, for example. This would mean that the command structure of the military that we are aware of is complicit to the degree that they chose to collaborate with the belligerents, while those patriot members are faced with the certainty of devasting civilian collateral damage if they choose to mutiny.
The other military, unknown to the masses, is smaller and more selective manpower wise, and thus easier to maintain patriotic integrity. This military holds the most powerful weapons and is the final fail safe.
The current battle, then, hidden to us, is the one that deals with neutralizing the doomsday threat that the belligerents are using to keep their occupying government in place. The stakes are massive civilian casualties, so only a select few will know the actual order of battle in the real war.
My thoughts here would explain the lack of judicial intervention in the current setting. The solution is a sudden, lethal blow by the hidden military and the aftermath will be sudden, wide-ranging upheavals in domestic government structure.
