'Stay in your lane': Former DA warns against prosecutors choosing which laws to enforce

Progressive" prosecutors who choose which laws to enforce are responsible for the crime that results from a lack of prosecution, said Tom Hogan, the former district attorney for Chester County, Pa.

"[E]ven 10 years ago, if you got 100 prosecutors together in a room, no matter what their party affiliation was, they would generally agree on how to stop violent crime," Hogan told the John Solomon Reports podcast. "And they would generally agree if you presented them with a hypothetical about a case about the appropriate way to handle it."

"You don't see that anymore," Hogan said. "You're seeing prosecutors breaking in all sorts of different directions, doing all sorts of crazy things. And that really started with the progressive prosecutor movement, which has been funded from a certain angle, and you are getting to see the results of it right now in the big cities."

Progressive billionaire George Soros has been involved in the financial backing of progressive district attorneys like St. Louis Circuit Attorney Kimberly Gardner, who prosecuted former Missouri Gov. Eric Greitens and was found to have engaged in misconduct by the state's chief legal disciplinary officer during the criminal prosecution.

In New York, Alvin Bragg is the Democratic candidate for Manhattan district attorney, and he has promised not to prosecute trespassing or resisting arrest, Hogan said. He added that Bragg also said, "Everyone is going to get bail unless they commit a murder, an assault with a deadly weapon where somebody actually was seriously injured, or a sex crime." This means cases of shootings where no one is injured, domestic assault without a weapon, illegal possession of a firearm, and drug dealers will get bail, Hogan explained.

A warning sign of these political district attorneys is when "they say that they're going to deprosecute whole swaths of crime," Hogan said. "In other words, they're going to take a particular area of crime, and even if the legislature passed the law, and even if the governor signed it, the prosecutor's saying, 'I'm not going to enforce it.' That is a huge red flag, because that's not a prosecutor's job. The prosecutor's job is to enforce the law that's on the books.

"They are usurping the authority of the legislature. If you want a law to change, a criminal law to change, run for the legislature. Don't run for district attorney. That's not your role, stay in your lane. And we're seeing that across the political spectrum: People are coming out of their lanes and deciding that they're going to do what they want."

Hogan added that voters need "to pay attention" when they vote for elected prosecutors.

"They have to demand that their prosecutors actually enforce the law," he said. "They need to support their police, if they want to be safe, because what we're seeing right now is the violent crime is leaking out from the cities and it's starting to hit the suburbs. I saw an interview with the suburban police chiefs around Minneapolis, and they said that the gangs are coming out there now because they realize they're just not going to get prosecuted."

While "the discretion of a prosecutor is great, and generally has been unfettered" in the courts, Hogan said, the attorney general over the prosecutor has the power to rein them in.

"Now what you can have is every district attorney is also covered by an attorney general, and a U.S. attorney's office," Hogan explained. "So you could have them stepping in and becoming much more law-enforcement-friendly … for instance, in Florida, when the Jacksonville state's attorney stopped enforcing the death penalty and stopped really going after murder cases, the governor did take away her authority over murder cases and handed it off to the attorney general."

Idaho State Patrol Police Sent to Arizona Border to Help With Security

BY THIN BLUE LINE TV

JULY 15, 2021

BOISE, ID – Idaho Governor Brad Little said that the state is sending Idaho State Police down to Arizona to help with the border crisis.

The governor said that the troopers will act as “force multipliers” with the Arizona State Police. He said, “Meth and fentanyl are the most serious and growing drug threats in Idaho and there is a direct tie to the border in Mexico.”

The five Idaho troopers were sent down to Arizona near the border on July 1 for a 21-day trip. At the time Governor Little said, “The crisis at the United States-Mexico border and the alarming bump in illegal drug activity are direct results of failed policies of the Biden-Harris administration that harm the people of Idaho.”

Little had indicated that the drugs start south of the border, then move up through California and Oregon over to Idaho.

— KREM 2 NEWS (@KREM2) July 15,

When announcing he was sending the troopers, Little said, “We did our homework and worked closely with Arizona State Police to determine the true needs and how Idaho can help in a meaningful, impactful way without compromising public safety here at home. States frequently assist each other through the emergency response system with fires, floods, and other emergencies, and this situation is no different.

“More than half of officers surveyed this year reported that investigations involving fentanyl were directly tied to sources [in Mexico].”

In addition to helping the Arizona police with drug interdiction and illegal immigration, the troopers will also be receiving information and training on new methods and technologies for reducing drugs in Idaho.

Officers all across the state of Idaho have been reporting the extreme uptick in crimes tracing back to drugs, and the use specifically of fentanyl. Reports have found that most fentanyl and methamphetamine in the US is imported from Mexico.

Captain John Kempf with the Idaho State Police in Coeur d’Alene said that fentanyl is popular because it’s low cost and easy to produce and smuggle. He said, “It’s very, very potent per gram, it is much more potent than black tar heroin was or is, and you essentially get more bang for your buck when you’re talking about addicts.”

Twin Fall chief of police, Craig Kingsbury, said, “Fentanyl is truly taking over our state with some really negative consequences.”

“I was talking to a rancher last week that has property along the border,” Little said, “and they said a vast majority of people coming across … are there for one reason, and that’s smuggling fentanyl and meth.” Weak border security has made the problem much worse in recent months, according to Little.

Arizona Conservatives Take Action, [15.07.21 16:36]

Highlights from AZ Audit Senate Hearing 7/15

Hand Count

• Ballot duplication nightmare. Serial numbers are required to match the original and duplicated ballot. “Thousands (https://t.me/ArizonaConservatives/1866)” of ballots are either missing serial numbers or have unreadable serial numbers printed over a dark black ballot identification box. Ken Bennett stated that it’s impossible to determine whether a ballot was duplicated more than once. Kelli Ward has previously stated there 27,869 duplicate ballots (https://t.me/ArizonaConservatives/1866).

Machine Analysis

• Fictive equipment verification process. Senator Peterson noted that if the EAC equipment verification process cannot handle evaluation by an audit, then we need a new certification procedure.

• Cyber security vulnerabilities, missing security event data, and suspicious logins. Ben Cotton of CyFIR emphasized the critical need for router and Splunk log data. He gave 4 reasons:

a) The November election system breach reported by Maricopa County and the SoS.

b) Extreme cyber security vulnerabilities: the last malware and operating system/ security patch update was in August 2019 when the Dominion software was originally installed. “It would take less than 10 min to gain system-level access.”

c) Security event data only goes back to 2/5/21. By design, the security log only holds 20 MB of data. Strangely, on 3/11/21, there were 37,646 queries for a blank password that had had the effect of overwriting the data prior to 2/5/21.

d) Suspicious anonymous logons. CyFIR has found anonymous logons at the system level that do not follow the pattern of normal Windows behavior.

• Maricopa County is unable to validate the security of the election system. The evidence provided suggests that only Dominion is able to verify the ICP configuration. Cotton explains that it’s impossible to validate the security of an election system if you cannot independently validate the configuration. CyFIR needs the authentication fobs held by Dominion to check ICP configuration.

Paper Analysis

• Ballot calibration was off by an average of 1000% in some batches leading to bleed-through, which can cause over-votes or inaccurate vote attribution. The County has stated that they use thick VoteSecure paper, which should limit bleed-through in the event of mis-calibration. However, the Cyber Ninjas team found a large number of ballots on very thin paper stock. The ballots printed on-demand at the voting centers on Election Day have the worst calibration issues. More than 168K ballots were affected. #sharpiegate

Voter Rolls

• Voter roll anomalies affect more than 107K ballots. Doug Logan “highly recommends canvassing” based on the data his team has reviewed. For example:

a) There are 74,243 mail-in ballots with no clear record of being sent out

b) 11,326 people who voted do not show up on the 11/7 voter rolls, but are listed in the 12/4 database

c) 3,981 people who voted on Election Day were registered after 10/15, which is a violation of state law

d) Approximately 18k people voted on Election Day but were subsequently removed from the rolls

Envelopes

• Maricopa County did not turn over images of the envelopes as requested in the January subpoena

Closing Remarks

The hearing concluded with a review of the 17 missing items needed to complete the audit, many of them already subpoenaed, including router data, Splunk logs, hardware tokens, envelope images, chain of custody documentation, and all portable media. Senator Fann stated that the Senate will likely have to go back to court to enforce the subpoena and retrieve the remaining items.

AZ Audit Hearing Insights From @ladydraza

“Ben Cotton just usedthe term script-kiddie. This is the term used for someone who is interested in hacking computers, but doesn't have deep cybersecurity education. They typically just copy scripts that are available on the internet that someone with higher skills wrote and use them. They just said a script-kiddie could access these machines in 10 min.

Important thing about the calibration is it tells the scanner where everything is on the sheet so the machine can identify the location that voting bubble would be at. If the calibration mark is intentionally printed in the wrong location…the machine will look for the filled in bubble in the white area next to the filled in bubble. Will say, "I can't read this vote" and zoooommmm…off this ballot goes for adjudication.

Based on what he just said…the data shows a log of voting adjustments up AND down in the voting totals…into December and some into Jan 2021. This is part of what Dr. Frank called the ‘clean up phase’”
