Michigan GOP lawmakers end Gov. Whitmer's 'rule by decree' — and she is powerless to veto it

 

Republican lawmakers in Michigan killed a law Wednesday that underpinned Whitmer's draconian coronavirus restrictions

 

Republican lawmakers in Michigan have officially killed a law that allowed Democratic Gov. Gretchen Whitmer to lock down the state indefinitely during the coronavirus pandemic — and the governor is reportedly powerless to veto it.

 

According to WDIV-TV, the Republican-led state House voted 60-48 on Wednesday to repeal an emergency powers law that granted broad authority to governors to issue an emergency declaration and enact rules to "protect life and property or to bring the emergency situation within the affected area under control." The state Senate approved the repeal proposal last week.

 

The law, known as the Emergency Powers of the Governor Act of 1945, was employed by Whitmer early on in the pandemic to enact draconian and indefinite health and safety restrictions. But it was declared unconstitutional by the Michigan Supreme Court last October.

 

With the Wednesday vote, the law has now been completely wiped from the books. And since the repeal proposal was the result of a citizen-initiated campaign, the governor is unable to veto it.

 

Another emergency powers law, known as the Emergency Management Act of 1976, remains in place. Under that law, however, emergency orders cannot extend beyond 28 days unless they receive legislative approval.

 

Unlock Michigan, the citizen campaign that led the repeal initiative, reportedly "spent millions of dollars to collect hundreds of thousands of voter signatures" in order to bring the bill before the state legislature.

 

Fred Wszolek, a spokesman for the group, celebrated the repeal vote on Wednesday, saying it ended Whitmer's "rule by decree."

 

"We're grateful to the members of the House and Senate who stood with the people of Michigan, and we're grateful for their help in repealing the misguided 1945 law that caused so much pain once and for all," Wszolek said, according to the Detroit News.

 

His group is now reportedly circulating petitions to revise a separate law, passed in 1978, that enabled Whitmer's administration to extend public health orders, such as capacity and masking restrictions, indefinitely without approval from lawmakers.

 

Wszolek said Whitmer also "abused" that law "to destroy lives, businesses, and futures."

 

Certainly, Michiganders have endured some of the nation's harshest lockdown policies since the start of the pandemic last March. Whitmer, though, has argued that her emergency directives were intended to keep residents safe.

 

Her allies, too, have warned that repealing the public health laws would only endanger residents.

 

"Today, House Republicans voted to eradicate an important tool for elected leaders trying to save lives and stop the spread of deadly, infectious diseases like COVID-19, Legionnaire's, tuberculosis and anthrax," Mark Fisk, a spokesman for Keep Michigan Safe, a group formed to oppose Unlock Michigan, said.

National Park Service To Send Data Collected From Special Use Permits To White House

 

The National Park Service is making it easier to share more data with the White House and other federal agencies on applications and approvals of special use permits for parks spaces.

 

The updates—outlined in a notice set to publish Wednesday in the Federal Register—would streamline the process for sharing data with the Executive Office of the President and allow NPS to share data with other agencies and entities suffering a cybersecurity breach when deemed “reasonably necessary” for helping respond to the incident.

 

The Park Service oversees 423 parks across the U.S., ranging from traditional, large conserved open spaces like Yosemite National Park all the way to small squares and triangles in roadways around Capitol Hill in D.C.

 

People interested in using a park for a specific purpose at a specific time generally have to obtain a special use permit. NPS issues permits for three types of uses: standard events like weddings, sports, picnics and family gatherings; special events like demonstrations, races, tournaments and the like; and construction, research and utility work.

 

When users apply for such permits, the system collects a wealth of data needed to process the application, including:

 

Name, organization, Social Security number, Tax Identification Number, date of birth, address, telephone number, fax number, email address, person’s position title.

Information of proposed activity including park alpha code, permit number, date, location, number of participants and vehicles, type of use, equipment, support personnel for the activity, company, project name and type, fees, liability insurance information.

Payment information including amounts paid, credit card number, credit card expiration date, check number, money order number, bank or financial institution, account number, payment reference number and tracking ID number.

Information on special activities including number of minors, livestock, aircraft type, special effects, special effect technician’s license and permit number, stunts, unusual or hazardous activities.

Information on driver’s license including number, state and expiration date.

Vehicle information including year, make, color, weight, plate number and insurance information.

 

The latest update proposes revising the system of records notice with some technical changes and expanding the federal entities with which that data can be shared.

 

The update adds “two new routine uses to facilitate sharing with the Executive Office of the President to resolve issues upon request of the subject of the record and with other federal agencies or entities to respond to a breach of personally identifiable information.”

 

The proposal to enable sharing with the Executive Office of the President appears to be limited to requests made by the applicant or someone on their behalf, with some additional leeway.

 

The information noted above could be shared with the White House “in response to an inquiry from that office made at the request of the subject of a record or a third party on that person’s behalf, or for a purpose compatible with the reason for which the records are collected or maintained,” the Federal Register notice states.

 

The update also modifies an approved sharing and adds another around data breach response. The modification allows NPS to share information about a breach of this system with other appropriate agencies—such as the Cybersecurity and Infrastructure Security Agency—to “respond to the suspected or confirmed breach or to prevent, minimize, or remedy such harm.”

 

The new addition would enlist NPS and special use permit data in assisting other agencies responding to a confirmed or suspected breach when such data would help with the investigation. Before sharing the data, the Interior Department must first determine “that information from this system of records is reasonably necessary to assist the recipient agency or entity.”

 

NPS already shares special permit use data with some federal agencies, including the Justice Department and members of Congress. The update expands the conditions under which such sharing is allowed, along with the new additions.

You’ve probably never heard of Robins Island, a teardrop-shaped islet half the size of Central Park in the Great Peconic Bay on the East End of Long Island. But it may very well be the most valuable private estate in all of the Hamptons — and the most untouchable.

 

Sandwiched midway between the North and South forks, Robins Island is roughly 435 acres with miles and miles of waterfront.

 

For comparison, a 42-acre compound, less than one-tenth the size of Robins Island, with far less waterfront, sold in Southampton this spring for close to $145 million.

 

“If it were just raw land, I’d guess Robins Island would be worth about a $100 million,” Corcoran’s Susan Breitenbach guessed, noting that she has never visited the island. “But depending on what’s out there in terms of infrastructure, it might be worth from $200 million to $500 million.”

 

Satellite images reveal two large estate homes on the island, what appears to be a caretaker’s home, a tennis court, a dock and thick woodlands. Boats to the island depart from the North Sea Harbor in Southampton.

 

But the very fact that area brokers, who make it their business to know the ins and outs of the Hamptons’ best estates, are foggy on its structures and amenities illustrates just how thick the veil of mystery is surrounding Robins Island.

 

Asked by The Post about the island, both the Sag Harbor harbormaster and a village policeman shrugged.

 

North Haven’s John Diat, 59, said that the waters around Robins are famed for their fishing but he’s less certain about what might happen on the island itself. The retired media executive added that he’s heard about well-attended bird hunts on the island.

“I heard that Jimmy Buffett was shooting there in November,” he said.

 

A sailor in Montauk — dressed in a dark tan safari vest and trucker’s cap emblazoned with the word “CASH” — added that he has heard urban legends about Robins Island.

American Life Expectancy Sees Biggest Drop Since WWII, Erasing 20 Years Of Progress

 

A few days ago, we reported the latest "stunning numbers" on American overdose deaths: more than 90K Americans died in 2020 of drug-related overdoses, with some 80% of those involving fentanyl, the synthetic opioid that has displaced heroin as the most commonly abused illicit opioid in the US.

 

These deaths, combined with the nearly 400K Americans who were killed by COVID last year, have officially led to the biggest drop in US life expectancy since WWII.

 

Provisional data released Wednesday by the Centers for Disease Control and Prevention showed that American life expectancy dropped to 77.3 years in 2020, roughly the same level as in 2003.

 

We reported on the preliminary data a few months ago, but now that it's been confirmed: Life expectancy in the US fell by 1.5 years in 2020, the biggest decline since at least World War II, as COVID killed indiscriminately, while the numbers of overdoses, homicides and other "deaths of despair" climbed.

 

"I myself had never seen a change this big except in the history books," said Elizabeth Arias, a demographer at the CDC’s National Center for Health Statistics and lead author of the report.

 

And from what we have seen so far, life expectancy won't rebound to pre-pandemic levels this year. It could decline again if the Delta variant causes new infections to flare up. What's more, many people skipped or delayed treatment last year for diabetes, high blood pressure and other conditions that could lead to more premature deaths.

 

"That has led to intermediate and longer-term effects we will have to deal with for years to come," Donald Lloyd-Jones, chair of the department of preventive medicine at Northwestern University Feinberg School of Medicine and president of the American Heart Association, told WSJ.

 

COVID was the third-leading cause of death in the US last year, with heart disease and cancer remaining in the top spots. More deaths from homicide, diabetes and chronic liver disease also contributed to the drop in life expectancy.

Larry Elder Wins in Court: California Must Put Him on Recall Ballot

 

Conservative talk show host Larry Elder won his court challenge Wednesday to California Secretary of State Shirley Weber, who must place him on the list of candidates in the Sep. 14 election to recall incumbent Gov. Gavin Newsom (D).

 

As Breitbart News reported Tuesday, Elder’s campaign sued the Secretary of State after she excluded him from the list of 41 candidates to replace Newsom, if a majority of voters choose to recall him. The reason given was that Elder allegedly failed to file complete tax returns. Elder’s campaign denied that accusation, noting that he had turned in five years of tax returns on time, and also arguing that the law requiring candidates to submit tax returns did not apply to recalls anyway.

 

Elder also noted the Secretary of State had exempted Newsom from the requirement, saying he was not a “candidate.”

 

Judge Laurie Earl agreed with the latter point: “Preliminarily … I am not convinced that Election Code section 8902 applies to recall election, and if it did, I am of the opinion, I am inclined to find that Mr. Elder substantially complied.”

 

After lawyers for all parties had a change to present their case, Earl made her ruling final:

 

I don’t find that the recall election is a direct primary election ballot … By reaching that finding, I don’t find that Mr. Elder was required to file tax returns at all … I would grant the petition, and issue a peremptory and writ of mandate, directing the respondent, and all persons under her control, to file Mr. Elder’s nomination documents … qualifying him as a candidate and place his name and ballot designation on the ballot, and any sample ballot and voter pamphlet for a candidate for Governor of the State of California in the September 14th recall election.

 

She also required the Secretary of State to include Elder’s statement of qualifications to be included in the voter pamphlet.

 

She ruled that while she did not need to order Weber to review Elder’s tax returns, the Secretary of State could give him the opportunity to file supplemental tax returns if necessary.

 

If Democrats hoped to keep Elder — a charismatic black conservative with a devoted popular following — off the ballot, the move may have backfired, as he has scored an important victory against the Democrat-run state government.

 

Former Monterey Park mayor Betty Chu, who also sued on behalf of Elder, had called the Secretary’s attempt to exclude Elder from the ballot “voter suppression,” throwing Democrats’ recent allegations against Republicans back at them.

Twitter Tests New Dislike Feature, But Won’t Show Number of Dislikes on Tweets

 

Twitter claims the number of dislikes would not effect the order of replies

 

Twitter is testing out a new dislike feature for iOS users, although the number of dislikes will not show up on a tweet. Twitter has also claimed it is a downvote, not a dislike button.

 

The announcement about the dislike button was made by Twitter via the official Support account on Wednesday. “Some of you on iOS may see different options to up or down vote on replies,” the tweet read. “We’re testing this to understand the types of replies you find relevant in a [conversation], so we can work on ways to show more of them.”

 

The accompanying photo included a number of variants being tested, including replacing the current heart-shaped like button with a thumbs up and an up arrow, and then including a complementary down arrow or dislike button respectively, and another version where the current like button stayed the same, but a downvote button was also included.

 

From the language included in the tweet, it suggests that Twitter would be using the number of dislikes or downvotes to further filter out replies – Twitter currently hides some tweets, even those with innocuous language, behind a “see more” filter. However, in a reply, Twitter claimed that votes would not change the order of replies. They also claimed that it was not a “dislike” button, although it is not exactly clear how that could be the case if they included the dislike design.

 

Twitter also noted that the downvotes or dislikes would not be public, and would be only visible to the users who took the action. If this is the case, it is even more confusing as to why Twitter would include such a button in the first place, as it would be rendered pointless if it did not affect either the order of replies or show the amount of dislikes.

 

The first instance of a Twitter employee declaring that they were working on a downvote or dislike feature was from November last year, when Kayvon Beykpour, the product lead at Twitter, responded to a critique of Twitter’s developmental priorities from Jackie Singh, a cybersecurity expert for the Biden campaign, saying that they were exploring it. The dislike button request from Singh came along with demands for Twitter to remove “disinformation” and improve “harassment and reporting” features.

 

Twitter’s announcement of a dislike button that would not show numerical data beside it comes as YouTube, a fellow Big Tech organisation, was caught scrubbing dislikes from the White House’s channel, despite later claiming that these were “spam” dislikes. Videos from the White House have received an overwhelming amount of dislikes despite this.

US strikes Ukraine-centered Nord Stream 2 ‘deal’ with Germany – Putin & Merkel ‘satisfied’ with pipeline’s near-completion

 

Washington and Berlin have struck a deal that would see the US drop opposition to the almost-complete Nord Stream 2 pipeline for Russian gas, in exchange for Germany promising investments in Ukraine.

 

US President Joe Biden administration officials confirmed the existence of the agreement on Wednesday, details of which have been leaked to the press earlier. Under the four-point plan, Germany and the US would invest in energy security and green energy in Ukraine and Europe and back the “Three Seas Initiative” spearheaded by Poland and Croatia.

 

Berlin also pledged to push Russia into extending the current gas arrangement with Ukraine, which provides Kiev with $3 billion in annual transit fees, through 2034 – and promised to back sanctions against Moscow if it commits “aggression” against Ukraine.

 

“Should Russia attempt to use energy as a weapon or commit further aggressive acts against Ukraine, Germany will take action at the national level and press for effective measures at the European level, including sanctions to limit Russian export capabilities to Europe in the energy sector,” an unnamed State Department official told reporters, repeating the statement given by undersecretary for political affairs Victoria Nuland before the Senate Foreign Relations Committee earlier in the day.

 

The exact verbiage also appears in the joint statement released by the German Foreign Ministry.

 

Meanwhile, the Kremlin said Russian President Vladimir Putin has received a phone call from German Chancellor Angela Merkel about the arrangement, and they were both “satisfied” with the fact Nord Stream 2 was nearing completion. The possibility of extending the transit agreement between Russia’s Gazprom and Ukraine’s Naftogaz beyond 2024 was “touched upon,” the Kremlin said in the readout of the call.

 

Early reports about the US-German deal spoke of a $50 million investment in green and other energy projects in Ukraine. Framing this as an effort to combat climate change, Berlin said the two countries would “endeavor to promote and support investments of at least $1 billion… including from third parties such as private-sector entities.” Germany’s initial donation will be at least $175 million and may be extended in the future budgets.

 

Germany also pledged $70 million in investments to help Ukraine transition away from coal and modernize its gas infrastructure, including creating the capacity for reverse gas flow, should Moscow cut gas supplies to Kiev for any reason.

 

The US-German deal has been in the works for some time, but was not announced last week during Merkel’s visit to Washington. According to the Wall Street Journal, the US demanded a “kill switch clause” in the pipeline’s operating rules, but Germany refused, saying it was a commercial project and such action would be illegal.

Hillary 2.0: Biden Used Private Email While VP to Send Government Intelligence to Hunter Biden - Report

 

History has a funny way of repeating itself, doesn’t it?

 

When now-President Joe Biden was serving as vice president in the Obama administration, his son Hunter Biden was galivanting around the world (sometimes on Air Force Two) in his pursuit of various business deals over which much hay has been made by Biden critics.

 

This, of course, is quite fair. It is certainly worthy of note that the father and son jetted off to China together on the vice presidential plane in 2013 and Hunter returned with a business deal with a Chinese state-linked bank.

 

There’s also the matter of Hunter’s position on the board of Burisma Holdings, a Ukrainian oil and gas company that was under investigation for corruption at the time that Vice President Biden was spearheading the Obama administration’s foreign policy in that nation, something which was likely impeded when Biden, by his own admission, pressured the government to fire the prosecutor heading up the probe by threatening to withhold millions in U.S. aid to the nation if he didn’t.

 

The senior Biden has adamantly denied having anything to do with his son’s business dealings, but the laptop that keeps on giving — that is, the laptop believed to have belonged to Hunter Biden that was abandoned at a Delaware computer repair shop in 2019 — has produced emails that, if authentic, significantly undermine this case.

 

Photos reportedly depicting Biden with his son’s business associates at the vice presidential residence in 2013 lend substantial evidence to claims that Joe Biden was lying through his teeth when he claimed to know nothing of his son’s affairs.

 

Now, we have learned that Joe Biden, when he was serving as vice president, was sending his son emails from a private email address, including information he’d received from the State Department, according to Just the News.

 

If this sounds familiar, it’s probably because it’s a lot like what failed Democratic presidential candidate and former Secretary of State Hillary Clinton was quite vocally accused of doing during the 2016 campaign. Those accusations serve as a cog in much of the so-called conspiracy theory surrounding the Obama White House, the deep state and longstanding accusations of illegal activity by the increasingly notorious former administration.

 

In the case of the Bidens’ private conveyance of State Department emails, at this point it appears to be considerably less suspicious than Clinton and her BleachBit operation, to be fair. But when you consider the Biden family history, well, it most certainly doesn’t look good.

 

Just the News reported Tuesday that then-Vice President Biden was sending emails to sons Hunter and Beau (who died in 2015) and others from the private email account robinware456@gmail.com, as per discoveries made on the Hunter Biden laptop.

 

According to the report, the messages were sometimes signed “Dad” and ranged from personal communications to forwarded information he’d received from the State Department.

 

In one instance, he bid his son Hunter to call him “right away” after the former insisted that he be involved with his father’s appointment of a Treasury Department detailee.

 

One of the emails obtained by Just the News was written to the State Department from the U.S. Embassy in Istanbul regarding the release of American Martin O’Connor, who had been imprisoned in Turkey.

 

“The lead attorney for Mr. O’Connor reports that the court granted the detention appeal and he expected Mr. O’Connor to be released from jail today, barring any unforeseen problems,” the email read, explaining the further details of his Dec. 11, 2014 release.
