Sen. Klobuchar wants to remove Section 230 protections from Big Tech companies that don't censor health emergency 'misinformation'

Sen. Amy Klobuchar (D-Minn.) on Thursday introduced legislation that would remove the liability protections social media companies enjoy if misinformation about COVID-19 vaccines or other health emergencies is shared on their platforms.

Klobuchar's bill would create an exemption to Section 230 of the Communications Decency Act, a law that provides platforms like Facebook and Twitter a shield from being sued for content posted on their websites by third parties. During an official public health emergency declared by the Secretary for Health and Human Services, if an internet platform permits misinformation to spread through its algorithms that platform would be legally liable for doing so, the Wall Street Journal reported. The federal government, through HHS in consultation with other agencies, would determine what constitutes health misinformation.

"Earlier this year, I called on Facebook and Twitter to remove accounts that are responsible for producing the majority of misinformation about the coronavirus, but we need a long-term solution," Klobuchar said in a statement. "This legislation will hold online platforms accountable for the spread of health-related misinformation."

The bill is co-sponsored by Sen. Ben Ray Lujan (D-N.M.).

Democrats fear that misinformation about COVID-19 vaccines is one of the primary reasons for vaccine hesitancy in the United States. An increasing number of COVID-19 cases caused by the delta variant has prompted public health officials to warn that mask mandates and other coronavirus restrictions may return if the remaining unvaccinated Americans do not take the COVID-19 vaccine shots.

White House chief medical adviser Dr. Anthony Fauci has floated vaccine mandates at the local level to force the hesitant to get vaccinated, but a recent poll found that 71% of Americans would oppose such an order.

Nearly all those who are hospitalized or die from a COVID-19 infection are unvaccinated.

The Biden administration has begun targeting purported misinformation about the vaccines on social media platforms in an effort White House officials claim will save lives.

NFL Teams With Unvax'd Players To Forfeit Games, Incur Financial Liability During Outbreaks

The NFL has notified clubs that if there's a COVID outbreak among unvaccinated players, teams who can't reschedule during the 18-week season will forfeit the match, be credited with a loss, and potentially incur financial liability and discipline from the commissioner.

According to the NFL Network's Tom Pelissero, the league intends to play its entire 272-game schedule over 18 weeks, and 'does not anticipate adding a '19th week' to accommodate games that cannot be rescheduled within the current 18 weeks of the regular season."

In short, all players need to be vaccinated unless teams want to risk running afoul of the new guidelines.

YouTube Deletes 15 Videos From Brazilian President's Channel For "COVID Misinformation"

Google-owned YouTube is once again flexing more power than world leaders by deleting 15 videos from Brazilian President Jair Bolsonaro’s channel over claims of ‘COVID misinformation’.

Videos that were removed included one that discussed the use of hydroxychloroquine as a treatment for COVID, as well as former health minister Eduardo Pazuello comparing coronavirus to AIDS.

“Post-HIV pandemic, HIV continues to exist. There are still some who are contaminated, most are treated, and life goes on,” he stated.

Some of the content was also deleted because YouTube doesn’t allow anyone to question the efficacy of masks.

This is particularly bizarre given that WHO and Anthony Fauci himself said early on during the pandemic that masks were useless.

Fauci wrote in a February 2020 email that a typical store-bought face mask “is not really effective in keeping out virus, which is small enough to pass through material.”

A similar argument was made recently by Dr Colin Axon, a SAGE advisor for the UK government, who told the London Telegraph that medics have given people a “cartoonish” view of how how microscopic viruses travel through the air, and the masks have gaps in them that are up to 5000 times bigger than COVID particles.

Apparently, discussing concerns shared by top doctors and scientists is enough to get content removed, even if you’re the leader of a major country.

“Bolsonaro and his office have not yet released a statement on the removal of the videos, but his official Twitter account did post a message urging followers to join him on Telegram to receive daily information directly,” reports RT.

As we previously highlighted, YouTube also automatically removes videos of anti-lockdown protests, even if the purpose of the video is to mock the protesters.

Appeals court reinstates church's lawsuit against Washington state abortion coverage mandate

Church's inability to get abortion-free health plan after law took effect is an "injury," 9th Circuit agrees.

A federal appeals court Thursday resurrected a church's lawsuit against Washington state's no-exceptions abortion mandate in health plans, agreeing that losing its abortion-free health plan was an "injury in fact that is fairly traceable" to the law.

During oral argument earlier this month, a three-judge panel of the 9th U.S. Circuit Court of Appeals signaled its skepticism of the state's assertion that SB 6219 didn't cause Cedar Park Assembly of God to lose its plan.

The law on its face offers no religious exemptions for purchasers of health plans, Judge Richard Clifton said at the time, characterizing state officials as saying "our fingerprints aren't on the murder weapon."

The only way to get out of abortion coverage is by choosing a plan without maternity coverage.

Kaiser Permanente "reasonably understood the plain language" of the law as banning it from offering any plan that did not cover abortion, "and it acted accordingly when it removed the restrictions from Cedar Park’s health plan," Thursday's order states.

While Washington claimed the Seattle-area church could have obtained abortion-free plans from other insurers – religious entities that have an exception to the abortion mandate – "there is no evidence in the the record clearly demonstrating" Cedar Park could find "acceptable coverage" when it sued, the order also reads.

"It is irrelevant that Kaiser Permanente erroneously provided Cedar Park with a health insurance policy that covered abortion services until this error was detected and corrected," the panel said, responding to the state's argument that the insurer itself – not the law – required the church to pay for abortion coverage.

"Washington state has no legal authority to force places of worship to fund abortions and violate their constitutional rights, as well as their religious beliefs," John Bursch, the Alliance Defending Freedom lawyer representing the church, said in a press release.

The case now goes back to the federal district court for further proceedings.

The Domain Name System (DNS) is a central part of the internet, providing a way to match names (a website you’re seeking) to numbers (the address for the website). On May 15, President Trump appointed Moncef Slaoui, a board member of Moderna who until May 19 held more than $10.3 million in Moderna stock, as chief scientist of the nation’s effort to find a Covid-19 vaccine.

Slaoui, who calls himself a “venture capitalist,” is also on the board of directors at the International AIDS Vaccine Initiative (IAVI), a “public-private partnership” organization that has received more than $359 million from the Gates Foundation.

Slaoui also held leadership positions at GSK. While heading the company’s Research and Development, GSK pleaded guilty and paid $3 billion in what the U.S. Justice Department referred to as the “largest healthcare fraud settlement in U.S. history.” The fraud included the coverup of the link between the drug Paxil and suicidal and depressive side effects (predominantly in children), the coverup of the link between the drug Avandia and heart attacks, which the FDA estimated lead to 83,000 excess heart attacks, as well several bribery and illegal kickback schemes.

While he was GSK’s chairman of vaccines, Slaoui oversaw the development of the swine flu vaccine named Pandemrix, which was rushed to market without proper testing during the swine flu outbreak. The result was an unsafe shot that left at least 800 people with brain damage, 80 percent of them children. Since GSK only agreed to give governments the vaccine on the condition that it be indemnified from liability, U.K. taxpayer money was used to pay millions of pounds in compensation to the victims.

Slaoui was hired to be the Trump administration’s “vaccine czar” as a private contractor, not a government employee. This means, as Public Citizen explained, that Slaoui can “maintain an extensive web of conflicting financial interests without the need to divest of, recuse from, or disclose those conflicting interests.”

The corporate media likes to paint the Covid-19 response as a tug of war between anti-science blowhards like Donald Trump and “champions of science” like Bill Gates. However, Slaoui’s appointment to co-direct “Operation Warp Speed” indicates that, here, the Trump administration and the Gates Foundation are on the same team.

After entering his new Trump administration role, Slaoui declared that Moderna’s clinical trial data made him confident “we will be able to deliver a few hundred million doses of vaccine by the end of 2020.”

Pegasus Spyware is a 'Big Black Hole', No Escape From Its Attack: Cyber Expert

Pegasus keeps updating its malware. Even if experts crack one, the spyware designs a new one. It is an ongoing war.

Israeli company, NSO group's Pegasus spyware is 'a big black hole' and near impossible to crack 'as the company keeps updating its modus operandi on how to attack mobile phones with malware,' says cyber expert Sandeep Shukla, speaking to The Quint.

Shukla is a professor of Computer Science and Engineering at IIT Kanpur, who also runs a government funded cyber security lab.

A global collaborative investigative project published by 17 media organisations on 18 July claims that mobile phones of at least 300 Indians were targeted by the NSO group using its Pegasus spyware. The list includes BJP ministers, opposition leaders, top lawyers, businessmen, rights activists and journalists.

Pegasus first made headlines in 2019 when Facebook-owned WhatsApp confirmed that the spyware was used to target around 1,400 users including journalists and human right activists in India. WhatsApp made this disclosure in a US law court in San Francisco.

WhatsApp claims to have fixed its software vulnerabilities that allowed Pegasus to penetrate a mobile phone just by giving the person a WhatsApp video missed call.

But Pegasus seems to have simply found other ways of spying on individuals' mobile phones.

The Quint spoke to cyber expert, Sandeep Shukla, to find out more about how the Pegasus spyware operates and what measures, if any, can be taken to protect mobile phones from being affected.

Arizona's largest health system Banner Health becomes the latest to require its 52,000 employees to get vaccinated against COVID-19 by November 1 or be fired

Banner Health, Arizona's largest hospital system, has become the latest to require its employees to get vaccinated against COVID-19.

The nonprofit health system is requiring its 52,000 workers across six states to be immunized November 1 or risk termination.

Officials said there will be 'limited exceptions' to the mandate but did not elaborate on what criteria would apply.

'We care for some of the most vulnerable people in our communities and we owe it to them to take every measure possible to ensure the safest care environment,' Dr Peter Fine, president and CEO for Banner Health, wrote in a company-wide email sent on July 20.

'We are taking this step to reduce risk for our patients, their families, visitors and each other. Safety is an absolute top priority and the COVID vaccine mandate reflects that commitment.'

Banner has an incentive incentive program in place to encourage workers to get vaccinated paid time off, reimbursement or travel and points toward its wellness program for discounts on health insurance.

Banner, which already requires workers to get the flu shot, said it is mandating the COVID-19 vaccine for several reasons including the rise of the highly transmissible Delta variant.

Average COVID-19 in Arizona have risen to 1,080 per day from 565 per day from two weeks ago, a 91 percent increase, according to Johns Hopkins data.

Arizona has reported a test positivity rate at 14 percent, up from five percent in June, which is near rates seen in November of last year.

Meanwhile, daily vaccinations have fallen from a record high of 78,000 per day in April to around 4,000 per day in July.

Meanwhile, the Delta variant makes up 36 percent of all new cases in the state.

Officials said they are also mandating the vaccine because it is expecting full approval of the Pfizer-BioNTech and Moderna COVID-19 vaccines.

'The vaccine data has fully supported the safety and efficacy to prevent disease and reduce its severity,' the company-wide email read.

'There is overwhelming evidence for us to act on behalf of the communities that rely on us to care for and protect them.'

The federal government's Equal Employment Opportunity Commission ruled in December 2020 that employers could legally set vaccine requirements for their workforce.

The Houston Methodist hospital system in Texas became the first in the U.S. to set a coronavirus vaccine requirement in April.
