Exclusive-'QAnon Shaman' in plea negotiations after mental health diagnosis -lawyer

 

WASHINGTON (Reuters) - The participant in the Jan. 6 U.S. Capitol riots nicknamed the "QAnon Shaman" is negotiating a possible plea deal with prosecutors, after prison psychologists found he suffers from a variety of mental illnesses, his attorney said.

 

In an interview, defense lawyer Albert Watkins said that officials at the federal Bureau of Prisons, or BOP, have diagnosed his client Jacob Chansley with transient schizophrenia, bipolar disorder, depression and anxiety.

 

The BOP's findings, which have not yet been made public, suggest Chansley's mental condition deteriorated due to the stress of being held in solitary confinement at a jail in Alexandria, Virginia, Watkins said.

 

"As he spent more time in solitary confinement … the decline in his acuity was noticeable, even to an untrained eye," Watkins said in an interview on Thursday.

 

He said Chansley's 2006 mental health records from his time in the U.S. Navy show a similar diagnosis to the BOP's.

 

A spokesman for the U.S. Attorney's office declined to comment on the case.

 

Chansley is one of the most recognizable of the hundreds of Donald Trump supporters who stormed the Capitol after the then-president in a fiery speech falsely claimed that his November election defeat was the result of fraud.

 

Chansley, of Arizona, was photographed inside the Capitol wearing a horned headdress, shirtless and heavily tattooed. He is a supporter of the QAnon conspiracy theory that casts Trump as a savior figure and elite Democrats as a cabal of Satanist pedophiles and cannibals.

 

He faces charges including civil disorder and obstructing an official proceeding.

 

Watkins did not say what Chansley was considering pleading guilty to, but defendants negotiating plea deals typically seek to plead to a less serious charge to reduce their potential prison sentences.

 

Watkins said authorities will need to determine how Chansley can get access to the treatment he needs to "actively participate in his own defense." Pleading guilty to a charge negates the need for a trial, but defendants still have to be declared mentally competent to do so.

 

Watkins said the BOP's evaluation of his client did not declare Chansley to be mentally incompetent, and he does not expect Chansley to be ordered to undergo what is known as competency restoration treatment.

 

'CHOCOLATE SOUP MESS'

 

Watkins said his client has expressed some delusions including "believing that he was indeed related directly to Jesus and Buddha."

 

"What we've done is we've taken a guy who is unarmed, harmless, peaceful … with a pre-existing mental vulnerability of significance, and we've rendered him a chocolate soup mess," Watkins said.

The National Institutes of Health (NIH) today lifted a 3-year moratorium on funding gain-of-function (GOF) research on potential pandemic viruses such as avian flu, SARS, and MERS, opening the door for certain types of research to resume.

 

The action coincides with today's release of a US Department of Health and Human Services (HHS) framework for guiding funding decisions about proposed research involving pathogens that have enhanced potential for creating pandemics.

 

Experts involved in the discussions welcomed the development, but some said the new framework still leaves key unanswered questions, such as how to responsibly report findings from the funded lab work in medical journals. Meanwhile, in research labs, some scientists plan to resume experiments and are relieved the pause has ended. Both groups are eager to see how the new review process works in real life.

 

In a statement today, NIH Director Francis Collins, MD, PhD, said "We have a responsibility to ensure that research with infectious agents is conducted responsibly, and that we consider the potential biosafety and biosecurity risks associated with such research." He added that he is confident that the review process spelled out in the new framework "will help to facilitate the safe, secure, and responsible conduct of this type of research in a manner that maximizes the benefits to public health."

 

Scientists gear up to resume studies

Research projects that were paused under the moratorium will now be reviewed based on the new framework, and the ones that clear the process will be able to proceed with appropriate risk mitigation measures in place.

 

Yoshihiro Kawaoka, DVM, PhD, who heads a virology research group at the University of Wisconsin-Madison, said his team will propose experiments they couldn't do during the funding pause. He was lead author of one of the two controversial H5N1 avian flu papers published in 2012 that brought the GOF controversy to a head.

 

"Specifically, we have been identifying amino acid changes that enhance the polymerase function of avian influenza viruses in mammalian cells to understand the molecular mechanism of avian-to-human transmission in a system not involving live virus," Kawaoka said. "We will now propose testing the effect of those amino acid changes on virus replication."

 

GOF research involves studies that enhance the pathogenicity, transmissibility, or host range of a pathogen to better understand the threat. However, GOF studies have sparked "dual-use" concerns that center around the threat of accidental lab release or the pathogens becoming bioterror threats if they fall into the wrong hands.

 

Framework follows advisors' daunting task

In light of controversial research on H5N1 viruses in 2012, the Obama administration in 2014 announced a pause of federally funded GOF research and asked a government advisory group to reevaluate federal GOF funding policies and put together recommendations to help officials make their decisions.

Presidential Emergency Action Documents (PEADs) are executive orders, proclamations, and messages to Congress that are prepared in anticipation of a range of emergency scenarios, so that they are ready to sign and put into effect the moment one of those scenarios comes to pass. First created during the Eisenhower Administration as part of continuity-of-government plans in case of a nuclear attack, PEADs have since been expanded for use in other emergency situations where the normal operation of government is impaired. As one recent government document describes them, they are designed “to implement extraordinary presidential authority in response to extraordinary situations.”

 

PEADs are classified “secret,” and no PEAD has ever been declassified or leaked. Indeed, it appears that they are not even subject to congressional oversight. Although the law requires the executive branch to report even the most sensitive covert military and intelligence operations to at least some members of Congress, there is no such disclosure requirement for PEADs, and no evidence that the documents have ever been shared with relevant congressional committees.

 

Although PEADs themselves remain a well-kept secret, over the years a number of unclassified or de-classified documents have become available that discuss PEADs. Through these documents, we know that there were 56 PEADs in effect as of 2018, up from 48 a couple of decades earlier. PEADs undergo periodic revision; although we do not know what PEADs contain today, we know that PEADs in past years—

 

authorized detention of “alien enemies” and other “dangerous persons” within the United States;

suspended the writ of habeas corpus by presidential order;

provided for various forms of martial law;

issued a general warrant permitting search and seizure of persons and property;

established military areas such as those created during World War II;

suspended production of the Federal Register;

declared a State of War; and

authorized censorship of news reports.

The Brennan Center’s Liberty and National Security Program researches PEADs and advocates for greater transparency and oversight of them. Defense Advanced Research Projects Agency Our Research Pandemic Prevention Platform

 

The Pandemic Prevention Platform (P3) program aims to support military readiness and global stability through pursuit of novel methods to dramatically accelerate discovery, integration, pre-clinical testing, and manufacturing of medical countermeasures against infectious diseases. P3 confronts the reality that Department of Defense (DoD) personnel are not only deployed around the world for routine operations, but are often among the first responders to outbreaks of emerging or re-emerging disease with pandemic potential (e.g., Ebola). P3 aims specifically to develop a scalable, adaptable, rapid response platform capable of producing relevant numbers of doses against any known or previously unknown infectious threat within 60 days of identification of such a threat in order to keep the outbreak from escalating and decrease disruptions to the military and homeland. State-of-the-art medical countermeasures often take many months or even years to develop, produce, distribute, and administer. The envisioned P3 platform would cut response time to weeks and stay within the window of relevance for containing an outbreak.

 

P3 focuses on rapid discovery, characterization, production, testing, and delivery of efficacious DNA- and RNA-encoded medical countermeasures, a foundational technology pioneered by DARPA under the Autonomous Diagnostics to Enable Prevention and Therapeutics (ADEPT) program that provides the body with instructions on how to immediately begin producing protective antibodies against a given threat. The P3 program seeks to unlock the potential of these coded genetic constructs—establishing them as the basis for a threat-agnostic platform technology—by achieving and integrating breakthroughs in three key areas: novel approaches for the growth of viruses for use in testing and evaluation of countermeasures; rapid identification and maturation of protective antibodies to increase their potency; and novel technologies for the delivery of nucleic acid constructs into patients to encode the antibody of interest and produce a protective response.

 

A principal benefit of the nucleic-acid-based approach to limiting the spread of infection is that genetic constructs introduced into the body would process quickly and not integrate into an individual’s genome. Similarly, the antibodies produced in response to treatment would only be present in the body for weeks to months. This is consistent with DARPA's intent to safely deliver transient immunity, halting the spread of disease by creating a firewall, and buying time for longer-term medical responses to be developed and deployed.
