OAKLAND — Well-known East Bay real estate developer James Tong was sentenced Friday in federal court to 15 months in prison for making illegal donations to U.S. Rep. Eric Swalwell’s campaigns.
Tong, 74, of Fremont, was convicted by a jury in October for making tens of thousands of dollars of illegal contributions to two of Swalwell’s congressional campaigns. He was sentenced Friday to 15 months in prison by U.S. District Judge Jon S. Tigar of the Northern District of California.
Tong was convicted of funneling $38,000 to Swalwell’s first campaign in 2012 and his re-election campaign in 2014 through a series of straw donors — a scheme designed to evade the federal donation limits, which were then $2,500 and $2,600, respectively.
Tong provided envelopes of cash to his bank manager and other business associates and then directed them to give the cash individually to people in the community, according to the Department of Justice. People then used Tong’s cash to write their own checks to Swalwell’s campaign.
Swalwell, D-Dublin, who ran for president last year, was not accused of wrongdoing in the case. He said he donated the money to charity and only learned about the straw donor set-up when he was told by the FBI in 2017. He also testified in the trial.
