For example -

 

Retail food chain purchases 100,000 cases of cookies.

  • Manufacturer will deliver 100,000 cases per the agreed delivery schedule (which can only be modified by the store).

  • Manufacturer will be penalized for breach.

  • Manufacturer may need to provide proof of contingent manufacturing capability (i.e.,2nd plant) to meet 100,000 case contract.

 

Cookie manufacturer buys 10,000,000 lbs of flour.

  • Flour mill will deliver 10,000,000 lbs of flour per the agreed delivery schedule (which can only be modified by the cookie manf).

  • Flour mill will be penalized for breach.

  • Flour mill may need to provide proof of contingent milling capability (i.e.,2nd mill) to fulfiull the contract.
