Mayorkas exploits media unfamiliarity w/immigration law. Since Biden exempts almost all illegal families from Title 42 expulsion they fall under Title 8 pre-covid rubric. However, Biden terminated the T8 removal tools (Safe 3rd/MPP/Flores fix, asylum bars) thus catch&release. 2/7
The “fast-track” family removal process 45 pioneered only works if asylum loopholes are shut. But Biden opened them to fit innumerable millions. What does this mean? Any illegal family that merely requests asylum (or claims “fear”) stays in US. It’s biggest loophole on earth. 3/7
Also: families testing positive stay. Those from countries requiring documents (most nations) stay. Those DHS lacks space/time to hold stay. Manifests nations reject (requires pressure not being exerted) stay. Bottom line, the “fast-track” announcement is a shameless PR ruse. 4/7
Every move Mayorkas makes is calculated to resettle, not return, illegal families. Hence, only 73 family aliens were removed out of daily 2K+ apprehended (from dozens of nations)! Just 1 sector enrolled. It’s a publicity stunt to mask endemic catch & release. Media was duped. 5/7
There are 4 genuine ways to remove illegal families. T42, swift transit to alternate country, rapid asylum denial, or detention through lengthy imm court proceeding. Biden suspended these 4 family removal pathways. This was true before the sham “announcement” & it’s true now. 6/7
Moreover, all non-Mexican illegal unaccompanied minors are resettled in US (numerically, a new city of UACs every month) & single adults got away #’s astronomical. The border is still disastrously open (much worse than known)—yet, some in GOP are focused on “infrastructure”. 7/7
