Yes.

There's no explicit mention of martial law in the Constitution and habeus corpus can only be suspended in cases of invasion or if "public safety" requires it. Even then a court can issue a writ of have us corpus on any government agency which means they then have to justify why the individual in question is being held.

It has been argued that only Congress can declare martial law because they alone can suspend the writ. The president has also been argued to be able to as he is Commander in Chief.
