Judge dismisses Michael Avenatti's $250 million defamation lawsuit against Fox News

 

Disgraced attorney Michael Avenatti had his $250 million defamation lawsuit against Fox News dismissed after a judge ruled that the news organization had accurately reported charges against him.

 

Avenatti gained national prominence among critics of former President Donald Trump when he represented Stormy Daniels, an adult film star who accused Trump of paying her off to stay quiet about their extramarital affair. Some on the left were even floating Avenatti's name as a possible Democratic presidential candidate before he was convicted for an extortion scheme against Nike, Inc.

 

On Friday, Avenatti, 50, was dealt another courtroom defeat.

 

U.S. Circuit Judge Stephanos Bibas said in his ruling that most of what Fox News reported about Avenatti was "substantially" true.

 

"And Avenatti does not plausibly plead that Fox or its employees knew that the statements were false or recklessly disregarded that possibility," he explained. "He also fails to allege any recoverable damages."

 

Avenatti argued that he had been arrested but not charged with domestic violence in 2018 while Fox News had reported that he had been charged. The judge said that was a "minor error."

 

The network released a statement about the ruling.

 

"We are pleased with the Court's swift decision in favor of FOX News," the network said. "Today's ruling is a victory for journalists everywhere, who should not be intimidated into silence when bullies like Michael Avenatti file baseless multimillion-dollar lawsuits."

 

Avenatti was sentenced in July to 30 months in prison after he was convicted of extortion. He is facing a lawsuit from former clients who accused him of embezzlement, and also another lawsuit from Daniels accusing him of stealing money from her. He has denied those claims.

Gab’s Andrew Torba Responds after Dan Bongino Calls Him a ‘Clown’ and ‘Fraud’

 

"If you're going to call yourself a 'free speech' platform then you better have a terms of service that reflects that claim."

 

On his show, Dan Bongino launched a series of emotional attacks against Torba for criticizing Rumble on their “great day,” calling him a “joker,” a “fraud,” and a “clown.” In a post on Facebook, Bongino added that Torba’s criticisms was a “childish temper-tantrum” because Rumble was successful, describing him as “pathetic,” saying that he only cares about himself. “It’s embarrassing,” Bongino wrote. “I’m sorry to do this but Torba clearly believes a circular firing squad is a successful strategy, and he chooses to make his emotional outbursts public. They require an honest response.”

 

Torba responded to Bongino’s claims in a video posted to Gab TV and in a written statement online. He argued that he has never once bashed other genuinely free speech sites, including YouTube competitors Bitchute and Odysee. He further added that Rumble is based in Canada, a country with stringent hate speech laws, and as such would be subject to their legal regulations. As National File reported, the speech regulations on Rumble, which specifically bans “anti-Semitism” as well as “hate speech,” were created on the day that President Donald Trump joined the platform.

 

“It’s not about competition for me, it’s about principle,” Torba said. “Having platforms that call themselves free speech, when they have the same terms of service and the same rules as Big Tech, is not acceptable,” Torba continued. “If you’re going to call yourself a ‘free speech’ platform then you better have a terms of service that reflects that claim. Otherwise: you’re a subversive at worst and a hypocrite at best.”

 

The Gab CEO confirmed that the site was also a safe haven for liberals to post without fear of censorship, including those like Greenwald and Gabbard, but that he takes issue with Bongino funding these high-profile liberals and not conservative content creators who may have been canceled by other social media and financial platforms. “There are now [conservative dissidents] who are banned from the financial sector… What are you doing here? You’re not propping up those people who are actually speaking truth to power, you’re propping up liberals,” Torba argued. “The issue is you’re paying these people six figures while our own people on our own side can’t even open a bank account.”

 

Torba further confirmed that he would happily work together with Bongino and others “against our shared enemies,” if Rumble removed the hate speech clause from their terms of service. “Until then, Gab and others will continue to be the tip of the spear for free speech on the internet and we will absolutely call out those who claim to be something they are not.”

 

This is not the first time that Torba and Bongino have butted heads. In February, Bongino falsely accused Torba of being behind a National File article which criticized the then CEO of Parler, Mark Meckler, who is tied to the Soros-supported Convention of States project, labeling the reporting as a “hoax” deliberately determined to undermine Parler’s success for Torba’s personal gain. Torba said it was a “shame” that Bongino made the “baseless” claims against him “because a media outlet reported something” Bongino didn’t like. “Bizarre behavior from a grown adult man,” Torba added at the time.

Lansing police officer arrested during child sex sting

 

The Shiawassee Human Oppression Team released the following statement on the arrests.

 

On August 8th, S.H.O.T. (Shiawassee Human Oppression Team) conducted a sex sting operation that resulted in the arrest of five individuals. The arrested individuals all engaged in a sexual conversation with whom they believed to be a 15 year old female (except in one case where one of the individuals thought he was chatting with a 15 year old boy). All five subjects were arrested after they traveled to the location of the undercover operation to meet for sexual acts. All five men face charges of Child Sexual Abusive Activity, Accosting a Minor Child for Immoral Purposes and Using the Internet to Commit a Crime. Fielder faces an additional charge of Possession of a Firearm During the Commission of a Felony after he showed up armed with his personal handgun. Yesterday, all five men were arraigned in 66th District Court. Fielder, Schneider and Mulanix each received a $20,000 bond, respectively. Adcock and Chester both received a $15,000 bond.

 

S.H.O.T. is a multi-jurisdictional team comprised of Law Enforcement professionals from the Shiawassee County Sheriff’s Office, Corunna, Durand, Laingsburg, Morrice, Owosso and Perry Police Departments, Shiawassee County Central Dispatch, Shiawassee County Emergency Management, Shiawassee County Prosecutor’s Office and the FBI. Nathan Matthew Schneider of Owosso has been charged with child sexually abusive commercial activity, children-accosting for immoral purposes, and using computers to commit a crime.

 

Corey James Mulanix of Linden has also been charged with child sexually abusive commercial activity, children-accosting for immoral purposes, and using computers to commit a crime.

 

Zackary Douglas Adock of Lansing has also been charged with child sexually abusive commercial activity, children-accosting for immoral purposes, and using computers to commit a crime.

 

Thomas Chester of Haslett has also been charged with child sexually abusive commercial activity, children-accosting for immoral purposes, and using computers to commit a crime.

 

LANSING. Mich. (WLNS)– A Lansing Police Officer now faces child pornography charges in Shiawassee County, following his arrest earlier this week.

 

According to the filing document from the 66th District Court, Benjamin Fielder is charged with four felonies, including:

 

Child Sexually Abusive Commercial Activity

Children-Accosting For Immoral Purposes

Using A Computer to Commit A Crime

Felony Firearm

 

Fielder was put on unpaid leave after Interim Lansing Police Chief Ellery Sosebee was notified of his arrest.

 

“The recent news is disappointing and frustrating, I hold my staff to the highest professional standards. I will not tolerate any employee misconduct and will take appropriate action if the allegations are confirmed”, said Chief Sosebee in a press release.

 

An internal LPD investigation will be conducted alongside the Shiawassee County Sheriff’s criminal investigation.

 

Fielder has worked for the department for 3 years.

IDF Veterans Issue Report About Settler Violence Against Palestinians In The West Bank

 

There is a broad consensus amongst international institutions that Israel remains the occupying power in Gaza and the West Bank. The Hague regulations of 1907 and the fourth Geneva Convention of 1949 impose certain rights and obligations upon any nation that is illegally occupying a territory.

 

In December 1975 the United Nations General assembly passed a resolution which recited that “any military occupation however temporary’’ constituted “an act of aggression’’. It condemned “Israel’s occupation of Arab territories in violation of the charter of the United Nations, the principles of international law repeated United Nations resolutions’’.

 

Since the collapse of the Israeli Palestine peace process at camp David in January 2001, Israel has proceeded apace with the illegal annexation of Palestinian land in the West Bank. We now have the situation where between 600,000 to 750,000 Jewish settlers are living in 250 illegal settlements dotted all across the West Bank. These are protected by thousands of soldiers from the Israeli Defence Forces (IDF).

 

As the scale and size of these illegal settlements have expanded in the West Bank so has the extent of the daily violence meted out by settlers the Palestinian population.

 

Under international law Israel has certain obligations with regard to its treatment of the Palestinian population in the West Bank and Gaza. A new report from Breaking The Silence, Settler Violence in the West Bank Soldiers’ Testimonies 2012–2020 gives a detailed account of how the IDF as the sovereign authority in the occupied territories fails to protect the safety and security of the Palestinian population.

 

This report based on interviews with dozens of IDF veterans notes how Israeli settlers, “often use the cloak of protection provided by the IDF to promote their goals, at the forefront of which is deepening their control of the area and pushing the Palestinians off of their land’’.

 

It should be noted from the outset that Breaking The Silence, which was established in 2004 by IDF veterans, has collected the testimonies of over 1000 former soldiers who have served in the occupied West Bank and Gaza since the start of the Second Intifada.

 

The objective of these IDF veterans is explained in the introduction to their latest report:

 

“We endeavour to stimulate public debate about the price paid for a reality in which young soldiers face a civilian population on a daily basis, and are engaged in the control of that population’s everyday life. Our work aims to bring an end to the occupation.’’

 

The report from Breaking The Silence notes how settler violence towards Palestinians in the West Bank has ‘Intensified significantly over recent years’. This has been made possible by the complete absence of any attempt to enforce the law by Israeli legal institutions, the police and the IDF.

 

Several examples below will illustrate the different types of violence meted out on a daily basis by Israeli settlers against the Palestinian residents of the West Bank.
