It's different when you're employed by the government, fren. Due process doesn't just cover criminal activity, but any deprivation of "life, liberty, or property." This case would be a property interest based on the mutually understood contract between the police officer/union and the government, which required both notice and some sort of ability to respond BEFORE the deprivation of property (aka taking away pay.)
Many Supreme Court cases have fleshed this out over the last few decades.

I'm in law school to help, and you should be glad there are anons in this profession. Not every average person is going to have the time and energy to learn these things, and sitting back and complaining about our legal system is far too easy, but sadly isn't helping anyone.

But seriously, I learn more in one week in law school than most will know in their entire lives, including how to counsel and represent those who cannot represent themselves fruitfully in a court.
