South Australia man sentenced for online child exploitation

A 51-year-old has been sentenced to more than two years’ jail by the Adelaide District Court yesterday (26 August 2021) for possessing more than 1000 files of child abuse material, which included graphic images and videos of very young children being sexually abused.

The South Australia Joint Anti Child Exploitation Team (SA JACET) arrested the man in October 2019, after an investigation sparked by a tip from the United States National Center for Missing and Exploited Children (NCMEC).

A person believed to be in South Australia had allegedly uploaded child abuse material to online platforms. SA JACET investigators identified the 51-year-old man as the suspected user of the account.

Police executed a search warrant at his home in Gawler, north of Adelaide, and found child abuse and bestiality material on several data storage devices. The content included videos, images and animated images involving children suspected to be as young as three.

The 51-year-old pleaded guilty in July 2020 to possessing or controlling child abuse material obtained or accessed using a carriage service, contrary to section 474.22A of the Criminal Code Act 1995 (Cth).

The man was sentenced to a term of imprisonment of two years, six months and 19 days, to be served in the community under a two-year Recognizance Release Order.

Members of the public who have any information about people involved in child abuse and exploitation are urged to call Crime stoppers on 1800 333 000.

You can also make a report online by alerting the Australian Centre to Counter Child Exploitation via the Report Abuse button at www.accce.gov.au/report.

Note to media:

Use of term ‘CHILD ABUSE MATERIAL’ NOT ‘CHILD PORNOGRAPHY’

The correct legal term is Child Abuse Material – the move to this wording was among amendments to Commonwealth legislation in 2019 to more accurately reflect the gravity of the crimes and the harm inflicted on victims.

Use of the phrase "child pornography" is inaccurate and benefits child sex abusers because it:

indicates legitimacy and compliance on the part of the victim and therefore legality on the part of the abuser; and

conjures images of children posing in 'provocative' positions, rather than suffering horrific abuse.

Every photograph or video captures an actual situation where a child has been abused.

First Operation Arkstone offender to be sentenced in Queensland

A 23-year-old man charged under Operation Arkstone yesterday became the first Queenslander sentenced for his role in the large-scale online child abuse network.

The man, charged with multiple child abuse offences, including producing child abuse material, using a carriage service to transmit and possess child abuse material, and bestiality offence, received an 18 month jail sentence in Hervey Bay Magistrates Court.

He was sentenced to 18 months’ imprisonment with a non-parole period of four months.

The man was charged in May 2020 as part of Operation Arkstone, a nationwide child protection operation where details were announced in November 2020.

The AFP found 23 videos containing child abuse material on the man’s electronic devices. The items were seized during the search warrants executed at the man’s home in Hervey Bay in May 2020.

Operation Arkstone was launched in February 2020 following the arrest of a 30-year-old Central Coast man for child abuse offences. The initial referral was made to the AFP-led Australian Centre to Counter Child Exploitation (ACCCE) from the United States’ National Center for Missing and Exploited Children.

Child protection investigators uncovered a global online network of alleged child sex offenders after examining evidence seized in February 2020.

The investigation has resulted in the arrest of 20 men in Australia for 1297 offences and has removed 55 Australian children from harm.

AFP Senior Constable Alexander Evans said viewing and sharing videos of children being abused fueled a horrific industry centred on the exploitation of some of most vulnerable in our society.

“No child should ever experience the horrific acts depicted in the videos and images that we as child protection investigators have to examine every day,” Senior Constable Evans said.

“We are determined and passionate about following every lead to identify alleged child sex offenders and ensure the safety of every child in our community from such abhorrent abuse.”

Logan man charged with possessing child abuse material

A 25-year-old man is expected to face court today (Friday, 27 August 2021) charged with child abuse-related offences by the Brisbane Joint Anti Child Exploitation Team (JACET).

The investigation began after the Australian Federal Police-led Australian Centre to Counter Child Exploitation (ACCCE) received a report from the National Center for Missing and Exploited Children (NCMEC) about child abuse material being transmitted between two email accounts.

Investigators from Brisbane JACET, which comprises AFP and Queensland Police officers, allegedly linked the 25-year-old man to both Yahoo email accounts.

A search warrant was executed at the man's Holmview home in July 2021, with officers seizing an Acer laptop and downloading the Yahoo account material that both allegedly contained child abuse material (CAM).

Police also seized an iPhone from the man which allegedly contained CAM.

The man was issued with notices to appear in Brisbane Magistrates’ Court for the following offences:

One count of possessing child abuse material accessed or obtained using a carriage service, contrary to section 474.22A of the Criminal Code Act 1995 (Cth); and

One count of using a carriage service to transmit child abuse material, contrary to section 474.22(1)(a)(iii) of the Criminal Code Act 1995 (Cth).

The maximum penalty for these offences is 15 years' imprisonment.

Detective Superintendent ACCCE and Child Protection Operations Paula Hudson said AFP investigators are dedicated to protecting children around the world from abuse and aim to destroy the vile industry that preys on our community’s most vulnerable.

“Our message to offenders accessing or exchanging child abuse material online is that we will never stop looking for you and we will bring you before the court.”

The ACCCE is committed to stopping child exploitation and abuse and is at the centre of a collaborative national approach to combatting organised child abuse.

The Centre brings together specialist expertise and skills in a central hub, supporting investigations into child sexual abuse and developing prevention strategies focused on creating a safer online environment.

Members of the public who have any information about people involved in child abuse and exploitation are urged to call Crime Stoppers on 1800 333 000 or report online.

If you or someone you know are impacted by child sexual abuse and online exploitation there are support services available.

Advice and support for parents and carers about how they can help protection children online can be found at ThinkUKnow, an AFP-led education program designed to prevent online child sexual exploitation.

=Cafe owner charged for not wearing mask not allowed into court for declining to wear mask

A south-east Queensland cafe owner arrested after she and her staff allegedly refused police directions to wear masks, has been unable to attend her court hearing in person because she would not put on a mask.

Key points:

Sarah Parsons was unable to make her court hearing in person after declining to wear a mask

The cafe owner is charged with allegedly refusing to wear a mask saying she has a medical exemption

The magistrate says she must wear a mask for her next appearance or a warrant will be issued for her arrest

Sarah Parsons, 38, was due to face Maroochydore Magistrates Court this morning on a contravene requirement charge but appeared by phone after security would not let her into the courthouse.

Ms Parsons told the court it was not her decision not attend in person.

"I was told that with a mask exemption I was not allowed to enter today so I was told to call instead," she said.

Magistrate Haydn Sjernqvist adjourned the matter to September 13 and told the court her reluctance to wear a mask would not be accepted as an excuse.

"Now, you might have some philosophical view about the world at the moment, including the requirement to wear a mask," he said.

"You will achieve nothing on the 13th if you don't come up to the first floor and talk to the prosecutor.

"And that may require you to wear a mask as everyone else is, entering the building. Do you understand?

"If you fail to appear, I'm going to issue a warrant for your arrest."

Ms Parsons told the court she was seeking legal advice, and would ask for the full brief of evidence from the prosecution including "copies of any and all body-worn camera footage", plus extra time to review it.

How the cafe owner ended up in court

Police said officers visited the New Earth Cafe in Coolum three times to ask Ms Parsons and her staff to wear a mask.

It was alleged the Ninderry woman refused each request and became verbally abusive towards officers.

In a video published shortly after her arrest, Ms Parsons said she and all staff at her cafe had medical conditions and were exempt from wearing masks.
