Elizabeth Holmes' Theranos trial delayed due to possible COVID exposure

Judge Edward Davila cancelled Friday's court proceedings as a juror reported awaiting results of a COVID test.

Elizabeth Holmes' hotly anticipated Theranos trial was called off for Friday after a juror reported a potential COVID exposure.

Judge Edward Davila made the announcement via an emergency virtual session Thursday evening that Friday's scheduled session had been cancelled. One of the jurors had emailed Davila that he may have been exposed to the virus but was not experiencing symptoms as he awaited the results of a test, NBC News reported.

"It's a little, I don't want to say ominous, but it's of concern that before we finish the first witness we have an issue," Davila said.

The trial is set to last for months with potentially more than 200 witnesses testifying.

Opening arguments started on Wednesday, when Holmes' defense attorneys argued the failure of health care startup Theranos was due to "technical" shortcomings rather than deception on the part of its disgraced founder. Holmes' attorney Lance Wade told jurors in a San Jose courtroom that the story of Theranos' remarkable fall was "far more human and real, and oftentimesโ€ฆ complicated and boring," according to The Wall Street Journal.

Holmes is charged with multiple counts of conspiracy and fraud over claims she made about the company's purportedly revolutionary blood-testing invention. Investigations revealed the technology had serious problems. In a few short years, Theranos went from being valued at $9 billion to one of the decade's more notorious Silicon Valley stories.

High-valued biotech start-up Theranos amped up its association with high-ranking government officials Thursday as Vice President Joe Biden joined a select group of healthcare industry leaders at the company's lab in Newark, Calif.

Theranos was started a decade ago by Elizabeth Holmes, who envisioned a new blood-testing process that requires less blood (drops compared to vials) at lower costs (fertility panels run $35, cholesterol checks for $3).

The company recently won Food and Drug Administration approval for its lab work as well as its test for the herpes virus. Theranos also helped push an Arizona bill into law on July 3 that allows patients to order blood tests without doctor approval. The FDA also granted the company a waiver that would enable it to create a suite of point-of-care products, akin to the way home pregnancy tests are administered by consumers. Most of Theranos' Wellness Center outlets are in Arizona, with one near its headquarters in Palo Alto, Calif., and another in central Pennsylvania.
