New Yorker’s ‘repugnant’ bid to marry their own child rejected by judge
A judge has tossed a lawsuit brought by a New Yorker who wanted to marry their own child and sued to overturn laws against incest.
The unidentified parent, labeled as “John Doe” in the Manhattan Federal Court papers, asked to stay anonymous — because they realized the request was considered “repugnant,” according to the litigation.
Incest is a third-degree felony under New York law, punishable by up to four years behind bars, and incestuous marriages are considered void, with the spouses facing a fine and up to six months in jail.
Marriage licenses in the five boroughs require potential spouses to list their birth parents and attest there are “no legal impediments to the marriage,” according to the City Clerk’s Office.
The city quickly moved to dismiss the case, noting the parent hadn’t even popped the question before filing the claim in April.
On Sept. 13, the judge agreed, but a lawyer for the parent quickly sought to overturn the decision on appeal.
