Federal officer arrested carrying gun at ‘Justice for J6’ rally won’t be charged but officials won’t say why

A spokesman for the US attorney’s office in Washington said they were “not moving forward with charges” against the unidentified 27-year-old New Jersey man, according to the Associated Press.

The spokesman did not provide any further information as to why they were not charging the suspect, despite two law enforcement officials speaking on condition of anonymity saying that he was not at the rally in any official capacity.

While the “Law Enforcement Officers’ Safety Act” exempts active and retired officers from local and State prohibitions on carrying concealed firearms while off duty, it does not apply within the US Capitol Grounds.

The US Capitol Police says agents face arrest, fines, and imprisonment if bringing a weapon to the grounds while not performing official duties. Any law enforcement officer acting in an official capacity needs to contact the Capitol Police to determine if they can carry a firearm under “established criteria”.

US Capitol Police confirmed in a tweet that the man was charged with “unlawful activities” under 40 U.S. Code § 5104 for possessing a gun, but did not mention that he showed a badge or any law enforcement credentials during the arrest.

Opinion Piece

Gen. Milley's China debacle, and how Trump revealed the cracks in an antiquated system

It is important, first of all, to remember that Woodward and Costa’s methods make it impossible to judge the accuracy of these alleged conversations. But the bombshell reporting clearly raises serious questions. Did Milley exceed his responsibilities as the country’s leading military officer, undermine the powers of the president and set a dangerous precedent for American civil-military relations? What does this also tell us about crisis management and our nuclear weapons safeguards?

Milley reached out a second time in the aftermath of the assault on the U.S. Capitol to reassure the Chinese that the U.S. government remained stable. Milley reportedly told Li that “democracy can be sloppy sometimes.”

Milley has argued that these calls were “perfectly within the duties and responsibilities” of his job. And indeed, it is routine for U.S. government officials to speak with their counterparts — allies as well as potential adversaries — on a regular basis. I can personally testify to this based on my own experience working in the White House during a crisis.

Trump won these counties big. His supporters question the results there, too.

Pushes to revisit November's results are underway or being called for in at least nine counties Trump won by more than 24 points.

Former President Donald Trump won Mesa County, Colorado, by 28 points in last fall's election.

In Barry County, Michigan, he won by more than 32 points. And in Lander County, Nevada, his victory was in excess of 61 points.

Yet in each county, Republican officials have sought to further investigate those results and, in some cases, suggested they may not be accurate. That's despite no evidence of widespread fraud in the 2020 election there or elsewhere.

With denial of President Joe Biden's victory at the core of the pro-Trump movement, demands for partisan election investigations styled after the one authorized by Republicans in Arizona — focused in a county Biden won — have proliferated. Now, a push to revisit November's results is underway or being called for in at least nine counties Trump won by more than 24 points.

Still, in Michigan’s Barry County, Sheriff Dar Leaf hired a private investigator he said came recommended by a lawyer on pro-Trump attorney Sidney Powell's “Kraken” lawsuit team to help conduct an unusual probe he launched in July. (Powell and other lawyers would later be sanctioned for what a federal judge called a “historic and profound abuse of the judicial process.”)

Leaf, who last year sought to enlist other Michigan sheriffs to seize the Dominion voting machines at the heart of the election conspiracy concocted on the far right, had his office and a private investigator, Michael Lynch, interview a series of township clerks. The Barry County GOP clerk criticized the effort and told the news organization Bridge Michigan that Leaf's team sought to "surprise" the officials.

FBI says fortune seized in Beverly Hills raid was criminals’ loot. Owners say: Where’s the proof?

After the FBI seized Joseph Ruiz’s life savings during a raid on a safe deposit box business in Beverly Hills, the unemployed chef went to court to retrieve his $57,000. A judge ordered the government to tell Ruiz why it was trying to confiscate the money.

It came from drug trafficking, an FBI agent responded in court papers.

Ruiz’s income was too low for him to have that much money, and his side business selling bongs made from liquor bottles suggested he was an unlicensed pot dealer, the agent wrote. The FBI also said a dog had smelled unspecified drugs on Ruiz’s cash.

The FBI was wrong. When Ruiz produced records showing the source of his money was legitimate, the government dropped its false accusation and returned his money.

Some lawyers for box holders say the government’s entire operation is a “money grab” to acquire tens of millions of dollars for the Justice Department through forfeiture. A spokesman for the U.S. attorney’s office denied that and said some of the money it recovers will go to crime victims.
