The question is: how serious is "tarring" someone? What's the penalty for lying to the public? Creating false stories?
If they can prove it was just lying and slander, the FBI is off the hook. They have to prove that the FBI "KNOWINGLY" moved forward with the investigation fully aware that the information was false.
