Below you see the criminal code of Germany about the formation of criminal associations.

§ Section 129

Formation of Criminal Associations

(1) A person who establishes or participates as a member in an association whose purpose or activity is directed towards the commission of criminal offences punishable by a maximum term of imprisonment of at least two years shall be liable to a custodial sentence not exceeding five years or to a monetary penalty. A penalty of up to three years' imprisonment or a fine shall be imposed on anyone who supports such an association or recruits members or supporters for it.

(3) Paragraph (1) shall not apply,

if the association is a political party which the Federal Constitutional Court has not declared unconstitutional.

The law doesn’t apply to political parties in Germany.
