With Kamala Harris no longer in the upper chamber, Bernie Sanders took over the “dumbest senator in America” title this year, and he’s hard at work maintaining the crown.

 

The socialist began Wednesday by reiterating that “two people do not have the right to sabotage what 48 want and what the president of the United States wants.”

 

This moronic statement could be dispelled by an alert kindergartener.

 

First, two people are not holding up the other 48; it’s 52 people, though I realize the Vermonter probably doesn’t consider Republicans to be humans.

 

And second, it does not matter “what the president of the United States wants” because Joe Biden has no vote in Congress.

 

Bernie has a low IQ but he still knows this. Yet as someone whose supporters are mostly children, he wants what he wants now. This is the person Democrats put in charge of their budget strategy with a split Senate. I can’t imagine why they are struggling.

 

Sanders is not only a socialist but also an ignorant bum who doesn’t understand basic economics, loathes America’s role in the world, and, so far as I’ve seen, never had an original idea. He is particularly dangerous because he believes his own hokum.

 

Even at age 80, the senator buys Marxist claptrap that’s destroyed societies for centuries. Perhaps this is why he’s failed in presidential runs, and his 2020 aspirations ended so abruptly with a startling collapse.

“The federal government is using its power to silence and intimidate American citizens,” said conservative talk radio host and author Mark Levin, who released a bombshell letter on his program Thursday. “They’re trying to chill free speech.”

 

The letter, from the nonprofit organization America First Legal (AFL) to the United States Inspector General claims, “In light of the Attorney General’s Memorandum of October 4, 2021, it appears the Department of Justice is committing the full weight of its federal law enforcement resources to prevent parents from exercising constitutionally-protected rights and privileges, for inappropriate partisan purposes.”

The AFL says it’s an inside job by “key Biden Administration stakeholders, including the National Education Association, the American Federation of Teachers, and others, have combined to oppress, threaten, and intimidate parents to chill and prevent them from exercising the rights or privileges secured by the Constitution. To date these efforts, though extensive, have generally proven ineffectual.”

 

And it wasn’t just any insiders. AFL believes high-ranking officials in the Biden White House staff and the Department of Justice (DOJ) have been meeting since early September to collude in the writing of not only Attorney General Garland’s memorandum but to “develop a plan to use a letter from an outside group as pretext for federal action to chill, deter, and discourage parents from exercising their constitutional rights and privileges.”

 

In other words, AFL says the Biden administration was in on the unconstitutional effort to mitigate the “political impact of parent mobilization [at school board meetings] and organization around school issues [like CRT and mask mandates] in the upcoming midterm elections” all along. And who was that “outside group”? The good old National School Board Association (NSBA). Remember them and their September 29 letter calling America’s concerned parents “domestic terrorists”? I wrote about them here.

So now we know why we had never heard of the NSBA before because during the White House and the DOJ meetings they planned to send the letter not from “the usual suspects,” meaning the leftist teachers’ unions, but from the NSBA, which is supposed to represent America’s parents. And now the AFL suggests that the short time for the AG’s memorandum to be written and made public after the NSBA’s letter was sent to Biden is suspect as well:

 

The short time frame between the September 29 letter and the Attorney General’s Memorandum suggests that either the entire matter was precoordinated and the September 29 but pretext, or that the normal clearance process and standard order both within the department (including legal sufficiency review by the Office of Legal Counsel, the Civil Rights Division, the Criminal Division, the Office of Legal Policy, and other components), and between the department and the White House Counsel’s Office and the Office of Management and Budget, were bypassed or corrupted.

 

But wait, there’s more. According to AFL, the Biden administration didn’t stop at intimidating American citizens—it taught those same officials how to skirt the law to further implement the very school issues parents are concerned about:

 

On October 5, there was a follow-up call involving, inter alia, the White House Counsel’s Office, [a Biden political appointee in the Civil Rights Division], and many other Biden Administration political and career officials.

 

The briefing included how to talk about “equity” initiatives, avoid liability for violating discrimination laws, and hide “equity” measures, initiatives, and action from Freedom of Information Act disclosure.

 

Clearly, the NSBA letter and the AG’s memorandum were fishy from the get-go and it’s not yet clear exactly who was involved, but if standard processes and legal practices were broken by the Biden administration in order to weaponize the federal government to intimidate and silence American citizens in the name of politics, there needs to be an immediate investigation to hold all participants to account—and that includes The Big Guy.

 

Let’s hope there’s at least one trustworthy Inspector General left at the Department of Justice who will take up this case. America is looking at you, Michael E. Horowitz.

Joe Biden’s Vaccine Mandate Doesn’t Exist. It’s Just A Press Release

Yes, we’ve heard all about Joe Biden’s alleged vaccine mandate for private companies employing 100 or more people. It was all over the news even before he announced it on September 9. His announcement has jeopardized the employment of millions of Americans and increased worker shortages in critical domains such as health care.

 

There’s only one problem. It’s all a mirage. Biden’s so-called vaccine mandate doesn’t exist — at least, not yet. So far, all we have is his press conference and other such made-for-media huff-puffing. No such rule even claiming to be legally binding has been issued yet.

 

That’s why nearly two dozen Republican attorneys general who have publicly voiced their opposition to the clearly unconstitutional and illegal mandate haven’t yet filed suit against it, the Office of the Indiana Attorney General confirmed for me. There is no mandate to haul into court. And that may be part of the plan.

 

According to several sources, so far it appears no such mandate has been sent to the White House’s Office of Information and Regulatory Affairs yet for approval. The White House, the Occupational Safety and Health Administration (OSHA), and the Department of Labor haven’t released any official guidance for the alleged mandate. There is no executive order. There’s nothing but press statements.

 

Despite what you may have been falsely led to believe by the media fantasy projection machine, press statements have exactly zero legal authority.

 

“There is nothing there yet that gives employers any mandate,” Stephanie McFarland, spokeswoman for the Indiana Occupational Safety and Health Administration, told me Oct. 6. “The president made an announcement on this asking OSHA to do it, but we’ve not yet seen anything come from it yet,” she also said. When the state agency gets any further information, she said, they’ll review it.

 

To impose the public perception of a mandate, the Biden administration is following an unusual rule-making process it also employed earlier this year, called an emergency temporary standard (ETS). The spring ETS rule took nearly six months to issue. Meanwhile, companies are telling reporters their vaccine mandates will have at the latest December deadlines. (For those who can’t calendar, that’s four months after Biden’s non-existent mandate was proclaimed. According to OSHA, an ETS takes up to six months to go into effect after the initial mandate is issued in the Federal Register — which, again, for the proclaimed 100-employee mandate hasn’t happened yet.)

 

Lawyers for big business were blunt about their love for this mandate mirage: “Everybody loves this cover,” Minneapolis employment lawyer Kate Bischoff told Bloomberg Law in September. “Many were already looking down the road at doing this, but the fact that they get to blame Biden is like manna from heaven.”

 

Using the ETS procedure instead of normal federal rule-making processes both allows the Biden administration to push its demands faster and without any public input or requirement of responding to public input, which is normally required of even legally laughable federal rule-making like this one would be. That is part of why ETS rules have been overwhelmingly overturned in courts.

 

“OSHA has used that legal authority only 10 times in 50 years,” David Rivkin Jr. and Robert Alt wrote in the Wall Street Journal in September. “Courts have decided challenges to six of those standards, nixing five and upholding only one.”

 

There are many other reasons any federal vaccine mandate would be obviously illegal and unconstitutional, Rivkin and Alt write, including that “The states have plenary police power to regulate health and safety. Congress has only those limited powers enumerated in the Constitution. That wouldn’t include the authority to impose a $155 fine (today’s equivalent of the $5 at stake in Jacobson) on an individual who declines to be vaccinated, much less to prevent him from earning a livelihood.”

But who needs the Constitution when you have an American people conditioned for compliance with even wildly outlandish things the screen people insist they must think and do?

 

Earlier this week, the Wall Street Journal published a letter from Bruce Atkinson making several excellent observations about the nonexistent mandate, including the following:

 

The mandate’s nonexistence shields the Biden administration from legal challenges that may ultimately restrict the Occupational Safety and Health Administration’s authority. Yet the mandate is still effective at compelling industries and companies into compliance, as it leaves room for any eventual issuance to target noncompliant entities. This implied cudgel is particularly effective on industries and companies that are dependent on federal spending or the goodwill of federal regulators. The nonexistent mandate also allows so-inclined state and local governments and companies to issue their own mandates, seemingly in lockstep with Washington.

 

The Biden White House has been well-served by presenting a nonexistent mandate as a done deal.

 

Now, let me see, what presidential administration does all this remind you of? Why, that of Mr. “Pen and Phone” himself, Barack Obama.

 

His also wildly unconstitutional Deferred Action for Child Arrivals was simply a two-page memo, for example, but it is still allowing some 616,000 people to simply ignore major U.S. laws, and could easily be reinstated by courts as litigation continues nearly a decade later. It seems that, given such unchecked gains from openly lawless actions Democrats have turned into standard operating procedure over the years, Joe Biden feels free to reduce that constitutional contempt to simply a phone now.

 

What this “government by press release” also allows is for Republicans like Indiana Gov. Eric Holcomb to complain about Biden’s tyranny while using zip, nada, zilch of their elected authority to stop it. Holcomb has used the same executive rule-by-decree throughout the lockdown era without effective restraint by a supermajority-Republican state legislature, even telling the press churches were required to deliver Christ’s Body and Blood his way while quietly keeping that part out of his executive orders, surely because government dictating religious exercise is obviously unconstitutional and would quickly have generated lawsuits.

 

All this allows weak Republicans and evil Democrats to shadowbox each other for the cameras while ordinary Americans suffer under their abdicated leadership. By the time Republican attorneys general get around to filing lawsuits over any eventually issued legal documents that fulfill Biden’s promises, the vast majority of people not wanting government to force them into medical procedures will likely be unemployed, forcibly injected with treatments that have almost no track record, forced from their education paths, provided with fake documents like these citizens are beneath COVID-rule-exempt illegal aliens, and all the rest.

 

This is how weak Republicans keep letting Democrats go right on gleefully disemboweling our rights just like they have nearly 50 million of the American unborn. Gee, thanks, “public servants.” Tell me another one about how you love American liberties and the Bill of Rights. I’ll believe that when I see you sacrificing anything substantial to fight for them.

 

What Democrats are doing as Republicans stand down yet again is a moral and constitutional abomination. Not even the fig-leaf pose of a pen signing balderdash-filled documents is needed for today’s Democrats. Whatever they say, you do. You have no rights or say in the matter, no possibility for objecting to even them forcibly injecting things into your own body and the bodies of your children.

 

These people believe they are royalty, and too many Americans are acting like they’re these losers’ serfs instead of citizens endowed by God with inalienable rights, including the right to consent — through elected representatives, not never-elected dictatorial bureaucrats — to rules that restrict our rights, everyday lives, and human dignity.

Former Border Patrol Chief Rodney Scott revealed on Tuesday that the Biden administration is paying contractors not to build a wall on the southern U.S. border and that “for a while, it was almost $5 million a day between DOD and DHS.”

 

In an exclusive interview with Fox News’s Bret Baier, Scott said that after Joe Biden assumed the White House, he issued a presidential proclamation that paused U.S. border projects for 60 days. Now more than 250 days since the inauguration and thanks to the Biden administration, Scott says many of those projects are still on hold despite contractors still being paid and having the materials to work on border security.

 

According to Scott, all that remains of former President Donald Trump’s border wall efforts are “stacks and stacks” of panels, “hundreds of miles of fiber-optic cabling,” and “hundreds of cameras” that are just “sitting there.”

 

“There’s no action being taken,” Scott explained. And despite Border Patrol telling the Biden White House in briefings that the border would suffer “unmitigable disaster” if Trump’s policies end, the Democrat administration’s position is simply, “We’re not building more wall.”

 

Just last month, large numbers of illegal aliens flooded the border waiting to be processed by the border agency. At one point, nearly 8,200 migrants were camped out at the International Bridge in Del Rio, Texas — and the number continued to grow. Fox News’s Bill Melugin described the situation as “out of control,” and Texas Gov. Greg Abbott ordered the Texas Department of Public Safety and the Texas National Guard to help shut down parts of the southern border.

 

Before Biden ousted him from his law enforcement role on the border, Scott witnessed people caught from 150 different countries coming through Mexico to try to reach the United States.

 

“There are huge sections of the U.S. border — you pick the state — we know we have thousands of people waiting to come across,” Scott said, blaming the administration’s soft approach and lack of initiative for the crisis. “There are hundreds of miles of border and there’s not a single border agent right now. Why? Because they’re in a soft-sided facility that we set up at another $5-6 million a month, to babysit, to process, and to expedite the process of these people.”

 

Amid the crisis, Scott said others in border security must be called to Congress so they can “speak the truth … as opposed to right now they just can’t.”

The September 12–24 migrant camp crisis in Del Rio displayed two lessons very much worth unpacking from the White House response.

 

DEL RIO, Texas — The migrant encampment under the international bridge here is liquidated, the 15,000 mostly Haitian illegal migrants who had pooled under it gone to different futures (most paroled into the United States but others flown to Haiti). Bulldozers have erased all trace evidence that anything of much note ever happened here.

 

Except that much of note did happen during the September 12–24 migrant camp crisis in Del Rio, including two lessons very much worth unpacking from the White House response, which saw this as a political canker sore and therefore swiftly ended it. If retained and refined, these two moves hold the power to prevent a recurrence of new such camps but, perhaps more importantly, to douse the far wider mass migration crisis from which this one spawned….

It appears things are not well in vaccineland. Top COVID experts are reportedly urging President Joe Biden to relax a bit on the “Y’all gotta get the booster shot” campaign. Even more juicy is the fact that these experts are clashing with Dr. Anthony Fauci, who has been constantly on cable television pushing Americans to accept the vax as their personal Lord and savior.

 

Politico reported on a “growing split” between the president’s team and outside health experts over the issue of booster shots. The outlet indicated that this rift “threatens to disrupt a key source of support the administration has relied on to sell its vaccination drive to the American public.”

 

Biden had the support of prominent physicians who believed his messaging on the COVID vaccine was on point. But now, even those who have lauded his approach to the pandemic are criticizing the administration’s current messaging on booster shots, pointing out that it is causing confusion.

 

Irwin Redlener, director of the Pandemic Resource and Response Initiative at Columbia University, told Politico that the administration’s messaging “undermines credibility not just for [federal health] agencies but for the administration overall.” He continued: “Somebody needs a communication lesson. Maybe many people do.”

 

A spokesperson for Health and Human Services (HHS) said:

 

We are doing all we can to offer Americans the maximum protection afforded by vaccines, including constantly working to increase the number of primary vaccinations as well as ensuring boosters are available to all who are eligible.

 

The president’s team typically has regular phone meetings with health experts to discuss talking points or to discuss upcoming announcements. Politico reported:

 

Now, with the FDA preparing to authorize boosters from Moderna and Johnson & Johnson, top federal health officials have reached out to administration surrogates to promote the government’s approach. Biden’s team is stressing the importance of using boosters to prevent breakthrough infections, even mild cases.

 

These conversations are happening as tensions between scientists working with the CDC and FDA and other officials are becoming more pronounced. The conflict is mostly over messaging. The most recent call, which occurred on Sept. 27, was rescheduled after the CDC’s vaccine advisory committee suggested that the booster only be given to people who are in high-risk groups – especially the elderly.

 

According to three people who had information on the phone call, this one “was the tensest one to date.” Fauci took issue with the CDC’s assessment that the boosters should not be given to all adults. What a shocker, right?

 

Politico reported that “He dismissed suggestions that the administration had to choose between a broad U.S. booster campaign and donating vaccines to countries in need.”

 

The president’s chief medical adviser also suggested to the experts that the boosters should be widely distributed to the population to decrease the spread of the virus and not just to prevent severe symptoms or death. The report notes that some of the experts on the call “were left mystified” about the administration’s messaging strategy.

 

“It was very tense,” said of the individuals on the call. “More than anything, it was like Fauci felt he needed to make a point.”

 

Essentially, Fauci and other members of Biden’s team wish to go all Oprah with the boosters – “You get a booster! You get a booster!” But the outside experts concur with the FDA and CDC and believe it should be targeted to those with underlying health conditions.

 

Fauci’s position on boosters isn’t surprising given that only a week ago, he intimated that things would get to the point that in order to be considered fully vaccinated, everyone would need to have both two vaccines and a booster. However, the fact that the outside experts, along with the CDC and FDA believe it should only be targeted to people who are more at risk makes one wonder if Biden will still “follow the science.”

 

It is unlikely that the president will listen to the naysayers even though the science seems to be on their side. The reality is that when the White House says “Trust the science,” they’re really saying “Trust the science that supports what we want to do.”

 

This kerfuffle and confusion over boosters might actually dissuade Americans from taking the additional jab. Unfortunately, it is unlikely that these experts will speak out against the vaccine mandates that the left is pushing, especially in blue states. For the time being, it appears there is no light at the end of that particular tunnel.
