Couric wasn't unaware of the of the import of RBG'sstatement, as she admits. She wanted to, "protect" RBG, which was more important, to her, than people being given the opportunity to lead a decent life.
Couric, then, doesn't seemed to be concerned concerned about (other, I guess) people leading decent lives.
Thus we return to Occam's razor, "Entities should not be multiplied beyond necessity", AKA "the simplest explanation is usually the best one."
It was malice.
