Is that how you read my post? I said "He's playing a game and this is how it is played." Meaning that he knows he's a target and he knew that they would try something like this. He's got nothing vital on that phone except what he needs from day to day. The real info is in a secure place. He played dumb with Hannity specifically to protect his sources.
Evidence can be ruled "inadmissible" if it was obtained using an "illegal" method. Like searching someone's residence without a warrant. Evidence can also be accidentally "found" which is one method that Q alludes to. Think Hunter's laptop.

Don't flipping know but the other thing is that civilians get a lot more leeway than the police do. Civilians don't need a warrant. As long as the evidence was not obtained illegally (like by breaking and entering).
